Regulation on the management of garbage and engineering residues in the sea

(Adopted by the 8 November 2010 Ministerial Order No. 50 of the Shanghai People's Government (Act No. 50 of 8 November 2010)

Article 1

In order to strengthen the management of garbage and engineering residues, to maintain urban sanitation, and to develop this provision in line with the provisions of the Act on the Management of Sanitation in the City of Shanghai and other relevant laws and regulations.

Article 2

The disposal of garbage and engineering residues and related management activities in the city's administration area apply to this provision, except for construction garbage and engineering residues generated by the household renovation work.

Building garbage and engineering residues refer to abandoned, abandoned and other wastes arising from the construction of new construction, alterations, expansion processes and construction, construction renovation and dismantling processes.

The disposal of garbage and engineering residues refers to the various components of garbage and engineering residues, transport, transit and sterilization.

Article 3 (Management)

The city's greener administration sector is the competent authority for the disposal of garbage and engineering residues in the city and is responsible for the organization under this provision.

Areas (zone) greener administrations are responsible for the specific management of construction garbage and engineering residues within the area under their jurisdiction.

Administrative penalties for violations of this provision are imposed by law by the municipal and district administration authorities (hereinafter referred to as the urban administration).

The executive branch, such as the construction, transport ports, public safety, planning of the land, sea, water prices, quality technics, homes, environmental protection, civil defence, is in line with their respective responsibilities.

Article IV (Government responsibility)

The Government of the urban and district (zone) should incorporate the requirements for the management of garbage and engineering residues into the current financial budget.

The people's Government should strengthen its leadership in the management of building garbage and engineering residues in the area under its jurisdiction.

Article 5 (Promoting integrated use)

The city encourages the integrated use of garbage and engineering residues for construction, with priority being given to garbage and engineering residues for construction.

Article 6 (Definition of regional transport units)

The green administration sector should determine units in the area of garbage and engineering residues in accordance with Article 7 of this Article (hereinafter referred to as transport units). The number of transport units may not be less than two, and the duration of regional operations should not exceed two years.

The territorial transport units established by the green administration sector are not able to meet the requirements for the construction of garbage and engineering territorial transport in the area under the jurisdiction, and the green administration sector should increase the transport units of the Territory.

Article 7

In the area (zone) the green administration sector determines the transport units of the Territory, tenders should be made through the transport units established by the municipality's greener administration. The terms of tendering should include the following:

(i) The number of transport vehicles owned by road transport vehicles is less than 20;

(ii) Transport vehicles are in line with the provisions of the construction of garbage technology and transport management requirements (DB31/T398) and are installed in line with the transpress signals, voice signals required by the municipal greener administration;

(iii) The number of transport vehicle driver corresponds to the number of transport vehicles and through transport safety training organized by the relevant departments;

(iv) The transport vehicle driver has more than three years of experience in driving the large vehicle, without a record of road traffic accidents that bear full responsibility or primary responsibility;

(v) There is a sound enterprise management system and effective implementation.

The city's green-coordinated administration sector should issue a licence for the transport of garbage and engineering residues to the intermediate transport units.

The mode of solicitation of transport units is developed separately by the municipality's greener administration.

Article 8

The construction units (including buildings, construction units, etc.) that produce construction garbage and engineering residues should select specific freight units in the area of the construction of the garbage and engineering territorial transport units established by the greening city administration.

Article 9

The place of garbage and engineering residues (hereinafter referred to as stereotyped sites) is set up by the green administration sector in the tropolitan area (at the district) and is balancing the administrative sector in the city's green city. The following conditions should be available in the event of:

(i) E-information devices consistent with the requirements of the city's Greenization Administration;

(ii) There are facilities that meet the need for machinery and lighting, firefighting;

(iii) There is a set-up wall and a hard-clocked access route;

(iv) To establish a dedicated vehicle washing site at the Export Service, with transport vehicles washing facilities.

Article 10

The management units of the sterilization should comply with the following provisions:

(i) In accordance with the provisions of the regulations, the garbage and engineering residues shall not be subject to other items;

(ii) Maintaining the equipment, facilities and facilities at home;

(iii) Maintaining abundance and surrounding environmental integrity;

(iv) In the area of the required garbage and engineering residues to the transport units, the garbage and engineering saving vouchers for the garbage;

(v) Record the transportation vehicles entering the sterilization site, the number of garbage and engineering residues, and regularize the data reporting area (zone) in the green administration sector.

Article 11

Construction works or low-lying, distributing, beaching, etc. need to be backed into the premises of garbage and engineering residues, as well as other sites that can be subject to NPS and engineering residues, the relevant units may make applications for the establishment of abundance facility for the greening city administration sector at the location (zone) where they are validated by the zone administration sector.

The green administration sector in the area (zone) should assign exclusives to the pre-defined sterilization sites, regulate the garbage and engineering residues of the Naed buildings, meet the requirements of the garbage and engineering residues, and provide the transport units with a garbage and engineering voucher.

