In order to preserve the unity of the rule of law, in accordance with the provisions of the National People's Republic of China's Administrative Accreditation Act and the decisions of the State Department concerning the cancellation and adaptation of administrative approval projects, the Office of the Rule of Law of the Government of the province will conduct a comprehensive verification of the existing 175 regulations and 156 normative documents developed by the Government of the province by the end of 2004. According to the verification, the Government of the province decided to amend and repeal five regulations and normative documents dealing with administrative licence projects already cancelled by the State Department as follows:
Regulations
(i) The Modalities for the implementation of the School Health Work Regulations in the Province of Yunnan, issued in document No. [1992]255, were amended to read: “A new construction, alteration, expansion of school premises, their location, design should be in line with national health standards, and the completion of the process should involve the local health administration.” Article 34 was deleted.
(ii) Article 9, paragraph 1, of the Zanananangan Avian Approach to the Management of Livestock, published by the Provincial Government Order No. 117, reads as follows: “The establishment of a livestock poultry area shall be in line with the overall planning of a poultry breeding system and the presentation of the provincial authorities of livestock”.
(iii) The Law on Mobility in the Province, published by Government Order No. 33, was repealed.
Normative documents
(i) The application of article VII, article 16, article 17 of the Rules for the Management of Older Vehicles in the Province of Yunnan, issued in document Yongu [2000]235, and deletion of the provisions contained in Article 17 relating to the approval of the UNCTAD-sector for the establishment of the old motor vehicle transaction market.
(ii) Article 10 of the provisional provision on property transactions in the Province of Yunnan, issued in document Yumn [2002]38.
This decision has been implemented effective 1 August 2005. The regulations and normative documents of the above amendments are revised accordingly in accordance with this decision.
