By which the quota of poultry promotion is created and rules are dictated on its collection and administration.
COLOMBIA CONGRESS
DECRETA:
ARTICLE 1o. Poultry is a subsector component of the agricultural sector of the country and is constituted by activities dedicated to the production of birds, poultry eggs and poultry meat.
ARTICLE 2o. For the purposes of this Law, it is understood as an incubator undertaking that it is dedicated to the obtaining of day-old chicks or chicks from fertilized eggs produced in the country or imported, for the purpose of sale to third parties or for their own exploitation.
ARTICLE 3o. OF THE POULTRY PROMOTION QUOTA. From the date of this law, create the Poultry Development Quota, which shall be constituted by the equivalent of one point seventy-five percent (1.75%) of the commercial value of each bird of a day of born in an incubator intended for the production of meat, and for the equivalent of seven point seventy-five (7,75%) of the commercial value of each bird of a day of hatchery intended for the production of eggs.
TRANSIENT PARAGRAPH. During the first year of this law, the Poultry-Fent Fee shall be constituted by the equivalent of one point twenty-five percent (1.25%) of the commercial value of each bird of a (a) day of birth in hatchery intended for the production of meat, and for the equivalent of six per cent (6.00%) of the commercial value of each bird of a day of hatchery intended for the production of eggs.
During the second year of this law, the Poultry Development Fee shall be constituted by the equivalent of one point fifty percent (1.50%) of each bird's commercial value of one day of hatchery intended for the production of meat, and for the equivalent of six points fifty per cent (6.50%) of the commercial value of each bird of a day of hatchery intended for the production of eggs.
From the third year of validity of this law, the Poultry Development Fee shall be constituted by the equivalent of one point seventy-five percent (1.75%) of each bird's commercial value of one day of hatchery intended for the production of meat, and by the equivalent of seven-point seventy-five per cent (7.75%) of the commercial value of each bird of a day of hatchery intended for the production of eggs.
ARTICLE 4. THE PARAFISCAL RESOURCE. The Poultry Development Quota created by this Law is a parafiscal contribution that is subject to the principles and rules governing the matter.
ARTICLE 5o. OF THE NATIONAL POULTRY FUND. With the product of the promotion quota referred to in the preceding articles, a special account shall be established which shall be called the National Poultry Fund, the production of which shall be for the purposes of the objectives. flagged by this Act.
ARTICLE 6o. OF THE OBJECTIVES OF THE NATIONAL POULTRY FUND. The resources of the National Poultry Fund shall apply exclusively to the Financing of Research and Technology Transfer Programs, technical assistance, animal health, training and studies Economic and Social Committee, the Economic and Social Committee, the Economic and Social Committee, the Economic and Social Committee, the Committee of the European Economic and Social Committee and the Committee of the European National Poultry correspond, according to the established documents CONPES, which is aimed at improving the health and safety conditions of Colombian poultry farming.
ARTICLE 7o. SETTLEMENT AND PAYMENT. The payment of the Poultry Development Fee is an obligation of the incubators established in the country and will be settled on the commercial value of each bird born in its plants destined for the production of egg and meat. The Fund's managing entity will set the average trading price for each bird for quarterly periods.
ARTICLE 8o. OF THE COLLECTION. The incubators will act as the collection of the Poultry Development Quota.
PARAGRAFO. The collectors of the Poultry Development Fee will provisionally keep the respective resources in special accounts and will be obliged to transfer them and deliver them directly to the managing entity during the first ten days of the month following the collection.
ARTICLE 9o. subhead] The National Government, through the Ministry of Agriculture, will contract with the National Federation of Avicultors of Colombia, Fenavi, the administration of the resources of the National Poultry Fund. In the absence of this Federation the National Government may contract the administration of the Fund with another sufficiently representative association of the avicultor guild.
The administrative contract shall provide for the establishment of programmes and projects, the powers and functions of the managing body and its prohibitions, the term of the contract and other requirements and conditions which are For the purposes of compliance with the legal objectives, as well as the consideration in favor of the respective entity for the administration of the Fund, consideration whose value will be up to ten percent (10%) of the amount of the perceived.
PARAGRAFO. The Board of the Fund may approve subcontracts of specific plans, programmes and projects with regional entities whose objectives are related to poultry production.
ARTICLE 10. FROM PERCEPTION, INVESTMENT AND EXPENDITURE. The perception, investment and expenditure of the National Poultry Fund resources will be made directly by the managing entity through special procedures.
ARTICLE 11. OF THE INVESTMENT AND EXPENDITURE PLAN. The resource management entity of the National Poultry Fund shall prepare the investment and expenditure plan in a timely manner, for programs and projects, for each year, which may only be executed once it has been approved by the Board of the same Fund.
PARAGRAFO. The resources of the National Poultry Fund shall be applied taking into account their origin, that is, in proportion to the collections carried out in each of the activities of the poultry farming on which the parafiscal contribution is caused.
ARTICLE 12. FROM THE MANAGEMENT BODY OF THE NATIONAL POULTRY FUND. As the management body of the National Poultry Fund, a Board of Directors shall act, composed of the Minister of Agriculture or his delegate, the Manager of the Colombian Agricultural Institute, ICA, or its delegate and three representatives of the National Federation of Avicultors of Colombia, Fenavi, chosen for this purpose by its Board of Directors, who must be incubators, egg and chicken producers, respectively, and represent the major producing regions.
ARTICLE 13. ADMINISTRATIVE SUPERVISION. The managing body shall submit to the Ministry of Agriculture, in the first two (2) months of each year, the programs designed for the respective annuity. If the first thirty (30) days after presentation of the Ministry of Agriculture has not been given, the approval of those programs will be understood.
ARTICLE 14. NATIONAL Federation of Avicultors of Colombia, as an administrative entity of the National Poultry Fund, will pay the corresponding accounts for the collection and investment of the resources to the Comptroller General of the Nation.
PARAGRAFO. It is up to the Comptroller General of the Republic to control the tax on the National Poultry Fund. For the exercise of this control, the Comptroller shall adopt appropriate systems that do not interfere with the autonomy of the managing entity, nor hinder the execution of the programs and projects that are brought forward.
ARTICLE 15. OF THE ASSETS OF THE FUND. Assets to be acquired from the Fund's resources shall be incorporated into a special account of the Fund and in each operation shall be clearly established that the asset acquired is part of the National Fund's assets Poultry.
ARTICLE 16. This Law governs from the date of its enactment.
