Employment of persons with disabilities in the Province of Yangi

(Adopted by Decree No. 182 of 16 April 2010 on the People's Government of the Southern Province, which was published as of 1 June 2010)

Article 1, in order to promote employment of persons with disabilities, guarantees the labour rights of persons with disabilities, in accordance with the People's Republic of China Disabled Persons Guarantee Act, the Department of State Employment Regulations for Persons with Disabilities and the Methods of Implementation of the People's Republic of China Disability Guarantee Act in the Province of the Republic of China.

Article 2

Article 3. The Government of the people at the district level should incorporate the employment of persons with disabilities into the planning for economic and social development of the current regional nationalities and establish preferential policies and specific enabling measures to create conditions for employment of persons with disabilities.

Article IV encourages social organizations and individuals to help, support the employment of persons with disabilities through multiple channels and forms of employment. Discrimination against persons with disabilities in employment is prohibited.

Persons with disabilities should improve their quality and enhance their employment capacity; adhere to the labour disciplines of the user's units and adhere to professional ethics.

Article 5

In the context of their respective responsibilities, the human resources and social security, civil affairs, finance, taxation, business and justice of the above-ranking people are employed by persons with disabilities.

Article 6 The employment services of persons with disabilities, affiliated to the Disabled People's Federation at all levels, are specialized agencies that assist Governments and relevant departments in providing integrated services for the employment of persons with disabilities, and are responsible for providing vocational guidance, career presentations, vocational training, etc. for persons with disabilities.

Trade unions, communitarian youth missions, women's associations should be able to promote employment for persons with disabilities within their respective spheres of work.

Article 7. Persons with disabilities are encouraged to organize employment in excess of the prescribed proportion; more than the proportion of the provision is provided with appropriate incentives.

Article 9. Article 10. The unit of the person shall provide for the necessary rehabilitation of the place of work, labour equipment and living facilities, as required, for basic old-age insurance, medical insurance, unemployment insurance, work injury insurance, maternity insurance, etc.

Persons with disabilities may not be discriminated against in the areas of promotion, promotion, evaluation, compensation, living benefits, rest leave, social insurance.

Article 11. The Government of the people at the district level should take measures to promote and develop public-private jobs that are suitable for the employment of persons with disabilities and to include persons with disabilities in employment hardship and provide employment assistance on a priority basis.

Article 12 Governments and their relevant departments should identify products, projects that are suitable for the production, operation of persons with disabilities, prioritize the placement of user units for persons with disabilities for the production or operation of persons with disabilities, and identify certain products for their exclusive production in accordance with the characteristics of the production of user units that concentrate on persons with disabilities.

Article 13 encourages and promotes the self-employment and ownership of persons with disabilities. Article 14. Governments at all levels should raise funds to organize and promote the participation of rural persons with disabilities in the cultivation, reproduction, craft and other forms of production.

The sectors, financial institutions and rural grass-roots organizations should assist rural persons with disabilities engaged in agricultural production, in accordance with their respective responsibilities, in the areas of production services, technical guidance, the supply of agricultural goods, the acquisition of agricultural products and credit.

Article 15 Governments and their relevant sectors should target rural poor persons with disabilities as a priority for poverty reduction development and strengthen the creation of a pro-poor base for persons with disabilities, enabling the development of pro-poor demonstration bases for persons with disabilities, in accordance with the policy of pro-poor enterprises at the same level.

Article 16 arranges for employment of persons with disabilities, exceeds the proportion of persons with disabilities or concentrates on persons with disabilities and persons with disabilities engaged in their own operations, which are granted tax incentives under the law.

Social security benefits should be granted to persons with disabilities who are eligible for employment in the user unit, human resources and social security, the financial sector and the Disability Federation.

Article 17 does not provide for employment of persons with disabilities or arrange for employment of persons with disabilities to be proportional, and shall pay employment guarantees for persons with disabilities in accordance with their actual number and the average annual salary of the urban units in the region.

Article 18

(i) The organs, groups and business units that have been allocated financially are charged by the Disabled Persons' Federation, which is not paid or paid under the provisions, are donated by the Disabled People's Federation, whose contributions are still unpaid or paid inadequacies, and are provided by the Disability Federation to the same financial sector with information and data, which are subject to suspension by the financial sector of its approval of the application plan or deduction.

