Civil airport regulations
Chapter I General provisions
First in order to regulate the construction and management of civil airports, actively and steadily promote the development of civil airports to ensure safe and orderly operation of civil airport, maintaining the lawful rights and interests of the parties concerned, in accordance with the People's Republic of China civil aviation law, this Ordinance is enacted.
Article II of this Ordinance shall apply to People's Republic of China civil airports in the territory of the planning, construction, use, management and related activities.
Civil airports include transport and General airports. Third civil airport is public infrastructure.
People's Governments at various levels shall take the necessary measures to encourage and support development of civil airports, improve the management level of civilian airports. Fourth civil aviation authority under the State Council in accordance with the supervision and administration of national civilian airports industry.
Regional civil aviation authority law implementation supervision and management of civil airports in the area.
Supervise and administer the relevant local people's Government in accordance with the civilian airport.
Fifth national civil airport distribution plan shall be in accordance with national economic and social development and national defense requirements, and the development of integrated transport planning, land use planning, urban and rural planning, linking, strictly control the scale of construction land, economical and intensive land use, protect the ecological environment.
Chapter II civil airport construction and use
Sixth new airports sites shall comply with the conditions of the competent civil aviation authority under the State Council.

13th transport engineering design of the airport shall comply with the relevant national standards, and approved by the Civil Aviation Administration.

(D) meet the requirements of the national civil aviation security requirements;
(E) emergency contingency plan and the appropriate facilities and equipment.
17th transport airports, airport administrative organ shall make application to the competent civil aviation authority under the State Council, and attached in accordance with the conditions specified in section 16th related material. Civil Aviation Authority under the State Council shall, within 45 working days from the date of acceptance of the application review is completed, to approve the permit or not permit decisions.
Permission is granted, issued an airport operating licence for transport; not permitted, it shall notify the applicant in writing and state the reasons.
18th general airport use shall meet the following conditions:
(A) there are compatible with the operations of the flight field;
(B) ensuring flight safety of air traffic services, communications, navigation and surveillance facilities and equipment;
(C) have a sound safety management system, consistent with the national civil aviation safety and security conditions as well as contingency plans for dealing with emergencies;
(D) equipped with the necessary management and professional and technical personnel.
19th General airport use, General airport managers should provide general airport area apply to the civil aviation authority and attached in accordance with the conditions specified in section 18th related material. Regional civil aviation authority shall within 30 working days from the date of acceptance of the application review is completed, to approve the permit or not permit decisions.
Permission is granted, and General airport operating licence issued; no permission, and shall notify the applicant in writing and state the reasons.
20th transport airport as an international airport, port inspection body shall, in accordance with relevant regulations of the State set up, equipped with appropriate personnel, premises and facilities, and acceptance by the departments concerned under the State Council.
International Airport opened for use by the competent civil aviation authority under the State Council announced to international airport information exclusively provided by the competent civil aviation authorities.
Article 21st airport administrative organ shall in accordance with the transport of airport use permits open transport airports, not allowed to close. Transportation airport if you can't protect the safe operation of civil aircraft, you need to temporarily close the airport administrative organ shall promptly notify the air traffic management sector and announced to the public in a timely manner.
Air traffic management departments shall, in accordance with the relevant provisions issued NOTAM.
Airport authorities intend to close airports, should be at least 45 airports use permit from the daily Office, approval to close, and announced to the public.
22nd transport airport named or renamed should conform to the relevant provisions of laws and administrative regulations of the State.
23rd transport airport scrapped or converted to other uses, airport administrative organ shall, in accordance with the relevant provisions of approval procedures, and announced to the public in a timely manner.
Chapter III civil airport safety and operations management
24th civil aviation authorities and relevant local people's Governments shall strengthen leadership of transport airport security operations, urged airport authorities to perform security management responsibilities, coordinate and solve transport problems in the safe operation of the airport.
25th aviation management sector, relevant local people's Government shall, in accordance with national regulations, transport to the airport emergency response plan for emergencies.

Transport does not meet the requirements of safe operation of the airport, airport administrative organ shall be corrected in a timely manner in accordance with the relevant provisions.
28th airport authorities to transport the safe operation of the airport shall exercise unified coordination and administration, is responsible for establishing and perfecting responsibility system for safe operation of the airport, making airports safe operation rules and regulations to ensure effective implementation of airport security operation, supervision and security operations, to eliminate accident risks, reported production safety accident according to law.
