Whereby the Naval Engineer profession and related professions in the country is regulated.

THE CONGRESS OF COLOMBIA DECREES:
ARTICLE 1o. For purposes of this law it is understood exercise of the professions of Naval and related engineering, everything related to research, study, planning, consulting, implementation, repair, operation and performance related to both marine vessels and river; study of the natural processes of the seas and rivers and the management and organization of public and private companies related to maritime activities and / or river, among others.
Article 2.
. Naval Engineering is understood by studying the profession and own systems projected sea and river vessels; and associated ground facilities, participating in the planning and direction of their design, construction, installation, maintenance and operation thereof.

ARTICLE 3o. For purposes of this law, they are considered as branches or related professions Naval Engineering, the following:
- physical and chemical oceanographers.
- Maritime Managers and professionals in management sciences play their profession in the naval and maritime environment.
- Naval Architects.
- Marine Biologists.
- Geologists Marinos.
- Ocean Engineers and others specializing in Marine Sciences
ARTICLE 4.
.. Are activities of the Naval Engineering and related professions include:
a) Studies and own systems of marine and river vessels and associated ground facilities projections;
B) Planning and direction of boat design;
C) construction, repair, maintenance and operation embarks ation;
D) Study and research of all physical, natural and characteristics of the seas, rivers, coastlines and riverbanks and adjacent high seas areas and processes;
E) Planning, organization and management of public and private maritime and river activities in the logistics and administrative field.

The 5th ARTICLE. To practice the profession of Naval Engineering or related occupation in the territory of the Republic of Colombia, it must have:
a) Professional degree awarded by university approved by the Ministry of National Education or foreign university duly recognized by competent Colombian authority ;
B) professional registration issued by the corresponding specialties authorized by this law, according to the regulations for the particular determined by the Government Professional Council. Tuition so issued is presumed authentic.

ARTICLE 6.
. Registration may be issued only Naval Engineer or related professional, in favor of who owns the respective degree from university, college or school of higher education level have the proper authorization from the Government for this purpose.
Registration may be issued Naval Engineer or related profession to holders of the respective degree from college, school or college level foreign school, they meet the following requirements:
a) A request for issuing tuition based on title granted by a country with which Colombia has sought to exchange titles, the person shall be governed by the terms established in the respective agreement or treaty;
B) The application for issuing registration based on title granted by a country with which Colombia has not tried to exchange titles, the applicant must attach all evidence to the effect required by the national government.
PARAGRAFO. In none of the cases referred to in this Article, the titles of non-formal education be recognized.

Article 7. In the activities and work performing Naval Engineers and Related Professionals, participation of foreign professionals will be regulated by the Ministry of Labour.
ARTICLE 8.
. All work related to the exercise of the Naval Engineering or related professions should be addressed as appropriate, by Naval Engineer or related professional, whose enrollment corresponds to the professional expertise required.


Article 9. When in office expert or specialist opinion understand the technical issues of the Naval Engineering or related professions, in any of its branches, it will be entrusted to professionals enrollment by subject in question.

ARTICLE 10. The Colombian Association of Naval Architects and Related Professionals, Acinpa will participate in the National Professional Council of Engineering and Architecture and National Professional and Sectional Councils covering Acinpa Specialties, and cooperate with them in monitoring the lawful exercise of professional and denounce to the competent authorities the violations occur.

Article 11. The exercise of Naval Engineering and related professions will be held in state agencies and organizations, Societies of Mixed Economy and the private sector.

Article 12. Offenses against professional ethics incurred Naval Engineers and Related Professionals, will be sanctioned by the Professional Councils in each specialty, without prejudice to have the laws and provisions in this article.
The Naval Architects and Related Professionals assume to society and the State a broad responsibility for the decisions, recommendations or proposals that perform professionally and approve with his signature and professional card number.

ARTICLE 13. The duties of Naval Engineers and Related Professionals:
a) Retain respect, loyalty and honesty of their profession and guilds to which it is affiliated;
B) Apply dutifully, upright and dignified philosophies, theories, concepts and technical and administrative principles, object of the profession;
C) Save the professional discretion in all its concepts and information received, necessary for their professional work;
D) To deal with jealous diligence their professional duties;
E) To act with loyalty to his colleagues;
F) Always act with professional ethics;
G) fully comply with the law regulating the profession.

Constitute offenses ARTICLE 14. Naval Engineer and Related Professionals:
a) Checking the execution of any act that violates the duties under this Act;
B) The unlawful exercise of the profession of Naval Engineering and related professions;
C) Accept and execute jobs for which is not considered appropriate;
D) Make spoken or written advertising that is not limited to the name of the professional, academic titles and specializations, positions held and data concerning his place of business;
E) Making judgments, certifications, reports, diagnoses, concepts, etc., based on untruthful sources and / or for the purpose of promoting themselves or others, to the detriment of others.
ARTICLE 15.
Naval Architects and Related Professionals who are check violation of the rules included in these articles, they shall be punished by reprimand, censure, fine, suspension and expulsion, according to preliminary concept and opinion of the National Professional Council the corresponding specialty:
a) the warning is a call for private care in writing that the offender is made;
B) Censorship is a judgment made the offender;
C) The fine is a monetary penalty whose value is regulated;
D) The suspension is the prohibition of the exercise of the profession for a term not less than two (2) months and a maximum of one (1) year;
E) The exclusion is definitive ban the practice of the profession, leading to the cancellation of the professional card:
PARAGRAFO. The amount of the fines will be directly proportional to the seriousness of the offense and correspond from one (1) to ten (10) minimum wages, under the concept of Professional National Council of the respective specialty.

Article 16. Professional Naval Engineering and Allied Professions, who serves as an officer and employee in the exercise of his office violates any of the above provisions or authorized, to provide, sponsor or conceal the illegal practice of the profession in any of its branches or specialties incur, without prejudice to the sanctions that are applicable for the violation of criminal laws or police, disciplinary offense is punishable by suspension for the first time and dismissal in case of recidivism.
ARTICLE 17.
ethical standards set forth in the preceding articles not subsume other unexpressed and that can result from professional practice correctly and with dignity.


Article 18. For the correct interpretation of the above rules should be understood that not everything is permitted unless expressly prohibited, considering that they are general rules that tend to avoid failures against professional ethics.
When situations not covered by the above rules arise, shall be resolved by the Professional Councils of the respective specialty, provided they are within their competence.
ARTICLE 19.
hereby recognized to the Colombian Association of Naval Architects and Related Professionals "Acinpa" with legal status granted by the Mayor of Santa Fe de Bogota, Capital District through Resolution 211 of April 13, 1994, as Technical Advisory Body Government to the issues and problems related to Naval Engineering and Allied professions Advisory Body on Administrative and labor issues related to these professions. His concept will not have the binding character.

Article 20. The National Government by virtue of a decree regulating this new law may define specific areas of the activities of Naval Architects and Related Professionals engineers, according to the changing needs of society.

ARTICLE 21. This law will be disseminated in all higher education institutions to develop such professions for incorporation respective academic curriculum.

Article 22. This law governs from its enactment and repeal all provisions that are contrary.
