Central interim measures for the supervision and administration of production safety

Article Central SOEs in these measures refers to the State-owned assets supervision and Administration Commission of the State Council (hereinafter referred to as the SASAC) under the State Council authorized the responsibilities of investor of State-owned and State-holding enterprises. Article III enterprises under the Central Government shall accept the State production safety supervision and management departments and location (district, municipal) and municipalities () of production safety supervision and management departments as well as the supervision and administration of production safety supervision and management departments.
SASAC investor responsibilities according to the State-owned assets, the Central SOEs the work of production safety shall perform the following duties:
(A) responsible for guiding urged the Central SOEs to carry out national security policies and relevant laws and regulations, standards, etc;
(B) urged the central enterprise mainly responsible for the implementation of responsibility for safety of human and corporate responsibility system for production safety, to discharge the responsibilities of the safety performance of Heads of enterprises;
(C) in accordance with relevant regulations, participate in or organize central safety inspection, supervision, and urge enterprises to implement the security and risk management measures;
(D) participating in special accident investigations, is responsible for the implementation of the relevant provisions of accident liability;
(E) urge enterprises to make overall planning, integrating safety into medium-and long-term development planning, protection of workers ' health and safety, effective implementation of social responsibility. Central enterprises according to SASAC approved business and safety risks are divided into three categories (see annex 1):
Category: industry engaged in the coal and non-coal mining, construction, production and management of storage and transportation of dangerous goods, transport of the enterprise;
Category II: industry engaged in metallurgy, machinery, electronics, electric power, building materials, pharmaceuticals, tourism, communications, textile, warehousing Enterprise;
Category III: apart from the first to second class enterprise businesses.