Air transport enterprises and others stationed units shall, in accordance with their respective responsibilities and safeguard airport operations and bear the responsibility for the safety of transport; transport airport security operations, shall immediately report to the Airport Authority.
Article 29th airport authorities, air transport enterprises in China as well as other resident units shall, on a regular basis to carry out the necessary safety training, ensuring employees have relevant knowledge and skills.
30th civil airport equipment shall meet the requirements of the national standards and technical specifications, and institutions designated by the competent civil aviation authority under the State Council after passing inspection, may be applicable to the civilian airport.
Civil Aviation administrative departments should strengthen supervision and inspection of civilian airport equipment.
Civil airport equipment directory formulated by the competent civil aviation authority under the State Council and published. 31st transportation airport open use case, not in the flight area and with the flight zone near the airport terminal construction.

32nd emergency transportation airport location relevant local people's Governments, civil aviation administration, air traffic management, airport authorities and other units should be in accordance with the emergency plan demands timely and effective emergency rescue.
Article 33rd regulatory agencies unified coordination and management of the airport transportation airport operation, maintain normal order of transport airports, air transport enterprises and other units in Hong Kong, passengers and shippers to provide fair, impartial, and convenient service.
Airport authorities and airlines and other resident units shall enter into a written agreement, clearly in manufacturing operations, airport management processes as well as flight delays occurred when the rights and obligations.
Article 34th airport administrative organ shall organize air transport enterprises and other resident units in developing service standards and to the public.
Article 35th of the airport management body shall, in accordance with the State standards with Terminal, catering, parking, medical facilities, equipment, and to provide appropriate services.
Article 36th airport administrative organ shall air transport companies, air traffic management and other units to establish mechanisms for information sharing, provide the necessary production and operations information, timely and accurate information to passengers, and cargo.
37th airport authorities, air transport enterprises, as well as other resident units shall take effective measures to strengthen coordination and cooperation, to ensure normal operation of flights. Flight delays, airport authorities should coordinate air transport enterprises and other related in both passenger and cargo service, notification relevant information in a timely manner.
Air transport enterprises and their representatives shall, in accordance with the relevant provisions and service commitment to provide passenger and cargo services.
Article 38th airport within the retail, catering, aviation ground services and other business operations take the form of right to transfer business, airport administrative organ shall, in accordance with civil aviation authorities under the State Council provisions and achieve corporate management signed an agreement, clear service standards and level of charges, safety and liability issues.
To transfer the right to operate business, airport authorities and its affiliates shall not participate in the operation.
39th airport administrative organ shall be submitted to the civil aviation management, transport planning, construction and operation of the relevant information, and accept the supervision and inspection of the Civil Aviation Administration. 40th Civil Aviation Department and the Airport Authority shall establish a complaint handling system, complaints and complaints released.
For the complaints of passengers and cargo, civil aviation administration or airport authorities should be made within 10 working days from the date of the acceptance in writing.
41st civil airport within the aviation fuel supply business enterprise shall satisfy the following conditions:
(A) obtaining refined oil business permits and operating license for hazardous chemicals;

Section 42nd civil airport within the aviation fuel supply business enterprise shall submit application for civil aviation administrative bodies in civilian airport is located and attached in accordance with the conditions specified in section 41st related material. Regional civil aviation authority shall within 30 working days from the date of acceptance of the application, to approve the permit or not permit decisions.
Permission is granted, issuing permits for civil aviation fuel supply security operations at the airport; no permission, and shall notify the applicant in writing and state the reasons.
Article 43rd aviation fuel supply of aviation fuel supply shall comply with the airworthiness standards for Jet fuel.
44th civil airport aviation fuel supply facilities should be fair use to provide aviation fuel supply company.
45th transport Airport Aviation fuel supply company ceases to transport aviation fuel supply business, shall inform the transport airport is located 90 days in advance of regional civil aviation authorities, airport authorities and related air transport enterprises.
Chapter fourth civil airport safety environmental protection
46th civil airport located regional civil aviation authorities and the local people's Governments shall, in accordance with relevant regulations of the State civil airport obstacle clearance protection zone, and announced to the public.
47th local people's Governments at or above the county level shall approve construction project of civil airport clearance protection zone, it shall seek the views of civil airport located regional civil aviation authority.
48th at the civilian airport obstacle clearance protection zone set up over 220,000-volt (220,000 v) of high voltage transmission towers shall be in accordance with the relevant provisions of the civil aviation authority under the State Council sets the obstacle lights or signs, maintain its normal state, and the civil airport area, where civil aviation authority, air traffic management and airport authorities to provide the relevant information.
