CONGRESS OF THE REPUBLIC

For which the Law 5is amended and added the law of 1992, the Legal Commission for the Equity of Women of the Congress of the Republic of Colombia is created and other provisions.

DECRETA:

ARTICLE 1o. OBJECT. This law aims to promote the participation of women in the exercise of legislative and political control through the creation of the Legal Commission for the Equity of Women of the Congress of the Republic.

ARTICLE 2o. Addition to Article 55 of the 5th Act of 1992, which will remain so:

Article 55. Integration, naming, and operation. In addition to the Legal Commissions identified for each of the Chambers with different competences, it will be necessary to integrate the system of the electoral quotient and the Constitutional Period, the Commission of Human Rights and Hearings, the Ethics and Statute Commission of the Congressman, the Commission on Documentary Accreditation and the Commission for Women's Equity.

ARTICLE 3o. Add to Chapter IV Section II of Title II of Law 5of 1992 with a new article of the following tenor.

Article 61A. Object of the Legal Commission for Women's Equity. This Commission aims to promote and promote the actions necessary for the consolidation of a State policy that has an impact on the improvement of the material and intangible circumstances of women in our society, The aim is to eliminate any situation of inequality and discrimination that is present in the exercise of citizenship by women.

ARTICLE 4. Addition to Chapter IV Section II, Title II of the 5 Act 1992 with a new article in the following tenor.

Article 61B. Composition. The Legal Commission for Women's Equity will have an interparliamentary character, will be composed of nineteen (19) congressmen, of whom ten (10) by the House of Representatives, and nine (9) by the Senate of the Republic, who shall be held jointly, subject to the convening of the Bureau.

PARAGRAFO 1o. In the event that no postulates are submitted by the male Congressmen, these quotas will be occupied by female Congressmen.

PARAGRAFO 2o. Members of this Commission must be designated within 15 days of the beginning of each ordinary legislature.

ARTICLE 5o. Addition to Chapter IV Section II, Title II of Act 5of 1992 with a new article of the following tenor.

Article 61C. Functions. The Commission for Women's Equity will have the following functions:

1. To draw up legislative proposals to ensure the realization of women's human, civil, political, economic, social and cultural rights, with the support of women's organisations and groups, research centres and other organizations that defend the rights of women.

2. To exercise political control over the various entities of the State in relation to the formulation and development of plans, programs, projects and public policies aimed at the recognition, promotion, realization, extension, protection and restitution of the civil, political, economic, social and cultural rights of women and the state of the treaties, conventions, protocols and recommendations of international bodies.

3. Promote the participation of women in the positions of popular choice and in the instances of leadership and decision within the different Ramas of the Public Power, organs of state structure, political parties and movements.

4. To be interlocutors of the women's organizations and groups, to the Public Power Ramas and other organs of the State structure, to channel their demands, to know their expectations and to process the solutions relevant to the realization of the rights of women.

5. Follow up on the processes of truth, justice, comprehensive reparation and non-repetition, so that the crimes committed against women and girls in the framework of the internal armed conflict do not remain in impunity.

6. Follow up on the results of the existing investigation and/or sanction processes in the different control entities, related to violations of civil, political, economic, social, cultural and integrity rights physical and sexual of women.

7. To participate actively in the strengthening of the international networks of women parliamentarians, for the promotion of the full citizenship of the women of our region and the rest of the world.

8. Promote and hold public hearings, forums, seminars, symposia, meetings, work tables, conversations and other communication strategies to develop, inform and disseminate issues related to women's rights, legislation in force, existing public policies and the bills they are pursuing in the Legislative Chambers.

9. To deal with the Constitutional Commissions with the observations, additions and modifications that they make in writing to the Commission for the Equity of Women, the citizens and the citizens with respect to bills or legislative acts the human, civil, political, economic, social and cultural rights of women.

10. Promote initiatives and actions that contribute to the promotion and recognition of the work and the contributions made by women to the economy, culture and politics in the country.

11. To promote actions in the private sector that promote equity for women in the labor and social field.

12. Submit annual reports to the Chambers of Chambers and civil society at the end of each legislature on the development of their institutional mission.

13. To request the inter-institutional accompaniment of national and international organizations, public or private entities and women's associations for the development of their institutional mission, to develop research projects, defence and dissemination of the civil, political, economic, social and cultural rights of women.

14. All other functions as determined by law.

ARTICLE 6o. Addition to Chapter IV Section II, Title II of Act 5of 1992 with a new article of the following tenor.

Article 61D. Sessions. The Legal Commission for the Equity of Women shall meet at the request of its Board of Directors, at least once a month or when deemed necessary. The decisions of the Commission shall be taken by a simple majority.

ARTICLE 7o. ATTRIBUTIONS. The Legal Commission for Women's Equity will have the following powers:

1. Choose the Board of Directors of the Legal Commission for Women's Equity.

2. To issue its own regulations for the development of its institutional object.

3. To verify compliance with laws related to women and equity for women in territorial entities, decentralized organizations, and other public or private institutions.

4. To control and follow up the effective implementation of public policies related to equity for women and all those that affect their condition.