Chapter II safety work responsibility Fifth central responsibility for safety production of enterprise is the main body, you must implement the national security policy, standards and related laws and regulations, in accordance with the "unified leadership, accountability and hierarchical management classification guidance and full participation" principle, and gradually establish and improve the responsibility system for production safety.
Responsibility system for production safety should cover all of its staff and posts, all production and management processes.
Sixth enterprises under the Central Government shall be established in accordance with the following provisions to heads of enterprises as the core of leadership responsibility system of production safety.
(A) the central enterprise mainly is in charge of the enterprise safety in production responsibility and the safety work responsibility, it should be the full implementation of the People's Republic of China Safety Act provides the following functions:
1. establishing and perfecting the enterprise safety in production responsibility system;
2. set the safety rules and regulations;
3. ensure the effective implementation of the production inputs;
4. supervise and check the safety of the enterprise, eliminating production safety accidents in a timely manner;
5. organizations in the development and implementation of the enterprise's production safety accident emergency plan;
6. to report truthfully and production safety accidents.
(B) the Central Executive in charge of co-ordinating organization in the production process of the safe production system and implementation, improve work safety conditions, important leadership responsibility for enterprise safety production work.
(C) the Central Executive in charge of assisting the principal in charge of safety production implementation of safety regulations, standards, coordinated and integrated management of enterprise production safety work, comprehensive management and leadership responsibility for safety work.
(D) other heads of enterprises under the Central Government should be well within the competence of the Division in accordance with work safety, within the competence of the leadership responsible for work safety.
Seventh Central enterprises must establish a sound safety organizations, including: (A) safety in safety, the leadership of the Commission (hereinafter referred to as the Committee), responsible for the unified leadership of the enterprise safety production work, study major issues of safety. The third kind of enterprises should be clearly relevant functional departments responsible for the supervision and administration of production safety, staffed with full-time safety production supervision and management; safety tasks of enterprises should be set up in the relevant functional departments responsible for supervision and administration of production safety within professional bodies.
Production safety supervision and management departments or functional departments are responsible for supervision and administration of production safety management of enterprises, work safety departments to other departments for comprehensive coordination of work safety management and supervision.
Eighth Central enterprises should make clear the functions of specific safety management responsibility; departments should be specific decomposition safety management responsibilities to the appropriate position.
Nineth central enterprise full-time safety Manager qualification number and equipped shall conform to the relevant provisions of national and industry; clearly defined national and industry, production and operation of enterprises under the Central Government shall, in accordance with the enterprise's content and nature, range, span of management full-time safety Manager. Central SOEs should strengthen the security team-building, improve the quality of personnel, and encourage and support the production safety supervisory and management personnel registered safety engineer qualification.
Safe production supervision and administration bodies shall gradually achieve the certified safety engineers as the main staff.
Tenth enterprise unions according to law for the safety and democratic supervision of labor protection, safeguarding workers ' legitimate rights and interests according to law, is entitled to the security facilities of construction projects and the principal part of the project designed, built and put into operation simultaneously and supervise the collection, use, and comment.
11th central business of its wholly-owned and controlled enterprises (including overseas companies) safety regulatory responsibilities seriously:
(A) wholly-owned and majority-safety conditions of supervision management situation safe production supervision and administration organization; the safe production responsibility system, safety rules and regulations established; safety investment and governance in troubleshooting; workplace emergency management; production faithfully and promptly report security incidents.
First category of enterprises under the Central Government can contribute to it as the focus of safety-owned and controlled firm appointed full-time Director of safety, strengthen child safety monitoring.
(C) wholly-owned and controlled enterprises into the central enterprise management system for production safety, its project construction, acquisitions, mergers, transfers, operation and production implementation of approval system on important matters such as safety, strict safety inspections, appraisal, reward and punishment and responsibility.
Holdings is not responsible for the management of enterprises, management mode of enterprises under the Central Government shall be agreed with the management side, in accordance with the People's Republic of China Law on production safety requirements through management contracts, articles of incorporation, agreement and other safety management responsibilities, clear objectives and requirements.
Shares and assume the responsibility for the management of enterprises, enterprises under the Central Government shall, in accordance with relevant laws and regulations of safety production management agreement signed with participating companies, clear safety management of responsibility.
Central level enterprises shall gradually establish and improve the responsibility system for production safety in accordance with above step by step to enhance work safety supervision and management.
Chapter III fundamental work safety requirements
12th Central enterprises shall make safety production of medium-and long-term development plan, and incorporate them into their overall development strategic planning, synchronization to achieve safety production and enterprise development planning and implementation, in parallel.
13th Central enterprises should establish a sound management system for production safety, develop and apply advanced safety management method and system, standardization, standardized and scientific management to realize safety production and modernization.
Central enterprise safety management system should include the Organization, systems, the responsibility system and risk control system, education system, supervision and guarantee system.
Central SOEs should strengthen safety production management system control, strengthen job training, supervision and summarize feedback and continuous improvement management process to ensure the effective operation of the system.
14th central characteristics of enterprises should be combined with industry and business practice, occupational health and safety management system, eliminate or reduce occupational health and safety risks, protect workers ' occupational health. 15th Central enterprises shall establish and improve safety in emergency management system, including preparedness system, organizational system, operational mechanism, support system, and so on.
Strengthen emergency preparation, assessment, training, joint exercises and the construction of emergency rescue teams, implementation of emergency supplies and equipment, improving production safety accidents and disasters have effects on all kinds of emergency management capability.
16th Central enterprises should strengthen safety production risk identification and assessment, formulation of the monitoring and management of major hazard programmes, ensuring always under control of major hazards. 17th enterprises under the Central Government shall establish and improve production safety accident investigation and management system, standard production safety accident hidden danger at all levels of frequency, control principles, management at different levels, step, manage content, and so on.