49th prohibited in the civil airport obstacle clearance protection zone to engage in the following activities:
(A) emit a lot of smoke, dust, flame, exhaust gas and other substances that affect flight safety;
(B) construction of a shooting range, a strong explosives warehouse and flight safety of buildings or other facilities;
(C) set the impact of civil airport Visual Navaid or pilot line of sight of the lights, signs or objects;
(D) the plant affect flight safety or affecting civilian airfield facilities used by plants;
(E) affect flight safety birds flying up unmanned free balloon, tethered balloon launch and other objects;
(F) the burning of crop stalks, produces a lot of smoke waste and other substances, or setting off fireworks, Fireworks;
(G) the enclosures at the civilian airport outside the 5 meter range, build buildings, planting trees, digging, stacked objects, or activities that affect the operating of civil airport security;
(H) the civil aviation authority under the State Council under other acts that affect the civilian airport obstacle clearance protection.
50th at the civilian airport clearance protected areas outside the 49th of the Ordinance of activities listed in section, shall not affect the civil airport obstacle clearance protection.
51st is prohibited from the zone within 30 kilometers of the route on both sides of the border building on an empty firing range and other facilities that could affect flight safety. 52nd Civil Aviation Administration and airport authorities shall strengthen the civilian airport clearance status verification. The situation of civil airport obstacle clearance protection found, should be stopped immediately, local people's Governments at or above the county level and written reports civilian airport is located.
Received a report of the local people's Governments at or above the county level shall take timely and effective measures to eliminate the impact on flight safety.
53rd civil airport located local radio management bodies shall, in conjunction with regional civil aviation administrative bodies in accordance with the national radio management regulations and standard-setting civil airport electromagnetic environment protection area, and to the public.
Civil airport electromagnetic environment protection that includes the settings in master plan of civil airport of civil aviation in the region radio (stations) electromagnetic environment protection area and the civil airport flight zone electromagnetic environment protection area.
54th settings, use the ground civil aviation radio (stations), should be approved by the Civil Aviation Department for review, in accordance with the relevant provisions of the State radio regulatory approval procedures, obtaining a radio licence.
55th at the civilian airport electromagnetic environment protection in the region setting, the use of civil aviation radio (stations), radio management institution shall, in consultation with the civilian airport is located after the civil aviation authority, in accordance with the relevant provisions of the State radio regulatory approval.
56th is prohibited in the civil aviation radio (stations) electromagnetic environment protection area, engaged in the following activities of the airport electromagnetic environment:
(A) the construction of overhead high-voltage power lines, overhead wires, railway, highway, power, irrigation and drainage pumping stations;
(B) storage of metal deposit;
(C) planting tall plants;
(D) engaged in earthmoving, sand mining, quarrying and other activities of the changing topography;
(E) the competent civil aviation authority under the State Council under other acts that affect the civilian airport electromagnetic environment.
57th no units or individuals to use the radio (station) and other electronic devices, not to interfere with the normal use of civil aviation special radio frequencies. Article 58th when the civil aviation dedicated radio frequency interference, the Airport Authority and the Civil Aviation Administration shall immediately take the investigation measures, to eliminate; cannot be eliminated, local radio management agencies should inform the civilian airport is located.
To inform the radio control bodies should take steps to investigate and punish.
59th at the civilian airport of the civil aircraft shall comply with the relevant national aircraft noise and engine emissions of the airworthiness standards.
60th airport administrative organ shall, together with the airlines, air traffic management and other relevant entities, technical measures and management measures to control the effects of aircraft noise on adjacent area of airport transportation.
61st civil airport located relevant local people's Governments in developing civil airports in the surrounding areas of land use planning and urban and rural planning should take fully into account influence of aircraft noise on civilian areas around the airport, according to relevant national environmental quality standards.
Airport authorities should be civil aircraft noise impact on the adjacent area of airport transportation, reporting on local government, planning and construction, environmental protection, land and resources department. 62nd civil airport located the relevant local people's Government shall designate restricted building in the surrounding area at the civilian airport regional control and noise-sensitive structures.
Really necessary to build noise-sensitive structures in the region, the construction unit shall take measures to reduce or avoid noise impact of civil aviation when it is running on its.
Civil airport located the relevant local people's Governments shall, in conjunction with regional Civil Aviation Administration coordinate civil airports by aircraft noise impact related issues.
