Reservoir management and water resources in the area and channel management

The fourth Ministry of water resources is responsible for the reservoir of the three gorges water control and oversight in the area of water resources and river management.
Yangtze River Water Conservancy Committee of water resources in accordance with laws, administrative regulations, and the authority responsible for the reservoir of the three gorges water control and water resources and river management.

The sixth Yangtze River Water Conservancy Commission and relevant competent administrative departments of local people's Governments at or above the county level water of three Gorges reservoir management and protection of water administrative law enforcement in the context of, and in accordance with the administrative rights, supervise and inspect the water activities in the jurisdiction, and to investigate and punish illegal activities on water.
Article seventh Changjiang water resources Commission and the relevant local people's Governments at or above the county level departments shall establish joint law enforcement of water administration system, communications system and inspection system.
Chapter II reservoir

11th Three Gorges project management according to the State flood control and drought relief command or the Yangtze River flood control and drought relief command issued by the three Gorges reservoir flood directive, specifically responsible for the implementation of the three Gorges reservoir flood.
The power generation of three Gorges reservoir and shipping schedules shall be subject to the flood.

17th District of three Gorges reservoir and downstream drought disaster, the State flood control and drought relief command or the Yangtze River flood control and drought relief command authority shall, in accordance with the drought emergency water operation plans, emergent water dispatch.
18th when significant water pollution in the three Gorges reservoir, Changjiang water resources Commission and Chongqing City, Hubei Province water conservancy administrative departments shall, in accordance with the relevant emergency plan, emergency scheduling of necessary measures in a timely manner.
19th Three Gorges project management unit should enhance security in project operation and management conservation, according to dam safety management regulations, safety monitoring and inspection of the project, project maintenance and repair work.
The Ministry of water resources or the Yangtze River Water Conservancy Committee shall strengthen the supervision and administration of safe operation of the three gorges project.
Management of water resources in the third chapter

Discover major water pollution incident or found that changes in water quality could cause major water pollution incident, shall promptly report to the Ministry of water resources and local people's Governments, and to inform the relevant Administrative Department of environmental protection.
Fourth chapter area the river course management
26th in water management within the construction of the three Gorges reservoir project, should be in accordance with the relevant provisions of the planning consent to management of water project construction, to the relevant local people's Governments at or above the county level the water conservancy administrative departments or the Yangtze River Water Conservancy Committee applied for water engineering construction planning consent.
27th Changjiang water resources Commission shall, jointly with the Chongqing, Hubei provincial water conservancy administrative departments, preparation of the three Gorges reservoir shoreline management plan, respectively, upon consultation with the Chongqing, Hubei provincial people's Government approval of the Ministry of water resources.
Three Gorges reservoir shoreline management plan, should be subject to integrated watershed planning and flood control planning and coordination with river and waterway planning.

30th in the three Gorges reservoir management of sand mining activities within, shall, in accordance with the relevant provisions of sand mining management in the Yangtze River, Chongqing, Hubei provincial water conservancy administrative departments or apply for river channel sand mining license of the Yangtze River Water Conservancy Committee, pay a fee for sand resource in the Yangtze River.
31st-fluctuating zone of three Gorges reservoir should be subject to the flood control safety and the safety of the three Gorges reservoir to meet the area of soil and water conservation, protecting water quality and ecological and environmental protection needs.

34th people's Governments above the county level the water conservancy administrative departments and Yangtze River Water Conservancy Commission and its staff, scheduling and reservoir area of three Gorges reservoir water resources and river management in the process, in contravention of this regulation, in accordance with the People's Republic of China water and the People's Republic of China flood control law and the People's Republic of China Law on water pollution prevention and control law and regulations relevant provisions to deal with.
35th TGP management unit in violation of this regulation, has refused to implement instructions or real time water regulation of three Gorges reservoir flood directive, or shall be ordered to correct the Yangtze River Water Conservancy Committee of water resources; the persons in charge and other direct liable persons, by their work units or the competent authority shall be given administrative sanctions constitutes a crime, criminal responsibility shall be investigated according to law.
Article 36th in the three Gorges reservoir area in water resources development and utilization and river activities such as construction of units and individuals in violation of these rules, the people's Governments above the county level the water conservancy administrative departments or the Yangtze River Water Conservancy Committee under the People's Republic of China water and the People's Republic of China flood control law and the People's Republic of China soil and water conservation law and the People's Republic of China Law on water pollution prevention and control law and the relevant provisions of the regulations will be punished.
The sixth chapter supplementary articles
37th in three Gorges reservoir area in these measures refers to check flood level following flood-affected areas of the three Gorges reservoir.

Detection units should be in accordance with the provisions of article III qualification and the qualification license within the scope of quality testing. Measuring unit qualification into geotechnical engineering, concrete engineering, metal structures, machinery and electrical and measurement a total of 5 categories, each category is divided into grade a, b 2 levels.
Testing qualification standards see annex. Achieved qualification level of detection unit can take the water quality testing. Large water project (levels Dyke) major buildings, as well as quality and safety appraisal of water conservancy project quality testing, must be borne by the detection unit with qualification.
Achieved qualification test unit can commitment in addition to large-scale water projects (including a-level embankments) outside the main building other levels of water quality testing.

(E) directors, technical director of original and copy of certificate of title, original and copy of evidence of sufficient testing personnel qualification;
(Vi) management system and quality control measures.
Application for qualification, shall also be submitted in the last three years to assume the quality testing services contract and related supporting materials.
Detection unit can apply for different categories, levels of qualification.
Article seventh approval authority upon receipt of the detection unit application, shall make a decision on whether to accept, and written to the test unit certificate of application materials are incomplete or not in compliance with the statutory form, shall inform the inspection unit within the 5th need correction in its entirety. Approval authority shall, from the date of acceptance of the application made within 20th approve or not to approve the decision.
Decision approving, issuing of the water conservancy project qualification certificate of quality inspection units (hereinafter referred to as the certificate of qualification grade); is not granted, it shall notify the inspection unit and explain the reasons.

