" TECHNICAL COOPERATION AGREEMENT BETWEEN THE REPUBLIC OF COLOMBIA AND THE REPUBLIC OF PERU FOR THE DEVELOPMENT OF SCIENTIFIC AND TECHNICAL ACTIVITIES, ASSISTANCE AND HEALTH PROMOTION IN THE BORDER AREA COLOMBO-PERUVIAN

The Governments of the Republics of Colombia and Peru, with motiv or the official visit to Peru of the Excelentisimo Mr. President of the Republic of Colombia, Dr. Cesar Gaviria Trujillo;

CONSIDERING the interest of the Governments of the Republics of Colombia and Peru in strengthening their border relations in the field of health in the framework of administrative decentralization and expressed in. several bilateral agreements and agreements.

EAGER to strengthen, the bonds of friendship and cooperation, convinced of the multiple benefits derived from a mutual technical, scientific and technological collaboration in the health sector and its importance for the strengthening of the actions aimed at the economic and social development of both nations.

IN APPLICATION of the Health Strategy, for all in the year 2000 and provided for in the first article of the Hipolito Unanue Convention that sets the goal of improving health in the countries of the Andean area.

I note that the Hipolito Unanue Convention and the PAHO/WHO signed an agreement on 28 November 1974, in which it is established that the Convention, through its permanent bodies, may request the PAHO/WHO to present initiatives and Sub-regional programmes of interest to be considered by the respective management bodies of the two institutions and by which the PAHO/WHO undertakes to provide their cooperation and technical support within their budgetary possibilities.

CONSIDERING also that the United Nations agreed on Technical Cooperation between countries as a general development strategy to be implemented by all governments and to be implemented, PAHO/WHO has promoted in the countries the "sub-regional initiatives", in order to produce a greater and faster impact on the health conditions of the most deprived human groups.

RECALLING that, at the meeting of Ministers of Health of the Andean Area REMSAA, held in 1987, Resolution REMSAA N ° 12/192, entitled Andean Cooperation Document on Health "The United States for Health", was adopted. Andean Health Cooperation, "CAS", as a joint work program, which concentrates efforts on priority health issues for Andean countries.

AGREE to sign the present Convention of Technical Cooperation for the Development of Scientific and Technical Activities, Assistants and Health Promotion in the Border Zone C olombo-Peruana.

ARTICLE FIRST. OBJECT.

The purpose of this Convention is to develop the mechanisms of Technical Cooperation between the Government of Colombia and the Government of Peru for the joint search for appropriate solutions for common health problems in the border area. colombo-peruana.

The parties undertake, within the limits of their competences, to give a renewed impetus to their relations of technical cooperation in health, based on the principles of mutual benefit, respect and reciprocity, which is proposed by the comprehensive health sector in the border area.

ARTICLE SECOND. GEOGRAPHIC LOCATION.

This convention has as a geographical area of execution the departments and border provinces between the two countries.

ARTICLE THIRD. GOALS.

The objectives of this Agreement for Technical Cooperation in Health are:

-Contribute to improving the quality of life of the populations of the border area covered by the second article of this agreement, giving priority to the least favored groups with emphasis on rural, urban and marginal areas indigenous.

-To jointly and jointly optimize the rational use of economic, technical and human resources to provide care with timely and continuous health services.

-Design and maintain an agile epidemiological surveillance system of the main pathologies of the border area.

-Promote the maintenance of an adequate level of health in the border population.

ARTICLE FOURTH. TECHNICAL COOPERATION PROGRAMS IN HEALTH.

The Health Technical Cooperation Programs in force for this convention are:

-Maternal and Child Health with emphasis on prenatal care, Stop care, Family Planning, Immunizations Program (Epidemiological Surveillance, Improvement of the Cold Chain), EDA, IRA.

-Prevention and control of priority pathologies in the area such as: communicable diseases (Cholera, Tuberculosis), Metaxenics (Malaria, Dengue, Leishmaniasis), sexually transmitted diseases (AIDS), Zoonosis (Oncoercosis and Wildlife) and accidents Caused by ponzonous animals.

-Epidemiological surveillance (implementation, reinforcement of reference laboratories).

-Basic Sanitation.

-Disaster and emergency prevention and mitigation.

-Design and assembly of a binational system of preventive, healthcare, curative and rehabilitation health with emphasis on the pathologies of the border area included in the second article of this convention.

