The highway safety regulations on the protection of the State Council on February 16, 2011 at the 144th Executive Council, are hereby promulgated and take effect on July 1, 2011.

Highway safety regulations for the protection of
Chapter I General provisions article in order to strengthen the protection and guarantee condition, safe and smooth, according to the People's Republic of China Highway Act, this Bill is enacted.

58th article 20th in violation of this Ordinance, by the water conservancy administrative departments, or catchment management agency ordered corrective action and may be fined not more than RMB 30,000 yuan.
59th in violation of the provisions of section 22nd, managed by the Highways Agency ordered corrective action and fines of less than 20,000 yuan and 100,000 yuan.
60th in violation of the provisions of this Ordinance, any of the following acts, managed by the Highways Agency ordered corrective action and may be fined not more than RMB 30,000 Yuan:
(A) to damage or move or alter, block Highway affiliated facilities or use the ancillary facilities of roads set up piping, hanging objects, which may endanger road safety;
(B) road-related facilities affected condition, safe and smooth.
61st in violation of the provisions of this Ordinance, unauthorised update logging and protection forest, managed by the Highways Agency ordered to replant, confiscate the illegal income and cut trees, fined not more than 3 times more than 5 times the value.
62nd in violation of the provisions of this Ordinance, the 27th article of the Ordinance to the unauthorized road construction-related activities under the fifth, managed by the Highways Agency ordered corrective action and may be fined not more than RMB 30,000 yuan without permission for the 27th article of the rules prescribed by the sixth road-related construction activities, managed by the Highways Agency ordered corrective action and fines of between 50,000 yuan.
63rd in violation of the provisions of this Ordinance, illegal production and sale of size and axle load, total mass does not comply with the relevant national vehicles offset dimensions, axle load, the quality limits of motor vehicle safety standards vehicles, in accordance with the People's Republic of China relevant provisions of the road traffic safety law.
National vehicle production enterprise fails to comply with the requirements of the qualification model and technical parameters of modified vehicles, by the original Licensing Office ordered corrective action, fines of between 40,000 yuan and 200,000 yuan; it refuses to, revoke certificates.
64th in violation of the provisions of this Ordinance, vehicles travelling on the highway, truck overall outline dimensions, axle load or mass over highways, roads and bridges, roads and tunnels, car ferries limited standard, managed by the Highways Agency ordered corrective action and may be fined not more than RMB 30,000 yuan.

67th in violation of the provisions of this Ordinance, any of the following acts, managed by the Highways Agency to force away from the, or impound vehicles, fined not more than RMB 30,000 Yuan:
(A) intentionally blocked fixed unlimited testing site traffic lanes, rammed through fixed unlimited testing sites, such as disturbing the order of overrun detection;
(B) take a short bogey to avoid overload detection.
68th in violation of the provisions of this Ordinance, instigating, forcing the driver of the vehicle exceeding limits for transportation of goods, by road transport management agency ordered corrective action and fined not more than RMB 30,000 yuan.
69th vehicle touch-drag, drop, impurity, or drift, causing road damage, pollution, and managed by the Highways Agency ordered corrective action and fined not more than 5000 Yuan.
70th in violation of the provisions of this Ordinance, highway maintenance operations not transportation departments under the State Council regulations on technical specifications and code of practice for highway maintenance work, managed by the Highways Agency ordered corrective action and the fines of between 50,000 yuan and 10,000 yuan; it refuses to, revoke certificates.
71st caused roads, ancillary facilities of roads damaged units and individuals shall immediately report the authority, under the on-site investigation and handling of the highway management; endangering traffic safety, should also set up warning signs or take other security measures, and promptly report to public security organs traffic management departments.
Accident damage to roads, ancillary facilities of roads, traffic management departments of public security organs in handling traffic accident shall promptly notify the relevant highway authority investigation.
72nd caused roads, ancillary facilities of roads damaged, refuses to accept the investigation and handling of road management agencies, road authorities can impound vehicles and tools. Highway authorities seizing vehicles, tools, should be issued certificates on the spot and inform the parties within the time stipulated in road management agencies.

Road management institutions for detention of vehicles, tools should be kept properly, may be used.
73rd in violation of the provisions of this Ordinance, and Highway Administration staff of any of the following acts, shall be subject to punishment:
(A) an administrative license;
(B) the breach block, checking vehicles on normal;
(C) fails to take measures to deal with the road collapsed, pits, uplift, such as damaged;
(D) illegally detaining vehicles, tools or by using the law to detain vehicles, tools;
(E) other acts of negligence, malpractice, abuse.
Highway administrative departments of any of the acts listed in the preceding paragraph, the person directly in charge and other direct liable persons shall be given administrative sanctions.
74th in violation of the provisions of this Ordinance, of activities contravening public security management by the public security organs shall be subject to administrative penalties for public security constitutes a crime, criminal responsibility shall be investigated according to law.
The sixth chapter supplementary articles
75th road management and maintenance work by the township-level people's Governments in the light of the provisions of that Ordinance.
Special protection are not governed by this regulation.
76th military transport use roads in accordance with the State Council and the Central Military Commission of relevant provisions. 77th these regulations come into force on July 1, 2011. October 13, 1987 issued by the State Council of the People's Republic of China highway regulations repealed simultaneously.