14th test unit shall not sub-contract quality testing; without the client's consent shall not be sub-quality testing.
15th detection units should be in accordance with national and industry standard quality testing activities without national and industry standards, proposed by the testing programme, after confirmation by the client implementation.
Tests in violation of law, regulations and mandatory standards, causes losses to others, and shall bear the liability for damages.
16th quality sampling test specimens should be strict implementation of national and industry standards and regulations.
Providing quality testing sample units and individuals, should be responsible for the authenticity of the sample.
17th Inspection Unit in accordance with the contract and the relevant criteria should be timely, accurate quality inspection report to the principal and is responsible for quality inspection report.
No unit or individual may express or imply false quality examination report issued by the testing may not be tampered with or forged quality inspection report.
18th detection units should be safety problems, possible quality problems or affect the normal operation of the testing results and project legal person found during testing (unit), survey design, construction company, supervising unit cases of violation of the laws, regulations and mandatory standards, commissioned the report in a timely manner and water conservancy administrative departments having jurisdiction or basin management agency. 19th Inspection Unit shall establish a records management system.
Inspection contracts, orders, records, quality inspection reports shall be the annual number and numbering should be continuous and should not be removed or altered.
Detection units should be separately establish the test results are not eligible projects account.
20th inspection personnel should be in accordance with laws, regulations, and standards of quality and testing work, and is responsible for the quality inspection results.
21st water Administrative Department of the people's Governments above the county level shall strengthen the detection unit and the quality supervision and inspection activities, check the following:
(A) compliance with the qualification criteria;
(B) whether there are any alter, resell, rent, lend or in any other form of illegal transfer of certificate of qualification;
(C) the existence of a subcontract, illegal subcontracting;
(D) is in accordance with the relevant testing standards and regulations;
(Each other) are signed and sealed in accordance with the provisions on the quality inspection report, quality inspection reports are true;
(F) operation verification and calibration of equipment;
(G) other matters stipulated by laws and regulations.
River basin authorities should strengthen supervision and inspection of water quality testing activities covered.
22nd water administration under the people's Governments above the county level authorities and river basin management agencies when conducting supervision and inspection, and the right to take the following measures:
(A) the testing requirements of the unit or the client provides documents and information;
(B) into the testing unit work places (including construction sites) spot checks;
(C) the organization test to validate the detection capability of detection;
(D) found to be in line with the relevant national laws, regulations and standards testing behavior and order them to correct.

24th article violates these provisions, without the appropriate qualification, without authorization, undertake testing, detection report is invalid, by the Department of water administration under the people's Governments above the county level shall be ordered to correct, and to a fine of up to 10,000 yuan and 30,000 yuan.
25th to hide relevant information or provides false information to apply for qualification, approving authority not to accept or not to approve and give a warning, and may not apply again for a qualification within one year.
26th through deception, bribery or other improper means to obtain the certificate of qualification, be revoked by the approving authority, not apply again in 3 years, and a fine of less than 10,000 yuan and 30,000 yuan constitutes a crime, criminal responsibility shall be investigated according to law.
27th test in violation of this provision, any of the following acts, by the Department of water administration under the people's Governments above the county level shall be ordered to correct, has illegally obtained, confiscation of illegal income, and to a fine of up to 10,000 yuan and 30,000 yuan constitutes a crime, criminal responsibility shall be investigated in accordance with law:
(A) the qualification of grade testing activities;
(B) alter, resell, lease, lend or otherwise transfer the certificate of qualification;
(C) the use does not meet the conditions of inspection personnel;
(D) is not required to report found that illegal behavior and not qualified;
(E) is not in accordance with the regulations on the quality inspection report signed and sealed;
(F) in accordance with national and industry standards for testing;
(VII) reference material management, cause data could not be retroactive;
(H) the detection business of subcontracting, illegal subcontracting.
28th test unit forged data, false quality examination report issued, by the Department of water administration under the people's Governments above the county level shall give him a warning and a fine of 30,000 yuan and cause damage to others shall bear liability constitutes a crime, criminal responsibility shall be investigated according to law.
29th article violates these provisions, principal of any of the following acts, by the Department of water administration under the people's Governments above the county level shall be ordered to correct, and to a fine of up to 10,000 yuan and 30,000 Yuan:
(A) the delegate did not obtain the appropriate qualification test unit for testing;
(B) the express or implied false testing reports issued by the inspection unit, altered or falsified inspection reports;
(C) the inspection of specimen fraud.
Article 30th inspectors engaged in quality control activities, any of the following acts, by the Department of water administration under the people's Governments above the county level shall be ordered to correct, given a warning and fined a maximum of 1000:
(A) does not record, feel free to choose test data;
(B) fraud, falsification of data;
(C) not enforcing the law, regulations and mandatory standards.
31st water administration under the people's Governments above the county level authorities, river basin authorities and their staff, have one of the following acts, by its superior administrative body or supervisory organs shall be ordered to correct serious, managers directly responsible and other persons directly responsible shall be given administrative sanctions constitute a crime, criminal responsibility shall be investigated in accordance with law:
(A) to comply with the statutory conditions of application as inadmissible or not approved within the statutory time limit;
(B) an applicant who does not meet the statutory requirements of issuing the certificate of qualification;
(C) the use of the convenience of duty and accepting other people's property or other benefit;
