THE CONGRESS OF THE REPUBLIC,

Seen the texts of the "Cultural Agreement between the Government of the Republic of Colombia and the Government of the Republic of Turkey", made in Caracas, the nine (9) of September of a thousand nine hundred and ninety-one (1991) and the "exchange of notes that modifies it" of 23 February 2000 and 30 March 2000, which reads as follows:

" CULTURAL AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC

FROM COLOMBIA AND THE GOBI ERNO OF THE REPUBLIC OF TURKEY

The Government of the Republic of Colombia and the Government of the Republic of Turkey, with the desire to strengthen the friendly relations between the two countries and to promote and develop cultural, educational and scientific cooperation, have agreed to next:

ARTICLE 1. The Contracting Parties undertake, through the present agreement, to stimulate educational, scientific and cultural cooperation between the two countries.

To this end, the Contracting Parties, within their competent areas, will promote:

a) Visits of university professors and other people engaged in scientific research, as guest professors;

b) The language and literature studies of each country in the universities and other educational institutions of the other country.

ARTICLE 2. The Contracting Parties through their competent bodies shall determine the scholarships they deem appropriate to grant in their respective countries for the purpose of facilitating studies or research of a culture, educational or scientific nature, in accordance with the regulations and procedures established in each state.

ARTICLE 3. The Contracting Parties shall encourage the exchange of:

-Exhibitions and artistic presentations; orchestra directors, soloists, theatre groups and musical ensembles through the competent organizations.

-Books, publications, scientific and educational films, translations of literary and scientific works.

ARTICLE 4. Both Parties shall conduct exchanges of information on cultural events and international film festivals held in each country.

ARTICLE 5. The Contracting Parties, through the corresponding institutions, shall facilitate, within the framework of their national legislation, cooperation between radio and television institutions.

ARTICLE 6. The Contracting Parties shall foster cooperation between sports and youth organizations of the two countries, stimulating team visits and facilitating, subject to laws and regulations. national, their stay and movement in the respective countries.

ARTICLE 7. The Contracting Parties will agree periodically, programs in which the initiatives aimed at developing the cooperation of both countries in the field of culture, literature, the science and education.

ARTICLE 8. The Parties agree to establish a Joint Commission composed of the members appointed by each of them, which will meet in either Bogota or Ankara.

The Mixed Committee will have main functions:

-Prepare and negotiate the cultural programs projected by this Agreement;

-Coordinate the various activities and exchanges covered by this Agreement;

-Present appropriate formulas to facilitate their execution;

-To seek the solution of any doubts that arise in its application and, in general, to propose any initiative that encourages and strengthens the cultural relations between the two countries.

ARTICLE 9. Any discrepancy that may arise from the interpretation or application of this Agreement shall be solved by diplomatic means.

ARTICLE 10. This Agreement shall be subject to the constitutional and legal requirements established in each of the Parties for approval and shall enter into force on the date of the exchange of the instruments of ratification.

ARTICLE 11. This agreement shall last for five (5) years, after which it shall be automatically renewed for periods of one year, unless one of the Parties communicates in writing to the other. through diplomatic channels, their intention to terminate it in advance of six (6) months to the expiration date of the respective term.

ARTICLE 12. This Agreement may be denounced by either Party through written communication that will take effect three (3) months after the date of receipt of the corresponding notification.

Unless otherwise agreed by the Parties, the termination or denunciation of this Agreement shall not affect the continuation of the programs that are being implemented.

Made in the city of Caracas at 9 days of September 1991 in two copies, each in Spanish, English, being both equally authentic and valid.

I address your Excellency in order to refer to the Cultural Agreement between the Government of the Republic of Turkey and the Government of the Republic of Colombia, signed in Caracas on September 9, 1991.

In particular, this Embassy has the honour to communicate that the Congress of Turkey requires as a requirement for the approval of the aforementioned Convention, to incorporate as valid a text in Turkish language. In view of this and on behalf of the Government of Turkey, the reform of the last paragraph of the Cultural Convention is suggested by this Note, in the following terms:

"Made in the city of Caracas, on the nine days of the month of September of a thousand nine hundred and ninety-one, in three copies, each in Spanish, English and Turkish, being such texts equally authentic and valid."

This Agreement is rare in force on the date of the exchange of the instruments of ratification in which the Parties communicate the fulfillment of the internal procedures required for this purpose.

If the enlightened Government of the Republic of Colombia is in accordance with the terms of this communication, this letter and the letter of reply, which shall be accepted by your Government, shall constitute an Agreement.

I am worth the opportunity to reiterate to Your Excellency the assurances of my highest and most distinguished consideration.

REASON EXPOSURE

Honorable Senators and Representatives:

On behalf of the National Government and in compliance with the provisions of Articles 150 numeral 16 and 189 numeral 2 of the Constitution Policy of the Republic of Colombia, we have the honor to submit to your consideration the Bill by means of which the "Cultural Agreement between the Government of the Republic of Colombia and the Government of the Republic of Turkey" is approved, made in Caracas, nine (9) September, nine hundred and ninety-one (1991) and the "Exchange of Letters" amending it " of 23 February 2000 and 30 March 2000.

Vision

Colombia and Turkey established diplomatic relations on April 10, 1959, through an exchange of letters conducted through the missions of both countries to the UN in New York. During these 41 years of relations, Turkey has been located in an unbroken place within our trading partners in the Middle East. It is the third destination for Colombian exports in that area (after Israel and Saudi Arabia). As well as the second country of origin of our imports in the region.

