Security emergency management provisions in Northern Province

(The 115th ordinary meeting of the Government of the Northern Province of the River, held on 28 December 2012 to consider the publication, through Order No. 15 of 28 December 2012, of the People's Government Order No. 15 of the Northern Province of the River, effective 1 February 2013)

Chapter I General

Article 1 regulates the management of safe production emergency response and guarantees the safety of public life and property, in accordance with laws, regulations and regulations such as the People's Republic of China's Emergency Response Act and the Northern Province Security Production Regulations.

Article 2, paragraph 2, applies to emergency management activities such as prevention and emergency preparedness, monitoring and early warning, emergency disposal and relief for the production of security accidents in the province's administrative region.

Article III establishes a unified leadership, integrated coordination, sub-level responsibility, classification management and management system for safe production response management.

More than the people at the district level are responsible for the management of safe production emergency response within the present administration, commanding, coordinating the management of the relevant departments and the lower-level people's governments in the production of safe accident response, and establishing the responsibility for the safe production of emergency management.

Article IV

The security production emergency response command established by the Government of the Provincial People is tasked with the coordination of emergency relief commands for heavy production of safe accidents, as well as for emergency maintenance, emergency response training, emergency response capacity, emergency information development, major dangerous source control. The security production emergency management body established by the relevant departments of the provincial government is specifically responsible for the management of safe production emergencies in this sector or in this area.

The municipalities and counties in the area (markets, zones) should be clearly identified by the Government of the people to produce emergency relief command structures, with specific responsibility for such tasks as emergency response command, response performance, emergency information development, major hazardous source control.

Article 5

Article 6 encourages, supports the autonomous development of scientific and technical equipment in the area of safe production of emergency response, scientific institutions, the introduction of advanced relief equipment and advanced technologies and the enhancement of emergency response capacity.

Article 7. The Government of the people at the district level shall, in accordance with the relevant provisions of the State and the province, provide recognition and incentives for units and individuals that have made a prominent contribution in the production of safe accidents, and provide adequate treatment and pensions to those who have suffered or suffered during the rescue process.

Chapter II

Article 8. The Government of the people at the district level shall organize the relevant sectors to be subject to a strict inspection of the production units that are vulnerable to production accidents in the present administration area, in accordance with their respective responsibilities.

The productive units should regularly check the implementation of the security-prevention measures of this unit and address accidents in a timely manner and prevent production of safe accidents.

Article 9. The Government of the people at the district level and its relevant authorities shall, in accordance with the relevant provisions of the State and the province, establish a pre-emption case for the production of safe accidents in the current administrative region, in this sector and in accordance with the relevant provisions.

The productive units should be directed at possible production safety accidents in this unit, to establish a production safety accident emergency case, as required by the State and the province concerned, to report on the corresponding security production monitoring management and other related sector reserves.

More than the people at the district level and their relevant departments, the pre-empts developed by the productive units for the production of safe accidents should be mutually reinforcing and be revised in a timely manner in accordance with the relevant provisions of the State and the province.

Article 10 Governments and their relevant departments and production units should implement emergency resources such as emergency response organizations, personnel, strengths, equipment, material, experts, to conduct emergency response exercises and to record performance of the exercise and to provide an overview and assessment of the effectiveness of the performance, as required by the production of safe accidents response.

Article 11. The management of safe production monitoring of the population at the district level may establish a professional security production emergency response based on the needs of local security production.

Article 12. The mines of coal and non-coal mines should be established in accordance with the relevant provisions of the State and be administered with a quality.

Large construction units, transport units and production, operation, storage units of hazardous items should be established with a dedicated security production response.

The small- and medium-sized construction units, the production, operation, storage units of transport units and hazardous items, as well as the operating use units of large nodule facilities, passenger freight forwards, provide conditions for the establishment of a dedicated security production emergency response team; and, without conditions, the creation of a part-time safe production emergency response team and the signing of a safety accident relief agreement with the full-time security-time production rescue force close to the same production units.

Other productive units should be equipped with emergency relief assistance personnel that are responsive to the scale of operations produced by this unit, and a production safety accident relief agreement is concluded in accordance with the relevant provisions with the full-time safe production emergency response team.

Social forces are encouraged to set up a dedicated safe production emergency response force to provide productive safe accident relief services to productive operators.

Article 13 Professional and dedicated security in the production of emergency relief teams shall be administered on a case-by-case basis in accordance with the relevant provisions.

Part-time safe production of emergency response teams should be trained accordingly and met the conditions set by the province.

Article 14. The safe production of emergency response teams should work in conjunction with real war needs, develop training plans, undertake appropriate training, enhance rescue capacity and purchase contingency insurance for emergency relief personnel.

Article 15. The full-time safe production of emergency response teams should conduct regular preventive safety inspections of the productive units within the service area, familiar with the relevant aspects of the pre-disaster response, the surrounding environment, the geomorphology, and the risk factors of major dangerous sources.

Article 16 is dedicated to the safe production of emergency relief teams to participate in the production of safe accidents or to the provision of related technical services in accordance with the relevant provisions.