(ii) Enterprises, economic organizations are charged by the Disability Federation with the same-tier tax sector.

(iii) Self-governance units, non-commercial units and other organizations are charged by the Disability Federation.

(iv) The Provincial Disability Federation is responsible for the collection of employment guarantees for persons with disabilities in central presence and province-specific units; the collection of the municipal disability union in charge of the employment security fund for persons with disabilities in the city-specific units; and the collection of employment guarantees for persons with disabilities in the district (communes, districts) disability associations for persons other than those provided for above. The Federation of Persons with Disabilities may entrust the lower-level Disability Federation.

Article 19, difficulties in the provision of funds by organs, groups, business units, non-commercial units, serious corporate losses, difficulties in paying employment guarantees for persons with disabilities, vetting, deducting or distributing the financial sector or the tax sector's approved annual financial settlements or accounts statements, submitting an application to the financial sector or to the Disabled's Federation, which, with the approval of the Finance Department and the Disabled People's Federation. Article 20

(i) Vocational training of persons with disabilities;

Employment guarantees for persons with disabilities should be used in accordance with prescribed purposes and no organization or person shall be subject to corruption, misappropriation, extradition or private separation.

Article 21 Financial sectors, the Disabled People's Federation should establish a regulatory system for the protection of employment guarantees for persons with disabilities and enhance income and expenditure management. The collection and use of the employment security fund for persons with disabilities should be reported annually to the Government of the current people and regularly to society.

The financial sector and the audit body should strengthen, in accordance with the law, the monitoring of the use of employment guarantees for persons with disabilities.

Article 2

(i) The publication of employment information on persons with disabilities;

(ii) Organizing vocational training for persons with disabilities;

(iii) Provide services such as vocational psychological counselling, vocational adaptation assessment, vocational rehabilitation training, job orientation and career presentations for persons with disabilities;

(iv) To carry out the management guidance and services of blind people;

(v) To guide, support the complementary employment of persons with disabilities with intellectual, mental and reactive disabilities;

(vi) Provide the necessary assistance for the self-determination of persons with disabilities;

(vii) Provide the necessary support for the organization of employment for persons with disabilities by human units.

Public employment services should establish disability service windows and services projects that provide employment services and employment assistance to persons with disabilities free of charge. Other employment services are encouraged to provide free services for persons with disabilities.

Article 23 Employment services for persons with disabilities are entrusted by the human resources and social security sector to register unemployment, employment and unemployment statistics for persons with disabilities and regularly inform public employment services affiliated to the same human resources and the social security sector.

The relevant sectors, such as human resources and social security, statistics, business and business, should provide assistance to persons with disabilities in their labour survey statistics and job registration, in accordance with their respective responsibilities. The user units should provide the required information and information for investigation statistics and registration.

The Human Resources Market Information Network should include information on employment of persons with disabilities in order to achieve resource sharing.

Article 24, the Disabled People's Federation, human resources and the social security sector should organize regular career skills competitions for persons with disabilities and establish an incentive system for the good skills of persons with disabilities.

Care is encouraged to facilitate the participation of persons with disabilities in vocational skills identification and to grant preferences.

Persons with disabilities participate in vocational skills identification and access to vocational qualifications certificates, which provide a one-time vocational skills identification subsidy in accordance with the relevant provisions.

Article 25 Human resources and the social security sector should strengthen labour inspections on employment of persons with disabilities and guarantee the legitimate rights and interests of persons with disabilities in accordance with the law.

Persons with disabilities are disputed with their user units, and local legal aid institutions should provide legal assistance to them in accordance with the law, and the associations of persons with disabilities at all levels should provide support and assistance.

Article 26 Disabled People's Federation and its affiliated employment services institutions, the relevant Government departments and their staff members have been treated by law, which constitutes a crime and are held criminally by law:

(i) In violation of the provisions of the employment guarantees for persons with disabilities;

(ii) Corruption, misappropriation, retention and private employment guarantees for persons with disabilities;

(iii) Use of office facilities for requests or receipt of property;

(iv) Other abuses of authority, omissions, provocative fraud.

Article 27, in violation of this scheme, provides that the person's unit does not pay the employment security of persons with disabilities in accordance with the provisions, is warned by the financial sector and is responsible for the duration of the period of time; that it is still unpaid, and that it should receive five thousand lapses from the date of payment.
