Fifth agricultural administrative departments in local people's Governments at or above the county level shall strengthen the mushroom germplasm resources conservation and breeding, production, updates, promotional work, encourage the combination of breeding, production and management.
Chapter germplasm resources protection and breeding of the sixth national protection of germplasm resource of edible fungi, no unit or individual may seize and destroy. Seventh prohibits the collecting State protection of natural germplasm resource of edible fungi.
Due to special circumstances such as the collecting of scientific research, they shall apply for collection procedures.
Eighth article of any units and individuals to offer foreign germplasm resource of edible fungi (including having a long cultivation of mycelium matrix and for the isolation of fruiting bodies), it should be examined by the provincial departments of agriculture administration, reported to the Ministry of agriculture for approval.
Nineth strains introduced from abroad, you should quarantine in accordance with law, and after the introduction in the 30th, sending appropriate strains to China's agricultural management of microbial culture collection Center.
The tenth State to encourage and support units and individuals engaged in the breeding and development of edible fungus varieties, encouraging research institutes and enterprises to combine breeding new varieties, guide enterprises to invest in breeding new varieties.
Breeding of new variety may apply for rights to new varieties of plants, national legal rights of protection of variety right owner. 11th mushroom varieties (introduced) may voluntarily apply to the national agro-technical extension and Service Center finds.
National agro-technical extension and service center established edible germ species that the Committee, technical appraisal of the bear species found. 12th edible germ species name should be standard.
Specific naming conventions prescribed separately by the Department of agriculture.
Chapter three strains produce and deal in 13th in spawn production of units and individuals, should be made a edible fungus production and operation license.
Units and individuals engaged in cultivation operation only, you can handle the strains of edible fungi production and operation license, but operators have a strain-related knowledge, with strains of appropriate storage facilities and venues, and county-level people's Government departments of agriculture administration.
The 14th seed and the seed of the edible fungus production license, the local people's Governments at the county level departments of agriculture administration audit, issued by the provincial departments of agriculture administration, Department of agriculture records.
Cultivars of the edible fungus production license issued by the administrative departments of people's Governments at the County agriculture, provincial departments of agriculture administration. 15th article application mother species and original species mushroom strains production business license of units and personal, should has following conditions: (a) production business mother species registered capital 1 million Yuan above, production business original species registered capital 500,000 yuan above; (ii) provincial government agricultural administrative competent sector assessment qualified of test personnel 1 name above, and production technicians 2 name above; (three) has corresponding of sterilization, and vaccination, and training, and storage, equipment and places, has corresponding of quality test instrument and facilities.
Production of parent types should also be cultivated to the desired device and place; (iv) production site sanitary and other conditions are in accordance with the Ministry of Agriculture of the edible fungus production technical regulation requirements. 16th article application cultivation species mushroom strains production business license of units and personal, should has following conditions: (a) registered capital 100,000 yuan above; (ii) provincial government agricultural administrative competent sector assessment qualified of test personnel 1 name above, and production technicians 1 name above; (three) has necessary of sterilization, and vaccination, and training, and storage, equipment and places, has necessary of quality test instrument and facilities; (four) cultivation species production site of sanitation and the other conditions meet Ministry of agriculture
Technical specification for edible fungus production requirements.
17th article application mushroom strains production business license, should to County Government agricultural administrative competent sector submitted following material: (a) mushroom strains production business license application table; (ii) registered capital proved material; (three) strains test personnel, and production technicians qualification proved; (four) instrument equipment and facilities listing and the property proved, main instrument equipment of photos; (five) strains production business places photos and the property proved; (six) varieties characteristics introduced;
(G) the spawn production management and quality assurance system.
Apply mother seed production and operation license for the protected variety shall also provide variety right owner (breeding people) authorized written verification. 18th County departments of agriculture Administration accepted species and seed production business license applications, organized experts to conduct field visits, but shall, from the date of acceptance of the application review comments up to 20th, and reported to the provincial departments of agriculture Administration approval. Provincial departments of agriculture administration should be completed from the date of receipt of an audit opinion in the 20th for approval.
Qualify and issue license; does not meet the criteria, and notify the applicant in writing and state the reasons. County departments of agriculture Administration accepted cultivar production business license applications, organized experts to conduct field visits, but should be completed from the date of acceptance of the application in the 20th for approval.
