Whereby article 367 of the Penal Code criminalizes partially modified and criminal behavior with that of Urbanizador Illegal. Summary
THE CONGRESS OF COLOMBIA DECREES:
ARTICLE 1o. It amend section 367 of the Penal Code, which shall read as follows:.
"Article 367. INVASION OF LANDS AND BUILDINGS who, for the purpose of obtaining for himself or for a third illicit gain, others invade land or building incur imprisonment of two (2) to five (5) years and a fine of fifty (50) to two hundred (200) minimum monthly wage. the penalty established in the preceding paragraph shall be increased by half by the promoter, organizer or leader the invasion.
the same increase in penalty shall apply when the invasion occurs on land located in rural areas.
paragraph. the penalties mentioned in the foregoing paragraphs will be lowered by up to two-thirds, when before to rule first instance judgment, cease acts of invasion and total eviction of the land and buildings which have been overrun occurs.
Jurisprudence Article 2. Term. Adiciónese Chapter VII of Title XIV Penal code with the following article, which will be inserted after Article 367 of the cited work.
"Article 367A. THE DEVELOPER ILLEGAL. The go ahead, develop, promote, sponsor, abets, finances, facilitates, tolerates, collaborate or allow the division, subdivision, development of real estate, or construction without fulfilling requirements of law, by this fact alone incur imprisonment of three (3) to seven (7) years and a fine of two hundred (200) to four hundred (400) statutory minimum wages.
The penalty indicated above shall be increased by half when the parcelling, urbanization and housing construction are made in land or areas of environmental and ecological preservation, reserve for the construction of public works, environmental pollution in areas of high risk or in rural areas.
PARÁGRAFO . the public servant or official worker within the territory of their jurisdiction and because of its competition with its act or omission giving rise to the execution of the facts mentioned in paragraph 1o. of this article shall incur interdiction of rights and public functions of three (3) to five (5) years, without prejudice to other penalties that might arise in the development of their conduct penalties. ARTICLE 3. This Law governs from its publication and repeals all provisions that are contrary.