The variety and normative aspects of the production security accident relief agreement are developed by the Ministry's Government's safe production management.

Article 17

More than 18 per cent of the population's government in the area of safe production monitoring and management and other relevant sectors should take a variety of forms to promote knowledge such as safe production of emergency laws, accident prevention and avoidance, self-saving, inter-saving and emergency disposal, and to raise public awareness and capacity for safe production.

The productive units should conduct awareness-raising and training on the production of emergency knowledge in the context of the actual situation of the unit.

Chapter III Monitoring and early warning

More than 19 per cent of the population's Government's safe production monitoring management should establish a security production emergency management information platform to improve the relevant databases, such as the rescue, relief and relief experts, and to monitor potential accidents in production and major dangerous sources.

Article 20 shall establish a safe production monitoring system, as required by the State and the province concerned, to ensure the proper functioning of the monitoring system. Of these, units such as mines, construction units, transport units, production, operation, use, transport and storage of hazardous items, as well as major dangerous sources, should be transferred to safe production monitoring management or safe production of emergency relief services, as required.

Article 21 provides for the safe production of emergency information platforms at all levels and for the safety of productive units to achieve interconnection, information sharing and ensure information security.

Section II of the Safety Production Monitoring Management should establish an early-warning coordination mechanism with meteorological, ocean, jeopardy, land resources, earthquakes and agencies to have timely access to early warning information on relevant natural disasters, to identify potential accidents in production and to provide early warning information on production safety at the national and present levels, in accordance with the relevant provisions of the State.

The Government of the people in the area where a security accident occurs, and the production security accident in the vicinity of the administration, should be sent in a timely manner to the Government of the neighbouring region for early warning of production safety accidents.

The Government of the above-mentioned population at the district level and its relevant departments, the productive business unit, after receiving early warning information on production safety accidents, should respond in a timely manner to avoid or mitigate potential hazards.

Chapter IV

Article 23, after the production of a security accident by the productive units, shall immediately trigger the corresponding contingency advance and report to the relevant sectors of the Government of the people affected by the accident. After reports received from the concerned sector, reports should be made promptly, in accordance with the relevant provisions and the launch of the corresponding emergency prestigation, and the organization of a safe accident in production.

Article 24 Production of a security accident may endanger the safety of the surrounding public, the Government of the people of the accident should immediately organize evacuations, evacuations and placements of the person concerned, with the greatest possible reduction in the loss of life property caused by the accident, and to prevent the occurrence of sub- and derivative accidents. The relevant units and personnel should be subject to the command and arrangement of the local people's Government and cooperate actively with the evacuation.

Article 25 provides for the production of safe accident relief missions, which can be used by alerts, markers and, in order to ensure security, are not subject to movement, route, direction and command signals. Transport management command officers should ensure prompt movement of the relevant vehicles.

The outposts of special emergency relief vehicles are jointly established by the provincial Government's public security, transport and security production monitoring authorities.

Article 26 Governments of more people at the district level may, in the process of production of safe accident relief, make use or use by law of relief supplies, facilities and equipment of citizens, legal persons or other organizations.

Article 27 provides for the redeployment of emergency relief teams in the production of safe accidents emergency response, as well as for the borrowing or requisition of relief supplies, facilities and equipment, to be borne by the productive safety accident liability units. The responsibility for the production of a safe accident is indeed unable to assume and is addressed in coordination with the Government of the people who have been affected by the accident.

Article 28, which causes damage to public infrastructure, such as water supply, electricity, heating, transport, communications, etc., due to the production of security accidents, shall organize the rehabilitation of the affected sectors as soon as possible and ensure normal production, living needs.

Chapter V Legal responsibility

Article 29 of the Law on the Safety and Production Monitoring of the People's Government at the district level or in other relevant departments and their staff have one of the following acts, which are taken in accordance with the law by the competent and other persons directly responsible, suspected of committing crimes by the judiciary:

(i) The development of pre-emptions to produce safe accidents in accordance with the relevant provisions;

(ii) No early warning information on the production of safe accidents has been issued in a timely manner;

(iii) No timely organization of safe accident relief;

(iv) Other abuses of authority, omissions, provocative fraud.

Article 33, which is one of the following conditions in the productive business unit, is being converted by the time limit for the management responsible for the safe production supervision, which has not been corrected and may be fined up to one million dollars:

(i) The establishment of a safe production emergency response rescue force, or the absence of a provision for emergency relief agreements with the full-time safe production emergency response team;

(ii) The full-time safe production of emergency response teams, without dedicated training, to carry out the collection of costs for the production of safe accidents;

(iii) Not to require the establishment of a security production monitoring system, the transmission of monitoring information to the relevant oversight management or emergency command institutions.

Article 31, other violations of this provision, provides that the relevant laws, regulations and regulations provide for legal responsibility.

Annex VI

The safe production of emergency management activities for nuclear accidents and radiation accidents is not applicable.

The safe production of emergency management activities in coal mines is provided by law, legislation and regulations.
