Decision of the Government of the People of the Blackang Province to amend the provisions on penalties for obstructing the functioning of national staff in accordance with the law.

(Adopted at the 16th ordinary meeting of the Government of the Blackonang Province on 11 December 2008, No. 9 of 7 January 2009, by the Order of the People's Government of the Blackonang Province, on the date of publication)

The Government of the people of the Blackang Province has decided to amend the provisions on penalties that prevent national staff from carrying out their duties under the law:

I amend article 1 as follows: “In order to protect national staff members to perform their duties in accordance with the Law on the Safety and Security of the People's Republic of China and the relevant provisions, this provision is formulated in conjunction with the realities of my province”.

Amend Article 5 as follows: “A person with one of the following acts is warned or fined under the Law on the Safety and Security of the People's Republic of China under the Penalty Act of the People's Republic of China; in the event of a serious nature, the detention of the following ten days may be liable to a fine of 500,000 dollars:

(i) Disincentage and rumours for persons performing their duties under the law;

(ii) Obstacles on the ground and affect the enforcement of functions under the law;

(iii) To favour and assist those who have been punished to escape punishment;

(iv) Restructuring, concealing misappropriation and affecting the enforcement of functions under the law;

(v) Obstacles the legal evidence of national staff;

(vi) The transfer of funds, the conversion of accounts to escape punishment;

(vii) Removal of documents, documents and votes of persons performing their functions under the law;

(viii) The seizure of police, equipment and equipment taken by law enforcement personnel;

(ix) To take the lead on the ground or to instigate mass trajectorys, rendering the implementation of the law in an irregular manner;

(x) Expansion, poaching and peripheral of national staff so that they cannot be carried out in a regular manner in accordance with the law;

(xi) Impacts, law enforcement authorities and interference in the enforcement of the law;

(xii) Beating a minor injury to a person performing his or her duties under the law.”

iii. amend article 8 as follows: “A way of violence and threat hinders national staff from carrying out their duties in accordance with the law and constitutes a crime and is criminally liable by law”.

Article 11 was amended to read: “In violation of the penal decision procedure set out in this article, the execution is governed by chapter IV of the Law on the Safety and Security of the People's Republic of China”.

5 Delete Article 12: “This provision shall be interpreted by the Ministry of Public Security”.

This decision is implemented from the date of publication.

The penalties for obstructing the functioning of the State's staff in accordance with this decision are reissued.

Annex: penalties in the Blackang Province for obstructing the functioning of national staff in accordance with the law (as amended in 2009)

Article 1 provides for the protection of national staff in accordance with the Law on the Safety and Security of the People's Republic of China and the relevant provisions, in conjunction with the facts of my province.

The work carried out by a staff member of the 2nd State in accordance with the law, regulations, regulations and regulations shall be carried out in accordance with the law and shall not be obstructed and denied by any person in any form.

Article 3. This provision is organized by public security authorities at all levels.

Article IV prevents and rejects acts that are not criminally sanctioned by national staff in accordance with the relevant laws, regulations and provisions.

Article 6. The head of the unit refers to the fact that it impedes the performance of the State's staff in accordance with the law, while punishing the head.

Article 7. State public officials, within the framework of their unlawful determination, obstruct the functioning of the State's staff in accordance with this provision.

Article 8 prevents State staff from acting in accordance with the law by means of violence and threats and constitutes a crime and is criminalized by law.

Article 9 State staff shall be faithful to their duties and shall not be subjected to abuse of their functions and to provocative fraud. The perpetrators are subject to administrative disposition; they constitute crimes and are criminally prosecuted by law.

Article 10 Staff members of the State are obstructed by the enforcement of their functions under the law, and public security authorities at all levels shall be subject to a prompt hearing in accordance with this provision.

Article 11, in violation of the sanctions ruling procedure under this provision, is implemented in accordance with chapter IV of the Law on the Safety and Security of the People's Republic of China.
