CONGRESS OF COLOMBIA DECREES
:
ARTICLE 1o. SCOPE. This Law officials and employees of the Office of the Comptroller General of Colombia currently linked technical levels in grades 1 and 2. Effective

2. If the official hath one (1) year and less than five (5) years of continuous service they will be paid forty-five (45) days for the first year and fifteen (15) days for each additional year and proportionally per fraction.
3. If the official hath five (5) years and less than ten (10) continuous service will be paid forty-five (45) days for the first year and twenty (20) days for each additional year and proportionally per fraction.
4. If the official hath ten (10) years or more of continuous service and less than fifteen (15) will be paid forty-five (45) days for the first year and forty days for each additional year and proportionally per fraction.

ARTICLE 4. WAGE FACTOR. Compensation, bonus factor does not constitute salary for any legal effect and it will be settled based on the average salary caused during the last year of service.
For the purpose of recognition and wage payment the following factors will be taken into account only:
1. The basic monthly allowance;
2. The technical premium;
3. The Sundays and holidays;
4. Aid supply and transportation;
5. Christmas bonus;
6. The bonus for services rendered;
7. Premium services;
8. Premium holiday and
9. Increases for night shift or furlough days. Effective Jurisprudence


The 5th ITEM. DEADLINE FOR EXECUTION. The Comptroller General of the Republic, will implement this Act within four (4) months from its approval. Effective Jurisprudence


ARTICLE 6o. CONTINUITY OF SERVICE. For the purposes specified in the scheme of retirement with compensation or bonus, time of continuous service shall be counted from the date of the last or only link public employee with the Office of the Comptroller General of Colombia. Effective Jurisprudence


ARTICLE 7. Incompatibility with PENSIONS. Employees and officials who will abolish the office as a result of the restructuring of the entity and that at the time of removal from office or employment have caused the right to a pension will not be able to recognize them or pay compensation or bonus referred to in this Law. If compensation or a bonus is paid in contravention of the provisions of the preceding paragraph and then claimed and gets a pension, the amount covered by compensation or bonus, plus interest at the rate of liquidated bank current interest, will be deducted periodically pension in the fewest possible legally allowances. Article 8. COMPATIBILITY WITH SOCIAL SECURITY BENEFITS. Without prejudice to the provisions of article 7. of this Act, payment of compensation or bonus is compatible with the recognition and payment of social entitled to the retired public official or employee benefits. Effective Jurisprudence


Article 9. PAYMENT OF ALLOWANCES AND BONUSES. Compensation or bonus as applicable, must be paid to each beneficiary in cash by the General Treasury of the entity within two (2) months after the issuance of certificate of liquidation thereof. Effective Jurisprudence



ARTICLE 10. EXCLUSIVITY OF PAYMENT. Compensation or bonus referred to above items, officials and public employees who are linked to the Comptroller General of the Republic within thirty (30)

ARTICLE 11. LINKING TO auditees. Public officials and employees of the Office of the Comptroller General of Colombia who have been compensated or received bonus effect of this Act may be linked to the entity which has exercised fiscal control or any public entity, meaning the new different linkage and with continuity. ARTICLE 12. NEW LINKING TO THE COMPTROLLER. Officials who have been the subject of compensation or bonus under this Act, shall not be linked back to the Comptroller General of the Republic before five (5) years of their separation unless the new entry is made through a public tender for administrative career posts or elected Comptroller General of the Republic. ARTICLE 13. Transitory. To authorize the General Comptroller of the Republic for a period not exceeding 120 days from the date of enactment of this Act, so you can advance reconciliation on labor, with those officials and employees who, having been detached from entity between the first (1st) of January 1993 and the date of enactment of this Act and whose position is abolished in the restructuring has been initiated by ordinary action complaint to the jurisdiction of administrative litigation. ARTICLE 14. EFFECTIVE DATE. This Law governs from the date of its enactment and repeals all contrary to it. Effective Jurisprudence
