DECRETA:

ARTICLE 1o. AFFILIATION. 1 of Law 1023 of 2006. The new original text is as follows: > Community Mothers of the Community Household Program of the Colombian Institute of Family Welfare, will join their family group to the contributory regime of the General System of Social Security in Health and shall be accretive of all the care and economic benefits derived from it.

PARAGRAFO 1o. The contribution base for the settlement of contributions to social security by the community mothers as well as the economic benefits will be made taking into account the sums that Community Mothers are effectively received by the regulations of the Colombian Family Welfare Institute.

PARAGRAFO 2o. 1 of Law 1187, 2008. The new text is as follows: > For the financing of the affiliation to the contributory scheme of the family group of the community mothers will be applied as provided in the articles 3or href="ley_0509_1999.html#4"> 4or the 1999 509 Act, without prejudice to the universal coverage progression set out in Article 9or Act 1122 of 2007.

ARTICLE 2o. QUOTATION. 2 of Law 1023 of 2006. The new original text is as follows: > The Community Mothers will be listed monthly as a contribution to the General System of Social Security in Health a value equivalent to four percent (4%) of the sum they receive for the benefit of the Colombian Family Welfare Institute.

PARAGRAFO. The Management Organizations of the Hogar Welfare Program will collect the amounts quoted, through the retention and rotation of the percentage described, to the Health Promoter Entity, EPS, chosen by the Mother Community, within the opportunity provided by the Law for the payment of contributions.

ARTICLE 3o. The General System of Social Security in Health shall recognize the EPS chosen by the beneficiaries, the values corresponding to the Payment Units per Capitation of the Contributory Regime, by transferring the necessary resources from the solidarity sub-account to the compensation sub-account in the values corresponding to the subsidised Capitation Payment Units.

ARTICLE 4. The difference that results between the subsidized, subsidized, non-covered Payment Units (UPC), not covered by the contributions of the Community Mothers referred to in the article 2or. of this law and with the transfers provided for in Article 3or. of the same, will be satisfied with the percentage that is necessary, of the yields produced by the Fund of Solidarity and Guarantee -Fosyga-, for which, the National Council of Social Security is authorized in Health, to order the turn to the sub-account of compensation, of the corresponding values.

PARAGRAFO 1o. In any case with resources from those assigned in the National Development Plan for the subsidized regime, the sustainability of this special regime will be guaranteed.

PARAGRAFO 2o. Community Mothers will have the possibility to complete the total value of the contribution on their own and thus obtain the family coverage of the Contributory Scheme.

ARTICLE 5o. Pursuant to the provisions of Law 100 of 1993, in accordance with the provisions of the document Conpes 2753 of 21 December 1994, the Fund Solidarity Pensional will subsidize the contributions to the general pension scheme of the Community Mothers, regardless of their age and provided that they have fulfilled at least one (1) year of service as such.

ARTICLE 6o. The amount of the subsidy will be equivalent to eighty percent (80%) of the total pension contribution and its duration will be extended by the term in which the Community Mother exercises this activity.

ARTICLE 7o. The Pensional Solidarity Fund will manage in an independent account, the resources of the National Government that cover the subsidy to the contributions of the Community Mothers that deals with this law.

ARTICLE 8o. This law repeals all provisions that are contrary to you.

ARTICLE 9o. This law shall enter into force on the date of its enactment.