The fifth chapter legal liability
63rd in violation of the provisions of this Ordinance, any of the following circumstances, by the Civil Aviation Administration ordered corrective action and fines of between 100,000 yuan and 500,000 Yuan:
(A) does not meet the transport within the transport field Airport Master planning of construction activities;
(B) unauthorized implementation of an approved transportation airport professional engineering design, or without the acceptance of professional engineering put into use at the airport for transport;
(C) in the case of airports open, unauthorized flight area and with the flight zone near the airport terminal construction.
64th in violation of the provisions of this Ordinance, airport authorities are not in accordance with the transport of airport use permit to transport to the airport, transport airport Civil Aviation Agency ordered corrective action and fines of between 200,000 yuan and 1 million Yuan.
65th in violation of the provisions of this Ordinance, airport authorities without prior approval of closed airports, transport airport Civil Aviation Agency ordered corrective action and fines of between 100,000 yuan and 500,000 yuan.
66th in violation of the provisions of this Ordinance, airport authorities cannot guarantee flight safety of civil aircraft, closed airports, failing to notify the air traffic management sector and to society announcements, or approved after you close the airports was not announced to the public in a timely manner, transport airport Civil Aviation Agency ordered corrective action and fines of less than 20,000 yuan and 100,000 yuan.
67th in violation of the provisions of this Ordinance, airport management authority is not in accordance with the emergency plan calls for emergency rescue or emergency rescue equipment and devices that are not equipped with the necessary, managed by the regional Civil Aviation Agency ordered corrective action and the fines of between 50,000 yuan and 10,000 yuan.
68th in violation of the provisions of this Ordinance, transport to the airport put into use does not meet safety requirements, airport authorities refused to correct or corrected do not meet safety requirements, restrictions on the use of the decision by the Civil Aviation Administration in serious cases, suspension of transportation airport operating licence.
69th airport management authority is not in accordance with the provisions of this Ordinance in discharging their management responsibilities, resulting in airport ground transport accidents, civil aircraft flight accidents or serious incidents, civil aviation administrative departments shall be ordered to correct, fined not more than between 1 million Yuan and 200,000 yuan.
70th in violation of the provisions of this Ordinance, airport authorities in the transport field in use do not meet the standards prescribed by the State civil airport equipment and related technical specifications, by the transport seat regional civil aviation authority ordered to stop using the airport, less than 100,000 yuan and 500,000 yuan in fines.
71st in violation of the provisions of this Ordinance, emergency, airport authorities, air traffic management and other units is not in accordance with the emergency plan demands timely and effective emergency aid, managed by the regional Civil Aviation Agency ordered corrective action and fines of between 100,000 yuan and 500,000 yuan.
72nd in violation of the provisions of this Ordinance, without obtaining permits for civil aviation fuel supply security operations at the airport, aviation fuel supply business in civil airport, managed by the civilian airport of regional Civil Aviation Agency ordered corrective action and fined not more than between 1 million Yuan and 200,000 Yuan; has illegally obtained, confiscation of illicit proceeds.
73rd in violation of the provisions of this Ordinance, aviation fuel supply companies supply aviation fuel does not comply with airworthiness standards for aviation fuel, managed by the civilian airport of regional Civil Aviation Agency ordered corrective action and fined not more than between 1 million Yuan and 200,000 yuan in serious cases, revocation of permits for civil aviation fuel supply security operations at the airport.
74th in violation of the provisions of this Ordinance, transport aviation fuel supply company ceases to transport aviation fuel supply business, not 90 days in advance informed civil aviation authorities, airport authorities and related air transport enterprises which transport airport regional civil aviation administration fined not more than 50,000 yuan and more than 250,000 yuan.
75th in violation of the provisions of this Ordinance, any of the following circumstances, managed by the regional Civil Aviation Agency ordered corrective action and fines of less than 20,000 yuan and 100,000 Yuan:
(A) the airport management bodies in accordance with the State standards with Terminal, catering, parking, medical facilities, equipment, and to provide appropriate services;
(B) when flight delays, airport authorities, airlines and others stationed units are not in accordance with the relevant provisions and services corresponding to the commitment to provide passenger and cargo services.
76th in violation of the provisions of this Ordinance, airport authorities and their associated transfer businesses to participate in business the right way to operate a business, managed by the regional Civil Aviation Agency ordered corrective action and fines of between 100,000 yuan and 500,000 Yuan; has illegally obtained, confiscation of illicit proceeds.