ARTICLE QUINTO. WORK PLAN.

The health services of the geographical area covered by the second article of this agreement, with the support of the Ministries of Health of Colombia and Peru, as well as regional and subregional competent bodies, will jointly develop The Annual Work Plan and the schedule of activities and budget according to each country's budget laws, in order to operate the present agreement, which in turn will serve as the basis for the mobilization of technical cooperation resources. international, if required.

The Work Plan and schedule of activities shall be formulated within 90 days of the entry into force of this Agreement, and shall be evaluated and adjusted annually.

The Job Plan must contain:

In the cost budget, the Plan of Labor will have to identify the contributions of the institutions of both countries committed to it, as well as the contributions of the competent regional and subregional agencies, when appropriate. Activities that are not possible to defray with the resources already mentioned must be registered as international cooperation needs, for which it will be necessary to formulate a specific application for their presentation to third sources of international cooperation by the entities that have signed this agreement.

ARTICLE SIXTH. MODALITIES OF COOPERATION.

Technical Cooperation in Health provided for in this Convention may include:

-Exchange of experts and specialists to execute the Work Plan and the Activity Cronogram.

-Training and training activities.

-Supply of materials and equipment required for the execution of the Job Plan.

-Using facilities and centers that are needed for the performance of the activities.

-Exchange of technical, scientific and technological information.

-Any other technical cooperation activity that is agreed between the parties.

ARTICLE SEVENTH. COMMITMENTS.

The Governments of the Republics of Colombia and Peru through their Ministries of Health acquire the following commitments:

-Designate as implementers for the implementation of this agreement to the International Cooperation Directorate (Colombia) and the Office of Financing, Investments and External Cooperation (Peru), with the technical support of the relevant areas of each Ministry.

-To appoint as coordinators of the Plan of Work to the heads or their delegates of the Sectional Health Services of Amazonas and Putumayo, and to the Director of the Region of Health of Loreto.

-Collaborate on the identification and identification of the necessary resources in the budgets of the implementing entities for the development of the Work Plan.

-Identify through the representations of competent regional and subregional agencies in Colombia and Peru, the possibility of financial support from the Annual Work Plan through the APB (annual program of activities) and PTC (program of Four-monthly work) for the years of validity of this Convention.

-Make documents, progress reports issued pursuant to the implementation of the Work Plan available to the entities that are signatories to this convention.

-To present, if necessary, request for resources from the Pan American Health Organization/World Health Organization to finance one-off activities against projects, for Technical Cooperation between the Pares-TCC.

ARTICLE EIGHTH. MONITORING AND EVALUATION.

-The executing entities of the work plan will send semestrally to the International Technical Cooperation offices of the Ministries of Health of Colombia and Peru, a progress report on the implementation of the Convention.

-An evaluation and adjustments meeting will be performed annually to the job plan for the following year.

-Progress and evaluation reports should report coverage changes, epidemiological surveillance indicators, and indicators of improvement of service delivery.

ARTICLE NINTH. AUDITING.

Audit work will be carried out by the person or persons selected by the signatory entities in accordance with their rules, regulations and policies.

Audit reports shall be delivered to the entities that are signatories to this Convention.

DECIMAL ITEM. PERSONAL.

The personnel commissioned by each of the countries for compliance with the agreement will maintain their employment relationship with the institution to which they belong. The implementation of this Convention shall not generate additional contractual links.

ARTICLE TENTH FIRST. CONTROVERSIES.

Any dispute that may arise from the interpretation, application and execution of this Convention shall be settled by direct agreement between the parties.

ARTICLE TENTH SECOND. MODIFICATIONS.

This agreement may be modified with the express consent of the parties.

ARTICLE TENTH THIRD. DURATION AND DURATION.

This agreement shall enter into force from the date on which the parties communicate by diplomatic means the fulfilment of their internal requirements that will implement it, and will last for three years.

ARTICLE TENTH QUARTER. EXTENSION.

This convention shall be automatically extended for an equal period, unless one of the parties expresses in writing otherwise, sixty days in advance of the due date.

ARTICLE TENTH FIFTH. COMPLAINT.

This convention may be denounced by either party through written communication to the other party. The complaint shall take effect 60 days after the date of receipt of the relevant notification.

