REGULATION OF THE GOVERNMENT



of 23 December 2003. in March 2005,



laying down the technical requirements on recreational vessels

partly completed recreational craft and their selected parts,

jet skis and propulsion engines of recreational craft and personal watercraft



The Government ordered pursuant to section 22 of Act No. 22/1997 Coll., on technical

requirements for products and amending and supplementing certain acts, as amended by

Law No 71/2000 Coll. and Act No. 205/2002 Coll. (hereinafter the "Act") to

the implementation of § 11 (1). 2, § 11a paragraph. 2, section 12 and 13 of the Act:



§ 1



The subject of the edit



(1) this regulation in accordance with the law of the European Communities ^ 1)

(hereinafter referred to as "the community") sets out the technical requirements



and construction and) in terms of the implementation of the



1. recreational craft and partly completed recreational craft,



2. personal watercraft,



3. the selected part of the recreational craft, if they are placed on the market

Community (hereinafter referred to as the "market") separately and when intended for installation;



(b)) in terms of exhaust emissions on the



1. the propulsion engines which are installed or specifically intended to

installation on recreational craft and water scooters, or,



2. propulsion engines undergoing major engine modification that are installed

or specifically intended for installation on recreational craft, and of water

scooters, or,



(c)) in terms of the noise emission of the



1. recreational craft with stern drive engines without integral exhaust

system or with inboard engines,



2. recreational craft with stern drive engines without integral exhaust

system or with inboard engines or larger vessels and treatment

subsequently placed on the market within five years following conversion,



3. personal watercraft,



4. outboard engines and stern drive engines with integral exhaust

intended for installation on recreational craft;



If they are intended for placing on the market.



(2) in terms of the design and the implementation of this Regulation shall not apply to



and) recreational craft and personal watercraft manufacturer intended and marked

exclusively for racing,



(b)), canoes, kayaks, boats powered by oars, paddles or propelled and steppers,



(c)) oplachtěná boards



(d)) and the boards surfboards with a motor drive,



e) original historical craft and their copy, if you were as a copy

g) recreational craft and personal watercraft produced for their own use for the

(3) in terms of exhaust emissions, this Regulation shall not apply to



and) propulsion engines which are installed or specifically intended to

1. recreational craft and water scooters by the manufacturer and

designated solely for racing,



2. to test the vessels then not listed on the market,



3. on board vessels specially designed for the transport of persons, undertaken in

under business, while casting his own crew, ^ 2)



4. the submersibles,

7. on vessels of the police of the Czech Republic and the fire brigade

§ 2



The basic concepts



(1) for the purposes of this regulation, means a



and) recreational craft any boat of any type intended for

sports or leisure purposes of hull length from 2.5 m to 24 m

regardless of the type of drive,

(c)) the selected parts of the recreational craft



1. protecting the inboard and stern drive engines before the unwanted

ignition,

designed for control by a person or persons, which sits, stands or kneels

on the hull, rather than inside it,



(e) positive ignition engine or propulsion) compression ignition internal combustion engine that is used to

propulsion purposes, including two-stroke and four-stroke inboard engine

stern drive engines with or without integral exhaust and

outboard engines,



(hereinafter referred to as "products").



(2) for the purposes of this regulation, further means



and) major engine modification,



1. could cause the engine to exceed the emission limit values referred to in

part B of annex 1 to this regulation, with the exception of the normal Exchange of

part of the engine, which does not alter the emission characteristics, or



2. increases the rated power of the engine by more than 15%,



(b)) major craft conversion adjustment, that



1. changing the type of propulsion of the vessel,



2. includes a larger adjustment of the engine, or



3. change the vessel to the extent that it is considered a new vessel,



(c)) kind of propulsion machinery drive, which the craft is driven, in particular

Marine propellers or waterjet mechanical drive systems;



(d)) a group of engines by the manufacturer's grouping of engines which, is

possible with regard to their design, are expected to have similar properties

with regard to exhaust emissions,



(e) basic technical requirements) set out the requirements for products

their design and construction, on exhaust emissions and noise emissions

in terms of safety, health, the environment and the requirements of the

on the protection of the user,



(f) the built-in engine propulsion engine) built inside the vessel

§ 3



Basic technical requirements



Set the products must meet the basic technical requirements referred to in

Annex 1 to this regulation; partly completed recreational craft

must meet the basic technical requirements referred to in annex No. 1 to the

§ 4



Conditions for the placing on the market



(1) the products may be placed on the market only for the use of

(2) the recreational craft and personal watercraft may be placed on the market if

one manufacturer, his authorized representative or the importer has applied

the procedures for assessment of conformity with the technical requirements laid down in

products (hereinafter referred to as "conformity assessment procedures"), pursuant to section 5 and went about

EC declaration of conformity in accordance with section 10, paragraph 1. 2.