Article 12

The construction units, when soliciting tenders or directly issuing kits, should make specific requirements and related measures for the management of garbage and engineering residues in the solicitation documents and the signing of the contract.

Article 13

The construction units should be dedicated to the cost of transportation and disposal of construction garbage and engineering residues in the preparation of construction engineering estimates and budgets, and, prior to the application of the nuclear garbage and engineering slander disposal certificate, the construction garbage and engineering residues established by the construction units, the disposal fee-specific accounts. The construction units do not have transport fees and disposal fees to be deposited in the dedicated accounts; there is no nuclear garbage and engineering licence.

The construction of garbage and engineering residues are subject to government guidance, which is developed by the municipal price sector in conjunction with the city's Greenhouse Administrative Service.

Article 14.

Building units should choose their own premises, and construction units should enter into an sterilization contract with sterilization management units, specifying the number of construction garbage and engineering residues processed and determine disposal costs. The construction units themselves choose to disincentive sites, and transport contracts should be concluded with transport units to clarify the transport of garbage and engineering residues and to determine transportation costs in accordance with government guidance.

The construction unit commissioned transport units to choose to disincentive sites, with transport disposal contracts signed by the construction units and transport units to clarify the number of transport, disposal of building garbage and engineering residues, and to determine transport costs and disposal costs in accordance with Government guidance.

Article 15

The construction units shall apply to the garbage and engineering residues in the green administration sector of the engineering location prior to the processing of construction works or construction, construction and dismantling of the quality supervision process. The application for a nuclear garbage and engineering licence shall be submitted to the following documents:

(i) Plan for the disposal of garbage and engineering residues;

(ii) Transport disposal contracts for garbage and engineering residues, sterilization contracts, transport contracts.

The proposed construction garbage and engineering residue scheme, as set out in paragraph (i) above, should include matters such as the location, type, quantity and sterilization of garbage and engineering residues in construction; and the failure of the construction units to identify sterilization sites should be made to make applications for garbage and engineering residues.

The green administration sector in the area (zone) should be reviewed within five working days from the date of the request. In accordance with the requirements for disposal, a copy of the nuclear garbage and engineering slander disposal certificate and a corresponding number of disposal documents in accordance with the quantity of transport vehicles, and an application for the sterilization sites proposed by the construction units should be designated in accordance with the principle of integrated arrangements. Non-compliance with the requirements for disposal, the non-nuclear disposal certificate and the reasons for written notification to the applicant's unit.

The documents should contain the name of the construction unit and construction units, the name of the transport unit, the name of the engineering unit and location, the duration of the emissions, the sterilization, transport vehicle fleets, transport routes, transport time.

Contraints are prohibited, sold, rented or transferred.

Article 16

The construction units should submit construction waste and engineering saving cards to the construction administration or the housing administration.

Article 17

The construction units should be equipped with the construction site building garbage and engineering residue management, oversee the management of the garbage and engineering residues in the construction area, and ensure that the transport vehicle lags are cleaned. Workplaces that do not have oversight obligations with regard to the handling of construction on-site construction garbage and engineering residues shall not participate in the selection of the construction sites of civilization in the city.

The transport units should arrange for the supervision of the construction of field transport vehicles and, in accordance with the construction site management requirement, the lock-out and laundering of transport vehicles and the regular and normative use of equipment such as electronic information devices installed in transport vehicles.

The construction unit found that the transport unit had breached the provisions of the disposal and should require the immediate transformation of the transport unit; the transport unit refused to change, and the construction unit should report immediately to the management sector in the green market. After reports from construction units received by the Green City Administration, the construction sites should be checked on time.

Article 18

Transport construction garbage and engineering residues should be synonymous with the installation, use of record routes, time and sterilization of electronic information devices, carrying out the vehicle's disposal certificate and routing in accordance with the lines established by the transport, public safety transport.

Transport vehicles should be closed; shipping vessels should be closed or covered. Construction garbage and engineering residues in transport routes shall not be disclosed, dumped or pushed.

Article 19

The garbage and engineering residues should be allowed to operate at a minimum level, with video surveillance systems, e-information devices and anti-soil facilities that are consistent with the requirements of the city's greener administration sector, as well as back-up of the administration sector in the area (zone).

Article 20

Prior to the start-up of transport units, construction units should be delegated to the construction units to inform the green administration sector in the area (area) of the location of the works, and to communicate the construction of garbage and engineering slags, emission times, freight fleets, transport routes, sterilization sites, etc., respectively, to the extent that the area (areas) at the location of the Nuna area is known.

When the transport units are required to transport the building garbage and engineering residues to the prescribed sterilization sites, the ministered site management units should immediately distribut the building garbage and engineering slags to the transport units.

The transport unit may claim transportation fees and disposal fees for the green administration sector in the area where the settlement vouch is obtained from the settlement certificate to the location of Nasteruna, which shall be verified within two days by the Green Town Correspondent Administration Department of the District (Parea) within 2 days, and by verification of compliance with the requirements, the construction units shall be informed.