The obligations assumed by the parties, under this agreement, shall continue to terminate or terminate the agreement as necessary in order to permit the fulfillment of the commitments previously entered into.

EXPLANATORY STATEMENT

Honorable Senators and Representatives:

On behalf of the National Government and in compliance with articles 150 numeral 16 and 189 numeral 2 of the Political Constitution of Colombia, we present to the honorable Congress of the Republic the Bill, through which the Convention of Technical Cooperation between the Republic of Colombia and the Republic of Peru for the Development of Activities is approved Scientific-Techniques, Assistants and Health Promotion in the Border Zone Colombo-Peruana, subscribed in Lima, to the twelve (12) days of the month of July of a thousand nine hundred and ninety-four (1994).

This Convention was signed with the primary purpose of jointly seeking appropriate solutions for the common health problems in the Colombo-Peruvian border area, in order to achieve an improvement in the quality of life of the populations that inhabit the geographical area of their execution and, thus, jointly and jointly optimize the rational use of economic, technical and human resources to provide care with timely and continuous health services.

The governments of Peru and Colombia consider this to be a key instrument in the Andean integration process, which responds to the need to strengthen their border relations in the field of health, thus enabling the Exchange of health actions for the benefit of the peoples that make up the Andean area.

It is important to note that the conclusion of the Convention is within the framework of Articles 226 and 227 of our Political Constitution, which They have the orientation of foreign policy toward Latin American and Caribbean integration and the internationalization of political, economic, social and ecological relations on the basis of equity, reciprocity and national convenience. and, which point to the State's obligation to promote integration economic, social and political with the other nations, and especially with the countries of Latin America and the Caribbean.

Additionally, Decision 501 of the Andean Council of Foreign Ministers establishes the framework in which the member countries, by means of bilateral mechanisms that they agree, will be able to develop, if they consider it, at their borders or with third countries Border Integration Zones (ZIF), which are established in order to generate optimal conditions for sustainable border development and for border integration between the member countries of the Community Andean.

On the other hand, it should be noted that the relations of friendship and cooperation between the Republic of Colombia and the Republic of Peru have always existed, since both nations have been convinced of the multiple benefits derived from the a mutual technical, scientific and technological collaboration in the health sector and, of its importance for the strengthening of the actions aimed at economic and social development; for which they have considered it necessary to implement mechanisms of technical cooperation to improve the health of the nationals of the two countries.

The Convention of Technical Cooperation between the Republic of Colombia and the Republic of Peru for the Development of Scientific-Technical Activities, Assistants and Health Promotion in the Colombo Peruvian Border Zone, is made up of a Preamble and 15 Articles on which the purpose of the conclusion of the Convention is established, the objectives of the Convention, the geographical location, the technical cooperation programmes in health, its modalities and the plan of work to be carried out, the budget laws of each country.

Within this context, the areas of cooperation in the field of maternal and child health, prevention and control of priority pathologies in the area, epidemiological surveillance, basic sanitation, prevention and mitigation of disasters are highlighted. emergencies and design of an integrated binational system of preventive health care and rehabilitation, with emphasis on the pathologies of the border area.

The commitments of the two States through their Ministries of Health are established and the mechanisms for monitoring, evaluation and audit of the Convention are defined.

Importance of the Convention

This Convention sets up a mechanism that allows and encourages the development of strategies to strengthen border relations in the field of health in the framework of administrative decentralization, through technical cooperation, with positive repercussions for the improvement of the living conditions of the inhabitants of the geographical area of execution, of the departments and border provinces between the two countries; the joint search for appropriate solutions for the common health problems and the general prosperity of people living in the border area Colombo Peruvian, as well as to protect and promote the dissemination of the optimization of economic, technical and human resources that allow to provide timely and continuous health care.

There is no doubt that the conclusion of international health agreements seeks to make effective the aims of the internationalization of social relations and also seeks to ensure greater cultural cooperation. economic, social and political among the nations, thus ensuring the fulfilment of the objective of improving the quality of life of its inhabitants.

For the reasons stated, the National Government, through its Foreign and Health Ministers, submits to the honorable Congress of the Republic the Technical Cooperation Agreement between the Republic of Colombia and the Republic of Peru for the Development of Scientific-Technical Activities, Assistants and Health Promotion in the Colombo-Peruvian Border Zone, signed in Lima, at the twelve (12) days of the month of July of a thousand nine hundred and ninety-four (1994).