(3) the partly completed recreational craft may be placed on the market,

(5) stern drive engines with integral exhaust and outboard engines

§ 5 and released about EC declaration of conformity in accordance with section 10, paragraph 1. 2. Built-in

(6) for trade fairs, exhibitions, demonstrations, and other similar

sign clearly indicates that such products may not be placed on the market

or put into service until they are in compliance with this regulation.



(7) the placing of recreational vessels in operation, including selected

§ 5



Conformity assessment procedures



(1) before putting the set out products on the market, the manufacturer or his

the authorized representative or the importer apply conformity assessment procedures

referred to in paragraphs 3 to 9.



(2) in the case of the assessment of the recreational craft after its manufacture, if

the manufacturer, his authorized representative or the importer fails to comply with the obligations

relating to conformity assessment in accordance with this regulation, may be the recreational

EC type-examination, supplemented by the conformity assessment procedures referred to in-

Annex 12 to this regulation-product quality assurance (how to

conformity assessment-module B + E),



4. the conformity assessment procedure referred to in annex 4 to this regulation-

EC type-examination, supplemented by the conformity assessment procedure referred to in

Annex 7 to this regulation,-the product verification (procedure for assessment

conformity-module B + F)



5. the conformity assessment procedure referred to in annex 8 to this regulation-

authentication of individual products (conformity assessment procedure-module G)

or



6. the conformity assessment procedure referred to in annex 9 to this regulation-

comprehensive quality assurance (conformity assessment procedure-module H).



(4) in terms of the design and construction of products referred to in section 1 (1). 1 (a).

§ 6



The CE marking and other labelling



(1) the CE marking must be affixed to their placing on the market of these

§ 8

§ 9



Protective measures



(1) if it is found that the products referred to in article 1, which are equipped with

§ 10

(2) the EC declaration of conformity attached to the products referred to in paragraph 1 shall

be drawn up in the Czech language, as well as in the language of the Member State

Basic technical requirements for the products



BASIC SAFETY REQUIREMENTS AND THE DESIGN AND CONSTRUCTION OF VESSELS



For the purposes of this annex, vessels shall mean the recreational craft and the water

scooters.



1. In GENERAL



1.1. the structural categories of vessels

1.3. Basic provisions



1.3.1. The vessel must not jeopardise the safety and health of persons, property and

the environment must meet the requirements of this annex, which

apply to it, and must be designed and constructed in accordance with the

good shipbuilding, mechanical engineering and electrical engineering practice (hereinafter referred to as

"good practice") so as to meet those parameters, the appropriate design

3. Integrity and structural REQUIREMENTS



3.1. Structure

must be paid to the design category as defined in Chapter 1 of this annex and

manufacturer's maximum recommended load according to section 3.6.



3.2. Stability and freeboard



The vessel shall have sufficient stability and freeboard corresponding to its

Design category as defined in Chapter 1 of this annex and the Supreme

5. INSTALLATION REQUIREMENTS



5.1. Engines and engine spaces

5.2. Fuel System



5.2.1. General

Fuel tanks, pipes and hoses must be attached and separated or

5.4. Steering gear



5.4.1. General



The steering gear must be so designed, constructed and installed in such a way,

to allow the transfer of forces to the control under foreseeable operating

terms and conditions.



5.4.2. emergency resources



The sailboat, and the vessel with a single built-in motor and with remote

operated steering gear shall be provided with emergency resources

to control the vessel at reduced speed.



5.5. the gas system



5.5.1. Gas system for residential purposes must be of the type with the vapour and

fumes and must be constructed and installed so as to avoid

the gas leak and explosion hazard and to test its tightness.

Materials and components shall be suitable for the type of gas used and resistant

stress and the effects arising from changes in the marine environment.



5.5.2. each gas-consuming appliance must have a device to prevent escape

gas flame, effective for all burners. Each gas

the appliance must be isolated from the supply and distribution system must be

controlled by a separate closing device. It must be ensured

adequate ventilation to prevent hazards from leaking

gas and fumes.



5.5.3. The vessel with fixed gas installations must have

enclosed space to store all the gas bottles. Enclosed space must

be separated from residential areas, accessible only from the outside and ventilated to the outside,

that the gas was discharged overboard. Each is firmly installed

gas equipment must be tested after installation.



5.6. Fire protection



5.6.1. General



For the type of installed equipment and for the arrangement of vessels must be taken into

account of the risk of the emergence and spread of fire. Special attention must be

paid around open flame devices, hot surfaces,

engines and auxiliary machines, spilling oil and fuel, uncovered pipes

for oil and fuel, and avoid keeping electrical wiring over

hot surfaces.



