«Agreement CULTURAL between the Government of the Republic of COLOMBIA and the GOBI ERNO of LA Republic of Turkey the Government of the Republic of Colombia and the Government of the Republic of Turkey, with the desire to strengthen the friendly relations between the two countries and to promote and develop the cultural, educational and scientific cooperation, have agreed as follows : ARTICLE 1. The Contracting Parties undertake, through the present agreement to stimulate the educational, scientific and cultural cooperation between the two countries.
To this end, the Contracting Parties, within their relevant areas, promote: to) visits by university professors and other people engaged in scientific research quality of teachers;
(b) studies of language and literature of each of the countries in the universities and other institutions of education in the country.

ARTICLE 2. The Contracting Parties through their competent agencies, will determine scholarship choosing to grant in their respective countries, with the purpose of facilitating studies or research culture, educational or scientific, in accordance with the regulations and procedures established in each State.

ARTICLE 3. The Contracting Parties shall encourage the exchange of:-exhibitions and artistic performances; conductors, soloists, theatre groups and ensembles through the competent organizations.
-Books, publications, scientific and educational films, translations of literary and scientific works.

ARTICLE 4. Both sides will conduct exchanges of information on cultural events and international film festivals that are held in each country.

ARTICLE 5. The Contracting Parties, through the relevant institutions shall provide, within the framework of their national legislation, cooperation between radio and television institutions.

ARTICLE 6. The Contracting Parties shall encourage cooperation between sports and youth organizations of the two countries, encouraging visits by teams and providing, subject to laws and regulations in force, their stay and movement in their respective countries.

ARTICLE 7. The Contracting Parties shall agree on periodically, programs which promote initiatives to develop the cooperation of both countries in the field of culture, literature, science and education.

ARTICLE 8. The parties agree to establish a Joint Committee composed of members designated by each of them, which will meet alternately in Bogota or Ankara.
The Joint Commission will have for main functions:-prepare and negotiate cultural programs designed by the present agreement;
-Coordinate the different s activities and exchanges referred to in this agreement;
-Submit appropriate formulas which facilitate their implementation;
-Seek the resolution of any questions which may arise in their implementation and, in general, consider any initiative that fosters and strengthens the cultural relations between the two countries.

ARTICLE 9. Any dispute that may arise from the interpretation or application of this agreement, will be solved given through diplomatic channels.

ARTICLE 10. This agreement shall be subject to the constitutional and legal requirements of each of the parties for approval, and shall enter into force on the date of the exchange of instruments of ratification.

ARTICLE 11. This agreement will have a duration of five (5) years, after which it will automatically renew for periods of one year, unless one of the parties communicate in writing to the other, through diplomatic channels, its intention to so terminate in advance of six (6) months from the date of expiration of the respective term.

ARTICLE 12. This agreement may be denounced by either party by written communication shall take effect three (3) months after the date of receipt of the corresponding notification.
Unless otherwise agreed by the parties, the termination or denunciation of this Agreement shall not affect the continuation of the programs that are running.
Done in the city of Caracas to the 9 days of the month of September 1991 in two copies, each in Spanish, English, both being equally valid and authentic.

His Excellency: I am writing to your Excellency in order to refer to the Cultural agreement between the Government of the Republic of Turkey and the Government of the Republic of Colombia, signed at Caracas on September 9, 1991.
On this issue, the Embassy has the honour to communicate that the Congress of Turkey requires as a prerequisite for the adoption of the above-mentioned Convention, incorporate a text in Turkish language as valid. In view of this, and on behalf of the Government of Turkey is suggested by the present note, the reform of the last paragraph of the Cultural Convention, in the following terms: "Made in the city of Caracas, to the nine days of the month of September in thousand nine hundred ninety-one, in three copies, each in English, Spanish, Turkish, being these texts equally authentic and valid".

