Rural Highway management approach in the vast Hindu province

(Adopted at the 65th ordinary meeting of the Eleventh People's Government, held on 14 January 2013, No. 278 of 23 January 2013, published from 1 April 2013)

Chapter I General

Article 1, in order to strengthen rural road management, ensure access to rural roads and promote rural economic and social development, and develop this approach in line with the laws, regulations, such as the People's Republic of China Highway Act (hereinafter referred to as the Highway Act).

Article 2 refers to rural roads that are included in road planning and are constructed in accordance with national or provincial technical standards, communes, village tunnels and their links, tunnels and crossings.

Article 3. This approach applies to the planning, construction, conservation, management and use of rural roads within my province's administration. The State also provides for the provision.

Article IV. Rural road planning, construction, conservation and management should be guided by the principles of harmonization of leadership, district-level management, construction and re-orientation and coordination of development.

Article 5

The Government of the county is the subject of responsibility for the construction, conservation and management of rural roads in this administrative area, and should integrate rural road work into the Government's objectives and organize the coordination of rural roads in the relevant sectors.

Governments of the urban, district and communes (communes) should enter into performance appraisals on a case-by-step basis with the responsibility to work on rural roads.

Article 6. The provincial, municipal and district transport administration is responsible for the work of the rural highway within the current administrative area, with the high-level management responsible for the administration of rural roads in accordance with the law.

Relevant sectors such as development reform, finance, land resources, environmental protection, rural and urban construction, agriculture, water conservation, forestry and public safety are working on rural roads in accordance with their respective responsibilities.

In the context of the commune commune communes' responsibilities, the communes are responsible for the construction, conservation and management of villages.

Article 7. Rural Highway construction, conservation of sands, stones, soils, living land, water and electricity, etc., should be addressed in an integrated manner in accordance with the relevant provisions.

Chapter II Planning and construction

Article 8. Rural road planning should be based on national economic and social development planning, in line with the needs of people to produce their lives, in line with national and provincial rural road development goals, in coordination with national, provincial development planning and other means of transport development planning, and in line with rural and urban planning.

Rural Highway passenger terminals should be aligned with rural highway planning, integrated construction and compliance with prescribed standards.

Article 9 is planned by the district transport administration to be prepared in the same sector, with the approval of the Government of the city and the provincial transport administration.

The communes, village charts are prepared by the People's Government, assisted by the district transport administration, approved by the county's Government and reported to provincial and municipal transport administrations.

Rural road planning needs to be modified, approved by the pre-approval authority and reported to the top-level transport administration.

Village planning and modifications should be adopted by the villagers' conference or by the villagers' representatives conference before they are sent for approval.

Article 10 states, communes, nams and numbers of communes are determined by the provincial transport administration in accordance with the relevant provisions of the Department of State, the province, and by the municipal transport administration in accordance with the relevant provisions of the provincial transport administration.

Article 11. Rural road construction, including new construction and alterations, should be carried out in accordance with the basic State-mandated construction procedures and the relevant provisions of the State, with the responsibility of the Government of the county and the territorial transport administration and its associated road management agencies. The specific responsibilities of the commune and village councils in rural road construction are determined by the Government of the county.

Article 12 The district transport administration should, in line with the rural road planning, prepare annual rural road construction proposals, with the consent of the communes, post the approval of the municipal transport administration, fund-raising subsidies and municipal matching funds, in accordance with the annual capital subsidies granted jointly by the provincial transport administration and the fiscal sector, and provide annual funding for the construction of a fund subsidy scheme and the provincial transport administration.

The approved annual rural highway construction plan will need to be revised, with the approval of the original approval authority.

Article 13. Rural road construction should be in line with national and provincial standards relating to road engineering technology, save land, rationalize the use of old road resources and protect the ecological environment.

Transport safety and other subsidiary facilities, such as the protection of rural roads, drainage and traffic symbols, should be built in parallel with the main works.

Article 14. The technical standards are designed for more than four rural roads and bridges, tunnel works, which should be borne by the design units with corresponding qualifications, and the design of other rural road works, which can be absorbed by the district transport administration.

Article 15. Rural road construction should be carried out in accordance with the relevant provisions of the project legal body responsible for the administration of tenders, the contract management system and the engineering administration system, and be held accountable for the safety of production responsibilities and quality of works in accordance with the relevant provisions.

Article 16, after the completion of the rural road construction project, the units originally approved were to organize the receipts in accordance with the relevant national provisions and to collect, collate, maintain engineering information, establish the engineering archives in a timely manner, and transfer to the district transport administration after the completion of the process was eligible.

Chapter III Conservation

Article 17 should establish a system and operational mechanism for the sound management of the roads in line with rural road conservation.

Article 18 Rural road conservation should be conducted in accordance with relevant national and provincial technical norms and operational protocols to ensure the proper use of roads, slopes, well-established pathways, and water accessibility, greenization and the normal use of roads.

Article 19 Regional transport administrations should prepare annual and medium-sized specialization conservation plans based on the technical situation of rural roads, and, with the consent of the commune people, report to the municipal transport administration for the provincial transport administration.