Article 21 (Information systems)

The city's green-coordinated administration sector should establish a construction garbage and engineering saving management information system with other relevant administrations to incorporate transport units, shipping boats, driver, information on sterilization sites, as well as applications for garbage and engineering residue disposal, and approve information into the information system.

Article 2 (Option inspection)

Law enforcement officers in the green administration sector in the city and district (zone) should conduct monitoring inspections in accordance with the law on the handling of garbage and engineering residues.

When law enforcement officials carry out inspections, the time, place, content, problems identified and processing of inspections should be kept in writing.

In carrying out inspections, law enforcement documents should be presented without prejudice to the normal production of the relevant units and individuals.

Article 23 (Migation of complaints)

Any unit and individual found that the garbage of construction and engineering residues were in violation of this provision, and complaints and reports could be made to the management sector in the green city or to the urban administration. Upon receipt of complaints and reports by the Green Municipal Correctional Administration or by the urban administration, the complaints and reports should be processed within the prescribed time frame and the findings were communicated to the complainant.

Article 24

In violation of this provision, laws, regulations, regulations and regulations have already been provided for sanctions.

Article 25 (General penalties for transport units)

In violation of this provision by transport units, the authorities of the urban administration are correct and punished in accordance with the following provisions:

(i) In violation of article 7, paragraph 1 (b), of the present provision, the use of transport vehicles that are not in accordance with the provisions of article 7, paragraph 1 (ii), with a fine of more than 200 dollars;

(ii) In violation of article 17, paragraph 2, of the present provision, no dedicated person has been placed in the management of the construction site, with a fine of more than 1,000 dollars.

Article 26

In violation of this provision by construction units, the responsibility of the urban law enforcement authorities is changed and punished in accordance with the following provisions:

(i) In violation of article 8 of the present article, the transport of transport units established by the Greenhouseholding Administration has been entrusted with a fine of more than 10,000 dollars, without the exception of the area (the district);

(ii) In violation of article 15, paragraph 5, of the present article, the modification, sale, rental, borrowing or transfer of the disposition certificate shall be punishable by more than 5,000 dollars.

Article 27

In violation of article 10 of the present article, the management unit of the Nauna premises is not in compliance with the relevant management provisions, which is being rectified by the municipal law enforcement authorities, with a fine of over 3,000 dollars.

Article 28 (Option of construction units)

In violation of article 17, paragraph 1, paragraph 3, of the present provision, the construction unit was not managed by a manager or was not reported to the management and was converted by a warrant for the construction of an administrative authority, with a fine of more than 1,000 dollars.

Article 29

The transport units have been punished for more than three times (three cases) during a period of time, with the release of their construction garbage and engineering arsenal by the municipality's green administration.

(i) No seal or cover transport;

(ii) The transport vehicle is garbage and engineering residues;

(iii) The dumping, storage, disposal of building garbage and engineering residues by transport units;

(iv) The transport units carry out construction waste and engineering residues that do not have access to disposal documents.

During the period referred to in the previous paragraph, the executive branch of the city's greening city is regulated and adjusted according to the management needs.

The transport units have unauthorized dumping, storage, disposal of garbage and engineering residues for buildings and works that do not have access to the disposal certificate, in the circumstances of a serious nature, and the release of their construction garbage and engineering licenses by the municipality's administration.

The driver of the transport unit has resulted in a cumulative loss of more than three people and assumes full responsibility or primary responsibility, which is revoked by a construction garbage and engineering licence for the transport unit by the municipality's green administration.

Article 31 (Administrative oversight)

One of the following acts in the area (zone) in the green administration sector, in the district (zone) and in the city's management sector, are reported to be criticized on the basis of its mandate:

(i) No solicitation or enhancement of transport units, in accordance with the requirements established;

(ii) Inadequate redress and investigation of the founding offences;

(iii) Other cases where oversight functions are not performed by law.

In the case of a former act, which has serious adverse effects, the administrative disposition of the person directly responsible is provided by law.

Article 31 (Central accountability for violations committed by law enforcement officials)

One of the following acts was committed by staff members of the Green City Administration, the Law Enforcement Service and other relevant administrative departments, who were directly responsible by their units or superior authorities, and were criminally criminalized by law:

(i) No law enforcement can be determined by law enforcement or by intentional violation of the statutory procedures;

(ii) Law enforcement using tools such as violence, threats;

(iii) The intentional damage or the breach of the provisions that undermine the property of the parties;

(iv) The breach found is not lawful;

(v) Abuse of mandates,ys of negligence and other acts of private fraud.

Article 32 (Actual date of application)

This provision has been implemented effective 1 January 2011. Publication No. 10 of the Supreme People's Government Order No. 10 of 11 January 1992, was repealed in accordance with the amendment to No. 53 of the Shanghai People's Government Order No. 53 of 14 December 1997 and released the Regulation on the Management of the Construction and Engineering Hands in Shanghai City.