EXHIBITION of motives Honourable senators and representatives: on behalf of the national Government and in compliance with the provisions of articles 150 paragraph 16 and 189 paragraph 2 of the Constitution politics of the Republic of Colombia, have the honour to submit to your consideration the Bill by means of which approve the "agreement Cultural between the Government of the Republic of Colombia and the Government of the Republic of Turkey" made in Caracas, nine (9) of September of thousand nine hundred ninety and one (1991) and the "Exchange of notes amending it" on February 23, 2000 and March 30, 2000.
Vision Colombia and Turkey established diplomatic relations on April 10, 1959, by Exchange of notes, done through the missions of the two countries to the United Nations in New York. During these 41 years of relations, Turkey is located in a place destac ated within our trading partners in the Middle East. It is the third destination of Colombian exports in that area (after Israel and Saudi Arabia). As well as the second country of origin of our imports in the region.
Turkey is an important market, taking into account that it has around 62 million inhabitants and a high level of income per capita, US$ 2,900. Similarly, Turkey has signed free trade agreements with the European Union and is a neighbour of markets of great importance in the region, such as the former ex - Soviet republics of Georgia, Armenia and Azerbaijan, among others.
From the participation of Colombia to the movement of non-aligned countries - NOAL-, relations have shown a positive balance, as both countries have mutual support (vote) for the achievement of candidates that are of interest for one and another country in forums and international bodies. An example of this is the simple support that recently offered Turkey to Colombia for its candidacy to the Security Council - UN - initiative and first proposed a cultural instrument, arose from the Government of Turkey through its Ambassador in Caracas in the year 1989. The interest manifested by the diplomatic representatives of the Government of Turkey, during the negotiation and signing of the instrument, gives to understand the goodwill and willingness to facilitate its implementation underway once it enters into force.
Contained in the text of the Convention, in its articles first to eighth, are established clearly the commitments made by the parties to achieve as objective the development of each of the areas of interest covered by the agreement. It is as well as cultural cooperation is highlighted by the exchange of exhibitions, participation in events and bilateral in this field meetings, performances of musical groups, exchange of experiences between the entities of radio and television and other means of communication, information exchange, cultural events, international film festivals, working together for the development of cinematographic art, conclusion of programs which promote cooperation in the field of culture literature, science and education, exchange of publications, books, translations of literary and scientific works, scientific and educational films.
In what refers to cooperation in the field of education, it is vital to understand the importance of the promotion and Exchange that in all the fields of the educational area can occur between the two countries. The items one, two and three of the agreement include the educational and scientific cooperation.
The article 6o. refers to the promotion of cooperation between organizations, sports and youth, by encouraging visits by teams and facilitating your stay and movement in each country.
Within the eighth item, the parties in order to dynamise and give an applicability to the Treaty, proposed the creation of a Mixed Commission Colombo - Turkish with a particular mission to develop plans and programs of cooperation between the parties, to define its financial terms, coordinate activities and exchanges provided for by the agreement, present formulas appropriate to facilitate their implementation, seek solutions of doubts arising in its implementation and propose initiatives that promote and strengthen cultural relations.
Ninth to twelfth articles, specifies the mechanism to be followed in the event of any kind of controversy, as well as the procedures for their ratification and corresponding entry into force. Finally, joins bill approving the agreement concluded by an exchange of notes between the two Governments in order to modify the final paragraph of the Cultural agreement, change that was necessary to add the version in Turkish language of the Convention, without which this instrument could not be subjected to internal procedures of approval in that country.
The reading of the articles of the agreement is observed wide convenience, the undoubted beneficial effects that can arise for our culture as well as the future increase of exchanges between institutes and schools which will offer new opportunities to the youth of Colombia and Turkey.
Reasons considering that culture represents not only historical, material and spiritual values, but it also identifies the nature and unique origin of peoples, the Ministry of Foreign Affairs of Colombia has been, traditionally, a policy of bilateral approach that further strengthen existing ties with States whose relations have been preserved in other fields such as commercial financial and technical cooperation. Policy is based on establishing cultural relations based on instruments that allow the mutual approach of the different manifestations in this field, so that parties have a greater and better understanding of what their peoples. He is created in this way, a healthy approach, as mutual knowledge and exchange cultural manifestations of everyone, not only enriches and it universalizes the local cultures, but they also create the confidence necessary for the Exchange and relationship in other areas.
It is as well as the Ministry of Foreign Affairs of Colombia in accordance with the principles of mutual cooperation and reciprocity between peoples, saw fit to accept the proposal of Turkey to develop actions to sign Cultural agreement between the two countries, according to the purpose of providing mutual assistance in the cultural fields of art, science, education, cinema media, sport and youth exchanges.
The Convention in addition to providing the knowledge and dissemination of other cultures, gives us can advance efforts to the establishment, development and promotion of educational and academic cooperation and promote knowledge of national cultures.
For the national interest are of singular importance clauses of this international document, intended to give effect, in the field of culture, art, science, education, film, media, sport and youth exchanges, the good relations between the two countries.
Similar agreements have already been held with other Nations and uropeas and the lack of a Treaty of this kind with the Republic of Turkey, not justify in any way, it would be a failure in the national plan for the cultural development of our people.
The concern of the great Nations to strengthen and increase their cultural ties is notorious. The development of these cultural linkages implies a higher benefit for countries in recent history who, like ours, in these fields receive much more than they can deliver.
In accordance with the annotated before, and taking into account the importance of this agreement, it is of the utmost importance that fill the pending legislative approval before Congress as soon as possible.

For the above reasons, we permit ourselves to ask the Honorable Congress of the Republic adopted the "agreement Cultural between the Government of the Republic of Colombia and the Government of the Republic of Turkey", made in Caracas, nine (9) of September of thousand nine hundred ninety and one (1991) and the "Exchange of letters amending it" on February 23, 2000 and March 30, 2000.

LAW 424 (January 13) 1998 which ordered the follow-up to the international agreements signed by Colombia.
THE Congress of COLOMBIA Decree: article 1. The national Government through Ministry of Foreign Affairs shall submit annually to the latter commissions of Foreign Affairs of the Senate and house within the first thirty calendar days subsequent to the legislative period that begins each July 20, a report detailed how they are meeting and developing the existing international agreements signed by Colombia with other States.

Article 2nd. Each dependency of the national Government responsible for executing international treaties within their competence and require reciprocity in the same, transfer relevant information to the Ministry of Foreign Affairs, and, the latter commissions.

Article 3. The full text of this law will be incorporated as an annex to each and every one of the international conventions which the Ministry of Foreign Affairs submitted to the Congress for consideration.