77th in violation of the provisions of this Ordinance, airport authorities are not submitted to the civil aviation management, transport planning, construction and operation of relevant information, by the Civil Aviation Administration shall order rectification refuses, the fines of between 50,000 yuan and 10,000 yuan.
78th in violation of the provisions of this Ordinance, set inside the airport obstacle clearance protection zone more than 220,000-volt (220,000 v) of high voltage transmission towers, not in accordance with the relevant provisions of the civil aviation authority under the State Council sets the obstacle lights or signs, the civil airport area, where civil aviation authority ordered corrective action and fines of between 100,000 yuan and 500,000 yuan.
79th in violation of the provisions of this Ordinance, any of the following circumstances, local people's Governments above the county level shall be ordered to correct by the civilian airport in serious cases, fines of less than 20,000 yuan and 100,000 Yuan:
(A) emit a lot of smoke, dust, flame, exhaust gas and other substances that affect flight safety;
(B) construction of a shooting range, a strong explosives warehouse and flight safety of buildings or other facilities;
(C) set the impact of civil airport Visual Navaid or pilot line of sight of the lights, signs or objects;
(D) the plant affect flight safety or affecting civilian airfield facilities used by plants;
(E) affect flight safety flying birds, up unmanned free balloon, tethered balloon launch and other objects;
(F) the burning of crop stalks, produces a lot of smoke waste and other substances, or setting off fireworks, Fireworks;
(G) the enclosures at the civilian airport outside the 5 meter range, build buildings, planting trees, digging, stacked objects, or activities that affect the operating of civil airport security;
(H) the civil aviation authority under the State Council under other acts that affect the civilian airport obstacle clearance protection.
80th in violation of the provisions of this regulation, using the radio (station) or other electronic devices, to interfere with the normal use of civil aviation special radio frequencies, radio management agency ordered corrective action by the civilian airport is located in serious cases, fines of less than 20,000 yuan and 100,000 yuan.
81st in violation of the provisions of this Ordinance, in the civil aviation radio (stations) electromagnetic environment protection undertake the following activities in the region, local people's Governments above the county level shall be ordered to correct by the civilian airport in serious cases, fines of less than 20,000 yuan and 100,000 Yuan:
(A) the construction of overhead high-voltage power lines, overhead wires, railway, highway, power, irrigation and drainage pumping stations;
(B) storage of metal deposit;
(C) engaged in earthmoving, sand mining, quarrying and other activities of the changing topography;
(D) the civil aviation authority under the State Council under other acts that affect the civilian airport electromagnetic environment protection.
82nd article violates the provisions of this Ordinance, the civil aircraft at civilian airports do not meet the relevant State aircraft noise and engine emissions of the airworthiness standards, by the Civil Aviation Administration ordered airlines to correct, may be fined not more than 100,000 yuan; it refuses, fines of between 100,000 yuan and 500,000 yuan.
83rd country in violation of the provisions of this Ordinance, any of the following circumstances, it shall be given sanctions by the relevant authorities:
(A) not in accordance with the provisions of the implementation of administrative licensing;
(B) does not perform its duty of supervision and inspection;
(C) do not impose compulsory administrative measures or administrative penalty according to law;
(D) other acts of abuse their powers, neglect their duties.
The sixth chapter supplementary articles
84th airports referred to in these regulations refers to passenger and goods transportation offer civil aircraft in public air transport activities, such as taking off, landing and other airport services.
General airport mentioned in these regulations refers to industrial, agricultural, forestry, fisheries and construction job flight, as well as health care, emergency rescue and disaster relief, meteorological observation, ocean surveillance, science experiments, education and training, culture, sports and other flight of civil aircraft with takeoff and landing at the airport.
85th flight zone indicator referred to in these regulations is 4D airport means of transport available to the base flying field length is greater than 1800 m, wingspan of 36 meters to 52 metres, between the main undercarriage lateral outer edge 9 m to 14 m spacing between the aircraft taking off and landing airport.
Referred to in this Ordinance index of 4E flight area airports are available for benchmark flying field length is greater than 1800 m, wingspan of 52 metres to 65 metres, between the main undercarriage lateral outer edge 9 m to 14 m spacing between the aircraft taking off and landing airport.
86th combined civil-military management of the civilian part of the airport in addition to complying with the relevant provisions of this Ordinance, and shall comply with the relevant provisions of the State Council and the Central Military Commission. 87th article of the regulations come into force on July 1, 2009.