Qualify and issue license; does not meet the criteria, and notify the applicant in writing and state the reasons. 19th strains production license is valid for 3 years.
Effective date need to continue production and operation, the licensee shall, before the expiry of 2 months, the original license holder according to the application procedures to apply for a license.
Operate in spawn production license, the license indicated changes, licensee should change with the original examination and approval authority, and provided supporting materials.
20th strains by level production, the next level of strains of bacteria level only with production, cultivated species shall not be used for propagation of bacteria.
Gain superior strains of license units and individuals may engage in lower strain production business.
21st prohibits operation without a permit or not permit production strain; prohibited to forge, alter, buy or lease the edible fungus production and operation license. 22nd strains in the production unit and individual shall, according to the Ministry of Agriculture of the edible fungus production technology regulation of production and establishment of strain production files, stated the location, time, quantity, media, culture conditions, strain source, operation, technical manager, inspection records, strain the flow and so on.
Production files shall be kept until the strain sold after 2 years. 23rd bacteria strains of operational units and individuals shall establish management archive, containing bacteria source, storage time and conditions, movements, transportation, handling, and so on.
Business Archives shall be kept until the strain after sales for 2 years. 24th sales tag shall be attached and strain of bacteria quality certificate. Tags should be marked bacteria species, variety, grade, date of vaccination, storage conditions, shelf life, spawn production license number, standard and name of producer, production locations.
Labels should be consistent with the sales culture.
Strain the operator shall provide the purchaser with variety kinds of bacteria descriptions, cultivation and related advisory services, and the strain is responsible for the quality.
Strains of the fourth chapter of quality strains of the 25th Ministry of agriculture is responsible for establishing the national quality supervision and inspection plan and inspection scheme, local people's Governments at or above the county level agricultural Administrative Department is responsible for the oversight of quality strains within their respective administrative areas, according to the national planning and local conditions to develop the inspection scheme. Prohibit repeated checks.
26th competent administrative departments of people's Governments above the county level agricultural strains of quality inspection institution commissioned to examine quality strains.

Strain the inspector shall meet the following requirements: (a) with a relevant professional college education or those with mid-level professional titles, (ii) engaged in strain testing technology for more than 3 years, (iii) by the people's Governments above provincial level agricultural Administrative Department of examinations.
28th prohibits the production, management and bad bacteria.
Any of the following circumstances, false fungus: (a) non-strain to imitate strains; (b) levels of bacteria species, varieties, and the label does not match the content.
Any of the following circumstances, and as bad bacteria: (I) quality below the national standard, (ii) indicators of quality than labels; (c) strains of expired or deteriorated.
Fifth chapter 29th engaged in import and export of species import and export management units, except for strain production license, should also be in accordance with the country's foreign trade laws and administrative regulations of the eligibility for import and export trade engaged in bacteria.
30th strains of import and export of units and individuals, should fill out the (a) bacteria form, examination by the provincial departments of agriculture administration, after the approval of the Ministry of agriculture, import and export formalities according to law.
Species import and export approval is valid for 3 months.
31st article import and export species shall comply with the following conditions: (a) strains resources belonging to the national import and export permit; (b) strains of quality to the State standards or industrial standards, (iii) species names, types, quantity, country of origin and other relevant real complete and (iv) other conditions stipulated by laws and regulations.
Strains of 32nd applied for import and export units and individuals shall submit the following documents: (a) the edible fungus production and operation license copies, copies of business licenses and import and export trade certificate, (ii) description of edible mushroom varieties (iii) eligible for article 31st of other supporting documents. Article 33rd overseas imported seed strains, not limited by article 29th of this approach, but it should be a foreign production contract.
Imports can only be used for production of bacteria, the product may not be sold in the country.
Introduced from abroad to experiment with bacteria and propagation are strains of bacterium not as a commodity for sale.
The sixth chapter supplementary articles article 34th acts in violation of these rules, in accordance with the People's Republic of China seed law shall be punished.
Article 35th of bacteria species in these measures refers to the edible properties of abbreviations, including temperature, humidity, pH, light, oxygen, and other environmental requirements, stress resistance and high yield potential, sooner or later, a mushroom, a mushroom boom, cultivation cycle, agronomic traits of quality and cultural habits.
Article 36th collection and administration of import and export of wild edible fungus, shall, in accordance with the provisions of agricultural wild plant protection measures, relevant approval procedures. 37th article of the rules take effect on June 1, 2006.