Rural Highway works and non-specialized conservation schemes are being prepared by road management agencies, affiliated with the district transport administration, with the approval of the district transport administration and the presentation of the municipal transport administration.

Article 20 Conservation and communes and specialization of village routes are carried out by road management agencies affiliated with the district transport administration.

The non-specialization of communes, village trajectorys is the responsibility of the People's Government and the Village People's Commission, which can be done through the establishment of mass, professional conservation organizations or by individual subsidiaries.

Article 21, the territorial transport administration should strengthen the conservation of rural road bridges by maintaining a good technical condition and by setting limits in a timely manner in accordance with the relevant provisions and taking appropriate maintenance measures.

The district transport administration should strengthen the maintenance and management of rural road safety facilities and establish clear traffic symbols and security protection facilities in emergency, lope, rivers, etc.

The Government of the communes, communes (communes) should, in accordance with the requirements of the road conservation techniques, work on the greening of rural roads in the light of the realities of rural roads.

The basic conditions and safety of vehicle movement should be guaranteed during the period of the rural Highway conservation operation, without interruption of transportation by conserving operations.

Transport must be disrupted by conserving operations, and the transport management of the public security authorities should be given a social notice in accordance with the law and set a sign of circumventation.

Article 24, when rural roads are disrupted or severely damaged by natural disasters or other sudden events, the Government of the communes, communes (communes) should initiate emergency presupposes and organize rehabilitation. Where necessary, transportation can be restored as soon as possible, in accordance with the law, by mobilizing institutions, groups, business units and the local population.

Article 25, the provincial, municipal and district transport administration should establish a database on rural road management conservation in the region of the administration, improve information systems for rural road management and provide technical support and decision-making services for rural road management.

Chapter IV

Article 26 Highway management, affiliated to the district transport administration, is governed by the law by the authorities of the rural highway administration within the current administration and is guided by the industrial management and operation of the provincial, municipal transport administration and road administration.

Article 27 Highway management, affiliated to the district transport administration, performs the following responsibilities for the management of rural roads within the current administration:

(i) Management of rural road construction zones;

(ii) The protection of the right to a road;

(iii) Processing administrative clearance of rural roads;

(iv) Governance of the excess transport of rural roads;

(v) Establish a day-to-day inspection system for the sound rural highway, which is to be halted, inspected and corrected in accordance with the law;

(vi) Development of emergency response scenarios for rural roads in the current administrative region;

(vii) Other responsibilities under laws, regulations.

Article 28 covers the area of rural road construction control, with a distance from the highway area.

(i) The district is not less than 10 metres;

(ii) The commune is not less than 5 metres;

(iii) Villages are not less than 3 metres.

Chapter V Funding and management

Article 29 states that the Government of the city and the people of the district shall establish a mechanism for the construction, management and financing of rural roads, which are dominated by public financial inputs, are financed by multiple channels, and encourage the participation of all communities in society.

Rural Highway construction, management of conservation funds are raised by the Government of the People of the District, and provincial and municipal finances are subject to the provision of the provincial grants, which should be processed in accordance with the current financial transfer procedures.

It is prohibited to collect the cost of movement of vehicles in any form on rural roads.

Article 33 Sources of rural road construction and management of conservation funds:

(i) Financial allocations;

(ii) Specific funding for road construction;

(iii) Financial transfers of funds;

(iv) Grant funds from the provincial transport administration;

(v) Social donations, businesses and individuals voluntarily funded;

(vi) Other means specified by law, legislation or by the State Department.

Article 33 Rural road construction is supported by provincial transport administrations with provincial finances, which are not matched by provincial subsidies, and other parts of the capital are funded by the Government of the county.

In the province, the Ministry of Transport has established a special grant for the conservation of rural roads, which will be financed by the provincial financial sector, in accordance with the standards established by the Ministry of Rural Highway, the maintenance cycle and the performance appraisal process, and the city's finances, in accordance with the standards established by the province, and the other parts of the conservation funds are addressed by the people of the counties in accordance with the provincial standards and incorporated into the district financial budget.

Rural road conservation funds should be increased in accordance with the increase in road conservation and the growth of government financial resources. The rural road conservation course was declared by the district transport administration, the municipal transport administration was reviewed and the provincial transport administration confirmed.

The rural roads are approved every two years, and the financial sector should adjust conservation funds in a timely manner, based on the approved course.

Article 32 funds for rural road construction and conservation by the communes' governments should be paid in full and in a timely manner, and the provincial transport administration will deduct the same proportion as provincial finances without being fully in place.

Article 33 Rural Highway construction, management of conservation funds should be subject to sectoral budget management, accounting for money, specialization, inspection in the sectors of audit, finance, transport, etc., and no unit or individual should be stopped, crowded and diverted.

Chapter VI Legal responsibility

Article 34, in violation of this approach, impedes the construction of rural roads, emergency hidings and constitutes a violation of the law, punishes them in accordance with the provisions of the Law on the Safety and Security of the People's Republic of China; and criminalizes by law.

Article 33 15, in violation of this approach, provides for damage, property losses to rural roads, roads and subsidiary facilities, which should be subject to corresponding civil responsibility by law.

Chapter VII

Article 36 of this approach is implemented effective 1 April 2013.