5.6.2. Fire-extinguishing equipment



The vessel must be equipped with fire-fighting equipment appropriate to the type of

the danger of fire, and must indicate the location and capacity of this fire-fighting

the device. The vessel must not be put into service until

a suitable fire-fighting equipment. Enclosed spaces with a petrol engine must

be protected by a fire-fighting equipment, which does not require the need to open

the engine compartment in the event of fire. If the vessel is equipped with a portable

Propulsion engines shall comply with the following essential requirements for

exhaust gas emissions.



1. ENGINE IDENTIFICATION



1.1. Each engine must be clearly marked, indicating the following information:



and) trademark or trade name of the manufacturer of the engine,



(b)), or the engine type series engines



(c)) the specific engine identification number,



(d)) the CE marking, if required under section 6.



1.2. These marks must endure after the normal life of the engine and

must be clearly legible and indelible. If the apply decals

or labels, must be attached in such a way as to withstand the after

the normal life of the engine and could not be removed without their

destruction or damage.



1.3. These marks must be secured to an engine part that is

necessary for the normal operation of the engine, and which normally does not require Exchange

3. The LIFE



3.1. The engine manufacturer must deliver instructions for installation and maintenance, during which

specified limit values after the normal life of the engine under normal

3.2. Necessary information must obtain the engine manufacturer on the basis of the results of the

on the market. The manual shall contain:

C. ESSENTIAL REQUIREMENTS FOR NOISE EMISSIONS

exhaust, personal watercraft and outboard engines and stern drive engines

requirements for noise emissions.



1. NOISE EMISSION LEVELS



1.1. Recreational craft with inboard or stern drive engines without

integral exhaust, personal watercraft and outboard engines and

stern drive engines with integral exhaust shall be designed,

constructed and assembled so that noise emissions measured test procedure

of the management with regard to product quality,



(b)) methods, processes and systematic actions that will be used when

production, quality control and quality assurance,

3.4. The authorised person shall assess the quality system to determine whether it

satisfies the requirements referred to in point 3.2. and 3.3. Compliance with these requirements is

3.5. the group control personnel for the assessment of the quality system must

have at least one member with experience in technology assessment

4. Surveillance under the responsibility of the authorized person



4.1. the purpose of surveillance is to ensure that the manufacturer duly fulfils the requirements

arising out of the approved quality system.



4.2. For the purposes of supervision, the manufacturer must allow access to authorized person

point 2 of part B of annex 1 to this regulation,-the basic requirements for

exhaust emissions from propulsion engines



h) sound emissions test reports demonstrating compliance with section 1 of part

(C) of annex 1 to this regulation,-the basic requirements for noise emissions.



Annex 11



The minimum requirements for authorized persons



1. the Authorized person as a whole and the individual persons who are its

statutory bodies or members of the statutory body, or staff

responsible for the activities of conformity assessment and the implementation of the verification

the tests shall not be the designer or manufacturer of the products,

over which the supervision nor any of the authorised person

the participating parties. They shall not become either involved directly or as authorised

the person in the design, manufacture, marketing or maintenance of the laid down

of the products. This does not preclude the possibility of exchanges of technical information between the

2. the Authorized person and its personnel must carry out the verification tests

Product quality assurance (conformity assessment procedure-module E)



1. This procedure provides for a conformity assessment procedure whereby the manufacturer who

fulfils the obligations in point 2, ensures and declares that the product

is in conformity with the type as described in the EC type-examination certificate and

meets the requirements of this regulation, the Governments that apply to it.

The manufacturer or his authorized representative or the importer must produced in the

d) quality records, such as. the protocols on the results of tests, inspections,

data, calibration data, reports concerning the qualifications of the personnel concerned, and other

similar data.



3.3. The authorised person shall assess the quality system to determine whether the

satisfies the requirements referred to in point 3.2.



3.3.1. in the case of systems that implement the relevant harmonized standard

compliance with these requirements.



3.3.2. In the group control personnel must be at least one Member

who has experience of assessments of the technology concerned. Part of the

the assessment must include an inspection visit to the manufacturer's premises.



3.3.3. the decision shall be notified to the manufacturer in writing and without undue

about the assessment.



3.4. the manufacturer shall undertake to fulfil the obligations arising from the

the quality system as approved and to maintain it so that it remains

the person who approved the quality system of any intended adjustment to

the quality system.



3.4.2. The authorised person shall evaluate the proposed changes and decide whether the

modified quality system will still satisfy the requirements referred to in point 3.2.

or whether a re-assessment is required.



3.4.3. The authorised person shall notify the manufacturer of its decision in writing and without

undue delay. The notification must contain the conclusions of the examination and the reasoned

assessment decision.



4. Surveillance under the responsibility of the authorized person



4.1. the purpose of surveillance is to ensure that the manufacturer duly fulfils the obligations

arising out of the approved quality system.



4.2. the manufacturer will allow authorized person for inspection purposes to the