5. Ensure that during the negotiation and peace processes, UN Security Council Resolutions 1325 and 1820 of June 19, 2008, and other national standards and international instruments are complied with.

6. Propose and ensure that in the process of discussion and approval of the National Development Plan and the General Budget of the Nation, programs, projects and actions that make effective the realization of civil, political, and political rights are included. economic, social and cultural women.

7. Evaluate and carry out political control over the accountability reports that the Colombian Government must deliver to the International System and the Inter-American Human Rights System on civil rights, political, economic, social and cultural women.

8. To give honorary mentions and recognition to the work carried out by social organizations and/or personalities in favor of the defense, promotion and realization of the civil, political, economic, social and cultural rights of women.

9. Establish strategic alliances with national and international bodies, public and/or private law entities and NGOs that defend the civil, political, economic, social and cultural rights of women.

ARTICLE 8o. TABLE OF DIRECTIVE. The Board of Directors of the Legal Commission for Women's Equity will be composed of a Presidency and a Vice-Presidency elected by a simple majority, at the beginning of each legislature.

ARTICLE 11. DUTIES OF THE COORDINATOR (A) OF THE COMMISSION FOR WOMEN ' S EQUITY. The Coordinator (a) of the Commission for Women's Equity will have the following functions:

1. Carry out and coordinate the administrative work of the Commission.

2. Contribute to the implementation of the tasks of the Commission.

3. To draw up the agenda for each meeting, in coordination with the Commission's Bureau.

4. To keep the members of the Commission informed on the course of the topics covered in the sessions, as well as to monitor the progress of the sessions.

5. To call for a list of sessions, to verify the quorum and to act as the Secretary of the Commission on the Commission's sessions.

6. Establish a constant link with the academic community and national and international bodies to facilitate the analysis of the issues addressed by the Commission.

7. The others assigned to you, by the laws and subsequent regulations according to the nature of your office.

PARAGRAFO. To perform the position of Coordinator of the Commission for the Equity of Women, it is required to accredit professional title in law, political science, social sciences and/or related careers, postgraduate in related areas and one (1) year of professional experience.

ARTICLE 12. DUTIES OF THE UNIVERSITY PROFESSIONAL OF THE LEGAL COMMISSION FOR THE EQUITY OF WOMEN. The university professionals of the Legal Commission for Women's Equity will have the following functions:

1. Support the internal work of the Congressmen and members of the Commission and the implementation of the plans drawn up by the Commission.

2. To keep the members of the Commission informed on the course of the topics covered in the sessions and to monitor the progress of the sessions.

3. Work directly with the students of the judiciary and university interns, in the topics assigned to him by the Coordinator.

4. Any other that is assigned to you by the laws and subsequent regulations in accordance with the nature of your office.

PARAGRAFO. To be a University Professional of the Commission for Women's Equity, it is required to accredit professional title in law, political science, social sciences and/or related careers and a (1) year of professional experience.

ARTICLE 13 FUNCTIONS OF THE EXECUTIVE SECRETARY OF THE COMMISSION FOR WOMEN ' S EQUITY. The Executive Secretariat of the Commission for Women's Equity will have the following functions:

1. Give information to persons and entities who request it.

2. Receive, analyse and respond to the correspondence of the Commission and search for data to assist in its prompt and appropriate processing.

3. Attend to the general public, senators, representatives, representatives of social organizations and groups of women and other public servants.

4. Bring the daily agenda of commitments of the Commission's Board of Directors and keep it informed of its most important activities and commitments.

5. To bring a file of the proposals, constances and concepts that are established or approved in the plenary or in the various commissions, as well as of the activities, communiques and all the information that comes and comes out of the Commission.

6. Record and transcribe the interventions of each member and other people participating in the sessions, contained in the recording equipment.

7. To forward the documents transcribed to the Commission's Coordination or to the person in charge, for the preparation of the draft of the respective minutes.

8. Order the file in terms of tapes and transcripts to give the Commission greater agility.

9. Organize the Commission's Documentation Centre on the topics it adopts as an agenda in the respective legislature.

10. The others assigned to him in accordance with the nature of his position.

PARAGRAFO. To serve as the Executive Secretary of the Legal Commission for Women's Equity, a commercial or technical bachelor's degree must be accredited, management of systems programs required, and one (1) year of experience.

ARTICLE 14. Commission for the Equity of Women may have at its plant interns and judicants welcoming the provisions and conventions that the Congress of the Republic has established for this purpose. Institutions of Higher Education.

ARTICLE 15. FISCAL COST. The Senate and House Directives will include in the Annual Expenditure Budget of the Congress of the Republic, which is part of the General Budget Law of the Nation for each fiscal year, the corresponding items to the payment of the plant of personnel in accordance with the provisions of this law.

The general expenses necessary for the implementation and operation of the Legal Commission for the Equity of Women, will be assumed from the budget availabilities that will be assigned to the respective Corporation for each term.

ARTICLE 16. VALIDITY. This law governs from its enactment and repeals all provisions that are contrary to it.
