Decision of the Government of the Northern Province to amend the Rules for the Mobilization and Use of the Water-building Fund in Northern Province of the River

(Adopted at the 95th ordinary meeting of the Government of the Northern Province on 9 October 2011, by Decree No. 7 of 9 October 2011 [2011] of the People's Government of Northern Province of the River, which was published as from 20 November 2011)

The Northern Province People's Government has decided to amend the Rules for the Mobilization and Use of Management of the Water-building Fund in Northern Province as follows:

The topic was amended to read: “Financing and using the management approach of the Water-building Fund in Northern Province of the River”.

Article 1 amends to read: “In order to accelerate water conservation, to increase the capacity to configure water resources, to mitigate the contradictions in water resources and to promote sustainable economic and social development, and to develop this approach in line with relevant national provisions”.

The second amendment reads as follows: “The Water-building Fund referred to in this approach refers to specific funding for the construction, maintenance and governance of water-focused works, based on national and I provincial provisions”.

Article 3 was amended to read: “The Water-building Fund is divided into the Provincial Water-building Fund and the Urban Water-Energy Fund in the area of construction, which is mobilized and used separately by all levels of the people's governments in accordance with their governmental funds, administrative expenses and other funds that should be extracted from the Water-powering Fund.

(i) Three per cent of royalties from provincial government funds and administrative causes. The Governmental Fund and administrative cost charges for the Water-building Fund should be extracted, including vehicle traffic and expropriation management fees. Of these, the joint venture was constructed on the basis of three per cent of the revenue earned on vehicle movement in my province;

(ii) The Government of the Provincial People's Government provides for funds to be transferred from central to local oil prices and tax bills;

(iii) Remove three thousand dollars of the proceeds of the construction of a management fee for river works in the province, as prescribed;

(iv) Revenues from hydro-engineered water from national and provincial investment by provincial water administrations: 5 per cent of the agricultural water cost income, 12 per cent of the urban water cost income, 17 per cent of industrial consumption, recycling of water, habitual water cost income, and 10 per cent of the water-powered electricity;

(v) National and provincial governments provide for the inclusion of other funds in the Water-building Fund.”

Article 5 amends as follows:

(i) Three per cent of the municipal government funds and administrative revenue earned from the establishment area. The Governmental Fund and the administrative cost charges of the Water-building Fund should be extracted, including vehicle traffic fees, urban infrastructure support costs, and expropriation management fees. The joint venture was constructed on the basis of three per cent of the cost of vehicle movement earned by the municipalities in each area;

(ii) Cities with a focus on flood protection and severe water resource shortages have been disbursed by less than 15 per cent of the urban maintenance tax that is used for urban flood prevention and water resource allocation. The specific proportion is determined by the Provincial Finance Department with the Water Administration. Cities with a focus on flood protection and severe shortage of water resources are identified by provincial water administration authorities with advice from the housing and rural-urban construction sectors;

(iii) The construction of maintenance costs for river works that are subject to the provisions;

(iv) States and provinces and the municipalities in which they are established are required to include other funds from the Water-building Fund.”

Article 7 amends as follows:

(i) Provincial water conservation funds are mainly used to: provincially identified priority water resource allocation projects; governance of major rivers, lakes and garners throughout the province; insecure in the disease; infirmed security in the country; in the management of the Miguel telecommunications system in the province; infrastructural water loss prevention and management; in rural water, hydropower construction; water conservation and renovation; intact and emergency response; and in other hydrothermal projects approved by the Government of the province;

(ii) The municipal water conservation fund in the construction area is mainly used to: urban-focused water resource allocation projects in the construction area; urban protection facilities and construction, maintenance and governance in the area of rivers, lakes, hortidals, etc.; water-soil management; soil erosion prevention and management works; rural water, hydropower construction; water conservation and renovation; and drought prevention and emergency rehabilitation; and other water engineering projects approved by the municipalities;

(iii) The major hydroelectric construction works across the basin and across provinces should be financed by the funds that I have assumed in my province, as well as by major hydropower construction funds across the urban areas of the area, which are shared by the province with the relevant municipalities.”

Article 8 amends as follows: “The income and expenditure of the Water-building Fund is included in the budget management of the Government Fund, with a dedicated section, and the end-of-year balances can be accommodated over the next year. Of these, investment projects for fixed assets should be included in fixed-term asset investment plans.

The financial sector at all levels is responsible for the transfer, collection and financial management of the Water-building Fund, with expenditure plans for the Water-building Fund (item) from the same-level financial sector at all levels of water administration to include projects in the fixed asset investment plan.