18th Central enterprises should strictly comply with new construction, renovation or expansion projects security facilities simultaneously with the principal part of the project design, construction, and production and use of relevant provisions. 19th Central enterprises should be strictly in accordance with the relevant provisions of national and industry, extraction and production costs in full. Countries and industries do not have clearly defined production costs percentage of enterprises under the Central Government should be based on the needs of business practice and sustainable development, production costs of extracting enough.
Production costs should be segregated accounts and the preparation of plans, clear investment project content, quota, deadlines, responsibilities departments and those responsible to ensure the implementation of safety investment and implementation analysis of annual performance appraisal summary report submitted to the Commission.
20th Central enterprises should establish and improve safety education and training system, strict implementation of the corporate directors, safety supervision and administration staff, certified system and training special operations personnel appraisal system; in China strictly implemented safety education and training system. The 21st central enterprise safety evaluation and reward and punishment mechanism should be established.
Strict safety performance, improve production safety incentives, and seriously investigate every accident, be strictly held responsible for the accident of responsibility.
22nd of enterprises under the Central Government shall establish and improve production safety incident news release system and media response mechanism timely, proactive, accurate and objective news media published the circumstances surrounding this accident.
23rd enterprise to develop and implement safety management regulations and standards shall not be lower than national and industry requirements.
The fourth chapter safety reporting system
24th Central SOEs should be on by the end of January of each year an annual safety summary and this year's programme of work submitted to the Commission. 25th central enterprise shall, on a quarterly basis, annual of the enterprise (including wholly-owned and majority-and is responsible for the management of the enterprise) the production of accident statistics analysis and prepare a report (see annex 2, annex 3), in the first month of the quarter before 15th and before the end of January of the year to serve the Committee.

27th enterprises under the Central Government shall be the relevant government departments for large accidents, accident investigation report and approval of major accidents and times the Commission records, and to report on implementation of the accountability Commission.
The 28th central enterprise work safety should be lead agencies and safe production supervision and administration institution's name, composition, duties, work and contacts reported that SASAC filed, and submit changes.
29th central enterprise workplace emergency plans should be reported to the State-owned assets supervision for the record and to submit revisions.
30th central enterprise work safety should be an important event, conferences, major initiatives and achievements, major issues, and other important information and important matters, and promptly report to the Commission.
Fifth chapter safety production supervision and management and rewards and punishments
31st SASAC to participate in Central enterprises, particularly the major production safety accident investigation, and according to the accident investigation report and approval of the State Council is responsible for the implementation or oversight responsibilities for the accident and deal with those responsible. The 32nd central enterprise safety production supervision of State-owned organizations, urged the Central SOEs to implement safety regulations and improved work safety.
Central enterprises that violate the provisions of these measures concerning production safety supervision and administration, Commission depending on the seriousness of its correct or criticized.

33rd SASAC cooperate with relevant departments of the central safety investigation of reported violations, or to instruct the relevant authorities for investigation, in accordance with the management rights of the relevant person to deal with.
34th SASAC under central enterprise production safety accident identified conditions that can occur during the assessment period, the results of official performance evaluation of Central enterprises by following downgrade or to drop (see annex 6):
(A) charge an annual performance evaluation of Central enterprises special during a major accident and will have the primary responsibility or cover-up accidents occurred, the results of the annual performance evaluation of Central enterprises to downgrade.
(B) charge an annual performance evaluation of Central enterprises within larger accidents number reached demotion or negligently, to the results of the annual performance evaluation of Central enterprises to be cycled.
(C) charge an annual performance evaluation of Central enterprises within larger accidents and standards of negligently but not demoted, of the results of the annual performance evaluation of Central enterprises to drop points.
(D) performance evaluation of Central enterprises term period series of cover-up or two or more major accidents, the term of Office of the head of the central enterprise downgrade performance evaluation results.
Negligence in these measures refers to according to accident investigation report and reply to the determination of the nature of the accident, Central or central enterprises owned and controlled enterprises responsible for the accidents in the production safety accidents.

Annex 6: the enterprise production safety responsibility accident drop downgrade rules
Central production safety incidents are included in the official performance evaluation of Central enterprises, primarily on the basis of enterprise scale, production safety supervision classification and number of accidents, nature, level and the responsibility of, the official performance evaluation of Central enterprises results are degraded or reduced.
(A) the Central enterprises, one of the following situations occurs within one year, reduce annual performance evaluation results of Heads of enterprises under the Central Government level:
