Administrative measures on pig slaughter in Sichuan province

    (March 30, 2010, Sichuan provincial people's Government, the 54th Executive meeting on May 17, 2010, Sichuan provincial people's Government promulgated as of July 1, 2010, order No. 244) Chapter I General provisions

    First to strengthen the management of slaughtering, ensure pig-product quality and safety, safeguard the people's health, according to the State Department the pig slaughter regulations (promulgated by Decree No. 525, hereinafter referred to as the regulations) and related laws and regulations, in Sichuan province, these measures are formulated.

    Article engaged in pig slaughtering activities in the administrative area of Sichuan province, units and individuals shall comply with these regulations.

    Article III implementation of pig slaughter, centralized quarantine system in our province. Without fixed points, no unit or individual may engage in pig slaughtering activities. Individuals in rural areas since the slaughter except for food.

    Individuals in rural areas from eating pig slaughter, should declare to the animal health supervision institutions according to law before slaughter and quarantine.

    Fourth commercial administrative departments at or above the county level shall be responsible for supervision and management of pig slaughtering activities within their respective administrative areas.

    Above the county level animal science and veterinary medicine, environmental protection, public health, public security, industry and commerce, quality supervision departments in accordance with the Division of responsibilities, responsible for slaughtering activities supervision and administration in accordance with law.

    The township (town) people's Government shall assist the relevant supervision and management departments in pig slaughtering activities.

    Fifth to encourage and support the pig slaughter plants (field) introduction of mechanization, standardization, large-scale slaughtering, equipped with slaughtering size and sales ability to adapt pig product distribution facilities, improved regional market hog supply and consumer safety.

    Chapter II slaughter

    Article eighth hog slaughter plants (field) and location of small pig slaughterhouses, shall conform to the national and provincial environmental protection, food hygiene, animal epidemic prevention, land use and other requirements, away from hospitals, kindergartens, schools, old people's home, social welfare agencies, residential neighbourhoods, and livestock and poultry farms and other places.

    (D) equipped with commensurate with the scale of slaughter and meat quality of the provincial Commerce authorities qualified inspectors;

    (E) with meet the slaughter technology standards and requirements prescribed by the State inspection of equipment, facilities and medicines;

    (Vi) equipped with pollution control facilities that meet environmental protection requirements;

    (VII) equipped with subject to diseases of pigs and pig products treatment standards of facilities and equipment;

    (VIII) shall obtain the animal epidemic prevention certification.

    Article tenth of small pig slaughterhouses shall meet the following conditions:

    (A) commensurate with the scale of slaughter of sufficient water supply, water quality, drinking water health standards set by the State;

    (B) commensurate with the scale of slaughter of slaughter facilities;

    (C) has made commensurate with the scale of slaughter and slaughter of medical institutions above the county level to issue health certificates and technical personnel;

    (D) equipped with commensurate with the scale of slaughter and meat quality of the provincial Commerce authorities qualified inspectors;

    (E) is necessary to meet the requirements of national health facilities and medicines as well as sewage treatment facilities;

    (Vi) shall obtain the animal epidemic prevention certification. 11th an application for establishing a pig slaughter plants (field) or small pig slaughterhouses shall apply in writing to the local commerce authorities and submitted to the relevant technical information, and documentation.

    Apply for the establishment of a small pig slaughterhouses should be intended to supply the markets region-wide application.

    City (State) departments in charge of Commerce and related information in the 15th after receiving a written request, together with the animal husbandry and veterinary, environmental protection as well as other relevant departments according to the installation plan approved by the provincial government, in accordance with the provisions of the Ordinance and these rules, review conditions, provide review comments submitted to the municipal (State) Government.

    City (State) people's Governments shall seek, in writing within 5 working days after the provincial departments in charge of Commerce agrees or does not agree to a written decision.

    Applicants receiving cities (States) shall agree to a written decision before they can begin construction. 12th hog slaughter plants (field) and small pig slaughterhouses built upon completion, should be located, city (State) departments in charge of Commerce applied for acceptance.

    City (State) business departments of animal husbandry and veterinary, environmental protection acceptance as well as other relevant sectors of the municipal (State) people's Government issued a national code of pig slaughter certificates and pig slaughter signs.

    City (State) Government should identify the hog slaughter plants (field) and the small pig slaughter sites list to the public in a timely manner and report to the provincial departments in charge of Commerce.

    The applicant shall hold a pig slaughter to the Administrative Department for industry and commerce registration certificate.

    The fourth chapter management

    The fifth chapter legal liability

    Other units and individuals beyond the limited regional sales of small pig slaughter pig products, industrial and commercial departments at and above the county level shall be ordered to correct and liable to a fine of less than 2000 Yuan and 10,000 yuan in serious cases, fines of between 10,000 yuan and 30,000 yuan.

    Article 34th business, animal science and veterinary medicine, environmental protection, health, industry and commerce, quality supervision and other departments concerned in the supervision and administration of pig slaughter in the abuse of power, negligence, malpractice, shall be given administrative sanctions constitutes a crime, criminal responsibility shall be investigated according to law.

    Animal health supervision institutions and its violation of the People's Republic of China on animal epidemic prevention law and the provisions of the present measures, without quarantine or not passed quarantine inspection of live pigs, pig quarantine certificates issued by the product, add a quarantine sign by the people's Governments at the corresponding level, or veterinary authorities ordered corrective action and informed criticism; directly responsible in charge and other direct liable persons shall be given administrative sanctions.

    The sixth chapter supplementary articles

    Article 35th of small pig slaughterhouses in these measures refers to size up to 30 pigs slaughtered daily, facilities are not up to the slaughter of the level of qualification requirements to the national industry standard minimum qualification requirements for pig slaughtering point. 36th article of the rules take effect on July 1, 2010.