Turkey is an important market, taking into account that it has about 62 million inhabitants and a high level of income per capita, US$ 2,900. Similarly, Turkey has signed Free Trade Agreements with the European Union and is a neighbor of markets of great importance in the region, such as the former Soviet republics of Georgia, Armenia and Azerbaijan, among others.

From the participation of Colombia to the Non-Aligned Movement (NAM), relations have shown a positive balance, because in the international forums and organizations both countries have the mutual support (the vote) for the achievement of the of candidates that are of interest to one and another country. An example of the above is the simple support that Turkey recently offered to Colombia for its candidacy for the UN Security Council

The initiative and first proposal of a cultural instrument emerged from the Government of Turkey through its Ambassador in Caracas in the year of 1989. The interest expressed by the diplomatic representatives of the government of Turkey, during the negotiation and subscription of the Instrument, gives an understanding of the willingness and willingness to facilitate its implementation once it enters into force.

Content

In the text of the Convention, in its articles first to eighth, the commitments made by the Parties to achieve the development of each of the sectors of interest for which the Agreement is dealt with are clearly established. In this way, cultural cooperation stands out for the exchange of exhibitions, participation in bilateral events and meetings in this field, artistic presentations of musical ensembles, exchange of experiences among the entities of radio and television and other media, information exchange, cultural events, international film festivals, joint work for the development of film art, concertation of programmes in which promote cooperation in the field of culture, literature, science and education, exchange of books, publications, scientific and educational films, translations of literary and scientific works.

As regards cooperation in the field of education, it is vital to understand the importance of the promotion and exchange that in all fields of the educational area can be given between the two countries. Articles one, two and three of the Agreement highlight educational and scientific cooperation.

Article 6o. refers to the promotion of cooperation between sports and youth organisations, stimulating team visits and facilitating their stay and movement in each country.

Within the eighth article, the Parties in order to energize and give an applicability to the treaty, propose the creation of a Joint Colombo-Turkish Commission with the particular mission of drawing up plans and programs of cooperation between the parties, define their financial terms, coordinate activities and exchanges provided for in the Agreement, present appropriate formulas to facilitate their implementation, seek solutions of doubts arising in their implementation and propose initiatives to promote and strengthen cultural relations.

In the ninth to twelfth articles, the mechanism to follow in case of any kind of controversy is specified, as are the procedures for its ratification and corresponding entry into force. Finally, the Agreement concluded by an Exchange of Letters between the two Governments is incorporated into the draft law, in order to amend the final paragraph of the Cultural Agreement, which was necessary to add the Turkish language of the Convention, without which this instrument could not be subject to internal approval procedures in that country.

From the reading of the article of the Agreement you can see its wide convenience, the undoubted beneficial effects that it can derive for our culture, as well as the future increase of exchanges between institutes and schools that provide new opportunities for the youth of both Colombia and Turkey.

Reasons

Considering that Culture not only represents spiritual, material and historical values, but also identifies the nature and only origin of the peoples, the Ministry of Foreign Affairs of Colombia is developing, traditionally a policy of bilateral rapprochement which will further tighten existing ties with the States whose relations have been preserved in other areas such as commercial, financial or technical cooperation. Policy is based on establishing cultural relations based on instruments that allow for the mutual approach of different manifestations in this field, so that the parties have a greater and better understanding of what are their peoples. It is created in this way, a healthy approach, because mutual knowledge and exchange the cultural manifestations of each one, not only enriches and universalizes the local cultures, but also creates the necessary trust for the exchange and relationship in other areas.

This is how the Colombian Foreign Ministry, in line with the principles of mutual cooperation and reciprocity between the peoples, saw fit to accept Turkey's proposal to develop actions aimed at signing the agreement. Cultural Agreement between the two countries, with the aim of providing mutual assistance in the cultural fields of art, science, education, film, media, sport and youth exchanges.

The Convention, in addition to providing the knowledge and dissemination of other cultures, gives us the opportunity to bring forward actions aimed at the establishment, development and promotion of educational and academic cooperation and to promote knowledge of national cultures.

similar agreements have already been concluded with other nations and European countries and the lack of a Treaty of this kind with the Republic of Turkey would not be justified in any way, since it would be a failure in the national plan for the cultural development of our people.

The concern of the great nations is notorious for strengthening and increasing their cultural ties. The development of these cultural nexus implies a superior benefit for the countries of recent history that, like ours, in these fields receive much more than they can give.

According to the above, and taking into account the relevance of this Agreement, it is of the utmost importance that the legislative approval procedure before Congress takes place as soon as possible.

For the reasons explained, we allow ourselves to request the Honorable Congress of the Republic to approve the "Cultural Agreement between the Government of the Republic of Colombia and the Government of the Republic of Turkey", made in Caracas, the nine (9) of September 2000, 2000 and 30 March 2000, and the "Exchange of Letters amending it" of 23 February 2000 and 30 March 2000.

The National Government through the Foreign Ministry will submit annually to the Senate and Chamber Foreign Relations Committees and within the first thirty days of the post-government calendar. legislative period starting every July 20, a detailed report on how the existing International Conventions signed by Colombia with other States are being complied with and developed.