Article 9 is amended to read: “The Water-Food-building Fund is charged by the source of funds raised by the following units: extracting from government funds and administrative expenses incorporated in budget management, transfer of funds from central to local oil prices and tax charges reform, directly by the financial sector at all levels, and distributing funds to the production, operation of entrepreneurship units and units engaged in planting, breeding production units, personalized river engineering construction costs, and water-for-feeding, or distributing authorities.

The Provincial Waterpower Fund incomes are organized by the Provincial Finance Department, the provincial water administration authorities, in line with their responsibilities, to organize the collection and inspection.”

Delete Article 12.

The order of the relevant provisions of this approach is adjusted accordingly, in accordance with the above amendments. In addition, individual languages were revised.

The present decision has been implemented effective 20 November 2011.

The Rules for the Mobilization and Use of the Management of the Northern Province of the River Basin Fund are released in accordance with this decision.

Annex: Modalities for the mobilization and use of management in the Northern Province of the River (Amendments of 2011) (published on 26 June 1997 by the Government of the Northern Province of the River, No. 16 of 24 September 2002 [2002], in accordance with the first revision of the People's Government Order No. 7 of the Northern Province of the River on 9 October 2011]

Article 1 promotes sustainable economic and social development in order to accelerate water conservation, enhance the capacity of flood mitigation and water resource allocation, mitigate the conflicting supply of water resources, and develop this approach in line with relevant national provisions.

Article 2

Article 3 Water-building funds are divided into provincial water conservation funds and urban water conservation funds in the area of construction, which are mobilized and used separately by all levels of the people's governments in accordance with their governmental funds, administrative fees and other funds that should be drawn from the Water-building Fund.

Article IV Sources of the Provincial Water-building Fund:

(i) Three per cent of royalties from provincial government funds and administrative causes. The Governmental Fund and administrative cost charges for the Water-building Fund should be extracted, including vehicle traffic and expropriation management fees. Of these, the joint venture was constructed on the basis of three per cent of the revenue earned on vehicle movement in my province;

Article 6. The financial sectors at all levels should be transferred on a regular basis in accordance with established projects and proportions, and the water-living fund drawn from water engineering water costs for national and provincial investment construction by all water administration authorities should be distributed in a timely manner.

Article 7 Use of the Water-building Fund includes:

(i) Provincial water conservation funds are mainly used to: provincially identified priority water resource allocation projects; governance of major rivers, lakes and garners throughout the province; insecure in the disease; infirmed security in the country; in the management of the Miguel telecommunications system in the province; infrastructural water loss prevention and management; in rural water, hydropower construction; water conservation and renovation; intact and emergency response; and in other hydrothermal projects approved by the Government of the province;

(ii) The municipal water conservation fund in the construction area is mainly used to: the urban priority water resource allocation project in the establishment area; the urban protection facility and construction, maintenance and governance in the area of rivers, lakes, thans, etc.; the influenza conservation and management of the disease; the construction of water erosion control works; the construction of rural water, hydropower construction; water conservation and renovation; the prevention of drought and emergency rehabilitation; and other water-related projects approved by the municipalities;

(iii) The major hydroelectric construction work across the basin and across provinces should be financed by the funds that I am burdened by the province, as well as by major hydro-engineering funds across the urban areas of the area.

Article 8. The income and expenditure of the Water-building Fund is included in the budget management of the Government Fund, with dedicated funds, and the end-of-year balances can be transferred to the next year. Of these, investment projects for fixed assets should be included in fixed-term asset investment plans.

The financial sector at all levels is responsible for the transfer, collection and financial management of the Water-building Fund, with expenditure plans of the Water-building Fund (projects) by the same-ranking financial sector at all levels, including projects in the fixed-term asset investment plan.

Article 9. The Water-building Fund is charged on the basis of the source of funds raised by the following units: extracts from government funds and administrative fees that are incorporated into the budget management, from central transfers of local oil prices and tax bills and from the financial budget allocated for the transfer of funds, directly from all levels of the financial sector; direct transfers of funds to the production, operation of business units and units engaged in cultivation, breeding industry production, maintenance of privately-leaded river works, and provision of water supplies, or administrative authorities.

The provincial water-building fund income is organized by the provincial financial sector, the provincial water administrations are responsible for the collection and auditing.

Article 10. The financial sector at all levels should establish a predetermined management and financial management approach for the sound water-building fund to ensure that funds are paid in a timely manner and that funds are allocated in a timely manner, as required. Specific approaches were developed by provincial finances with the relevant sectors.

The relevant sectors and units of Article 11 should be raised, used for the construction of water resources as prescribed by law, to expand the scope of collection, to raise standards for collection and to interception, crowding and misappropriation of the water resources fund, to be dealt with by law in the sectors of finance, audit, inspection.
