REGULATION OF THE GOVERNMENT
of 23 December 2003. in March 2005,
laying down the technical requirements on recreational vessels
partly completed recreational craft and their selected parts,
jet skis and propulsion engines of recreational craft and personal watercraft
The Government ordered pursuant to section 22 of Act No. 22/1997 Coll., on technical
requirements for products and amending and supplementing certain acts, as amended by
Law No 71/2000 Coll. and Act No. 205/2002 Coll. (hereinafter the "Act") to
the implementation of § 11 (1). 2, § 11a paragraph. 2, section 12 and 13 of the Act:
§ 1
The subject of the edit
(1) this regulation in accordance with the law of the European Communities ^ 1)
(hereinafter referred to as "the community") sets out the technical requirements

1. recreational craft and partly completed recreational craft,
2. personal watercraft,
3. the selected part of the recreational craft, if they are placed on the market
Community (hereinafter referred to as the "market") separately and when intended for installation;
(b)) in terms of exhaust emissions on the
1. the propulsion engines which are installed or specifically intended to
installation on recreational craft and water scooters, or,
2. propulsion engines undergoing major engine modification that are installed
or specifically intended for installation on recreational craft, and of water
scooters, or,
(c)) in terms of the noise emission of the
1. recreational craft with stern drive engines without integral exhaust
system or with inboard engines,
2. recreational craft with stern drive engines without integral exhaust
system or with inboard engines or larger vessels and treatment
subsequently placed on the market within five years following conversion,
3. personal watercraft,
4. outboard engines and stern drive engines with integral exhaust
intended for installation on recreational craft;
If they are intended for placing on the market.
(2) in terms of the design and the implementation of this Regulation shall not apply to
and) recreational craft and personal watercraft manufacturer intended and marked
exclusively for racing,
(b)), canoes, kayaks, boats powered by oars, paddles or propelled and steppers,
(c)) oplachtěná boards
(d)) and the boards surfboards with a motor drive,

(3) in terms of exhaust emissions, this Regulation shall not apply to

designated solely for racing,
2. to test the vessels then not listed on the market,
3. on board vessels specially designed for the transport of persons, undertaken in

§ 2
The basic concepts
(1) for the purposes of this regulation, means a

stern drive engines with or without integral exhaust and
outboard engines,
(hereinafter referred to as "products").
(2) for the purposes of this regulation, further means
and) major engine modification,
1. could cause the engine to exceed the emission limit values referred to in
part B of annex 1 to this regulation, with the exception of the normal Exchange of
part of the engine, which does not alter the emission characteristics, or
2. increases the rated power of the engine by more than 15%,
(b)) major craft conversion adjustment, that
1. changing the type of propulsion of the vessel,

(c)) kind of propulsion machinery drive, which the craft is driven, in particular

with regard to exhaust emissions,
(e) basic technical requirements) set out the requirements for products

§ 3
Basic technical requirements

§ 4
Conditions for the placing on the market
(1) the products may be placed on the market only for the use of

§ 5
Conformity assessment procedures
(1) before putting the set out products on the market, the manufacturer or his

§ 6
The CE marking and other labelling

§ 9

§ 10

Basic technical requirements for the products
BASIC SAFETY REQUIREMENTS AND THE DESIGN AND CONSTRUCTION OF VESSELS
For the purposes of this annex, vessels shall mean the recreational craft and the water
scooters.
1. In GENERAL

1.3. Basic provisions
1.3.1. The vessel must not jeopardise the safety and health of persons, property and
the environment must meet the requirements of this annex, which

3. Integrity and structural REQUIREMENTS

5. INSTALLATION REQUIREMENTS

5.5. the gas system
5.5.1. Gas system for residential purposes must be of the type with the vapour and
fumes and must be constructed and installed so as to avoid
the gas leak and explosion hazard and to test its tightness.

stress and the effects arising from changes in the marine environment.
5.5.2. each gas-consuming appliance must have a device to prevent escape
gas flame, effective for all burners. Each gas

adequate ventilation to prevent hazards from leaking
gas and fumes.
5.5.3. The vessel with fixed gas installations must have
enclosed space to store all the gas bottles. Enclosed space must
be separated from residential areas, accessible only from the outside and ventilated to the outside,
that the gas was discharged overboard. Each is firmly installed

5.6. Fire protection
5.6.1. General
For the type of installed equipment and for the arrangement of vessels must be taken into
account of the risk of the emergence and spread of fire. Special attention must be
paid around open flame devices, hot surfaces,
engines and auxiliary machines, spilling oil and fuel, uncovered pipes
for oil and fuel, and avoid keeping electrical wiring over
hot surfaces.
5.6.2. Fire-extinguishing equipment
The vessel must be equipped with fire-fighting equipment appropriate to the type of
the danger of fire, and must indicate the location and capacity of this fire-fighting
the device. The vessel must not be put into service until
a suitable fire-fighting equipment. Enclosed spaces with a petrol engine must
be protected by a fire-fighting equipment, which does not require the need to open

1.1. Each engine must be clearly marked, indicating the following information:

(d)) the CE marking, if required under section 6.
1.2. These marks must endure after the normal life of the engine and

exhaust, personal watercraft and outboard engines and stern drive engines
integral exhaust shall comply with the following basic
requirements for noise emissions.
1. NOISE EMISSION LEVELS
1.1. Recreational craft with inboard or stern drive engines without
integral exhaust, personal watercraft and outboard engines and
stern drive engines with integral exhaust shall be designed,

4. Surveillance under the responsibility of the authorized person

(C) of annex 1 to this regulation,-the basic requirements for noise emissions.
Annex 11
The minimum requirements for authorized persons
1. the Authorized person as a whole and the individual persons who are its
statutory bodies or members of the statutory body, or staff
responsible for the activities of conformity assessment and the implementation of the verification
the tests shall not be the designer or manufacturer of the products,
over which the supervision nor any of the authorised person
the participating parties. They shall not become either involved directly or as authorised
the person in the design, manufacture, marketing or maintenance of the laid down
of the products. This does not preclude the possibility of exchanges of technical information between the

Product quality assurance (conformity assessment procedure-module E)
1. This procedure provides for a conformity assessment procedure whereby the manufacturer who
fulfils the obligations in point 2, ensures and declares that the product
is in conformity with the type as described in the EC type-examination certificate and
meets the requirements of this regulation, the Governments that apply to it.

3.3. The authorised person shall assess the quality system to determine whether the
satisfies the requirements referred to in point 3.2.
3.3.1. in the case of systems that implement the relevant harmonized standard
compliance with these requirements.
3.3.2. In the group control personnel must be at least one Member
who has experience of assessments of the technology concerned. Part of the

assessment decision.
4. Surveillance under the responsibility of the authorized person
4.1. the purpose of surveillance is to ensure that the manufacturer duly fulfils the obligations
arising out of the approved quality system.
4.2. the manufacturer will allow authorized person for inspection purposes to the
