amending the law on tourism (official SG. 56 of 2002; amended, issue 119 and 120 of 2002, no. 39 of 2004, no. 28, 39, 94, 99 and 105 by 2005, issue 30, 34, 80, 82 and 105 of 2006, issue 42, 53 and 80 by 2007, issue 31, 36 and 66 from 2008 and no. 19 of 2009)

§ 1. Article 5 shall be replaced by the following: "art. 5. the Minister of economy, energy and Tourism conducts public policy in tourism such as:

1. develops short-term programmes and concepts for tourism development and offers the Council of Ministers to adopt a strategy for the development of tourism;

2. organize and coordinate control of quality of tourism product; Register for a tour operator or travel agency activity and categorisation of tourist objects in cases envisaged by the law;

3. develop and monitor the implementation of the annual programme of spending for State financial support for the development of tourism, including the annual national program for tourist advertising;

4. held in conjunction with the competent departments State policy with regard to the training and upgrading the qualifications of staff in tourism;

5. assist in attracting investments and implementing projects for tourism development at national, regional and local level; assist in the establishment and maintenance of the infrastructure associated with tourism;

6. interacts with the bodies of local self-government and local administration and with regional governors in the exercise of their powers in the field of tourism;

7. to represent the Republic of Bulgaria in front of the international bodies and organizations in the field of tourism and perform and coordinate the implementation of the obligations of the Republic of Bulgaria arising from its membership in the international bodies and organizations;

8. participate in the development, evaluation and control of the implementation of the programmes and projects financed by the European Union and international organisations;

9. carry out methodical guidance of the activities of regional and local tourist information centres;

10. interacting with relevant government departments and organize cooperative activities on the development and validation of individual types of tourism;

11. arrange for the establishment and maintenance of a single system for tourist information, including National Tourism register;

12. to manage the National Council for tourism;

13. issue regulations for the activity of the Expert Committee on registration of tour operators and travel agents and of the Expert Committee on the categorisation of tourist sites and organize and manage their activities in their capacity as their President;

14. by commercial services-Economic Affairs to the diplomatic and consular representations of the Republic of Bulgaria promotes tourism abroad and coordinates the activities of the Bulgarian cultural institutes and companies abroad for the promotion of Bulgarian history and cultural heritage;

15. provides information services and supports the participation of Bulgarian companies in fairs and events related to tourism;

16. develop and participate in the discussion of the draft regulations in the field of tourism. "

§ 2. Article 5 (a) is repealed.

§ 3. In art. 9A is hereby amended as follows:

1. In paragraph 8. 1 the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism.

2. in the Al. 2 the words "the President of the State Tourism Agency" are replaced with "Minister of economy, energy and tourism.

3. in the Al. 3 and 4, the words "the State Tourism Agency" shall be replaced by the "Ministry of economy, energy and tourism.

4. Paragraph 5 shall be amended as follows:

"(5) in the composition of EKKTO when categorization of tourist objects of art. 3, al. 3, item 5 and 6 are included with the tie, the representatives of the Ministry of economy, energy and tourism, on the one hand, and representatives of the national tourist associations and other non-profit organizations involved in the development of the tourist sites, on the other hand. "

5. in the Al. 6, the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism", and the words "Office and" are deleted.

6. in the Al. 7, the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism.

§ 4. In art. 18 the following modifications are made:

1. In paragraph 8. 1:

a) in paragraph 1 the words "current certificate for entry in the commercial register of the applicant – original or" shall be deleted;

b) point 2 is amended as follows:

"2. a statement that the person is not in bankruptcy or in liquidation";

2. in the Al. 2 the words "Tourism Agency" shall be replaced by the "Ministry of economy, energy and tourism.

3. in the Al. 3 the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism.


4. in the Al. 5, the words "the President of the State Tourism Agency" are replaced with "Minister of economy, energy and tourism", and the words "Tourism Agency" shall be replaced by "Department".

§ 5. In art. 50, para. 3 is hereby amended as follows:

1. In paragraph 1, the words "recent certificate for entry in the commercial register of the person – the original or" shall be deleted.

2. point 2 shall be replaced by the following:

"2. a statement that the person is not in bankruptcy or in liquidation";

§ 9. In art. 51 the following modifications are made:

1. Paragraph 5 shall be amended as follows:

"(5) categorizing beaches is regulated by an Ordinance adopted by the Council of Ministers, on a proposal from the Minister of economy, energy and tourism."

2. Paragraph 7 shall be amended as follows:

"(7) Categorisation on the ski slopes is regulated by an Ordinance adopted by the Council of Ministers, on a proposal from the Minister of economy, energy and tourism."

3. in the Al. 9, the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism.

Additional provision

§ 10. In other texts of the law, the words "the Chairman of the State Agency for tourism", "the Chairman of the State Agency for tourism and the State Agency for tourism" are replaced with "Minister of economy, energy and tourism", "Minister of economy, energy and tourism and Ministry of economy, energy and tourism.

Transitional and final provisions

§ 11. (1) the State Agency for tourism is adjourned.

(2) the Ministry of economy, energy and tourism is the successor of the State Agency for tourism.

(3) assets, liabilities, the archive, as well as the other rights and obligations of the State Agency for tourism shall be borne by the Ministry of economy, energy and tourism.

(4) the labour and service of the staff of the State Tourism Agency pass to the Ministry of economy, energy and tourism in accordance with art. 123 of the labour code and article. 87 (a) of the law on civil servants.

(5) the Minister of finance to make the Al. 2 changes in the relevant budgets.

(6) the Council of Ministers shall, within one month from the entry into force of this law shall govern the relations linked to the closure of the Al. 1.

§ 12. Regulations issued or adopted on the basis of the law on tourism by or jointly with the President of the State Tourism Agency or by the Council of Ministers, on a proposal from the President of the State Tourism Agency, retain your action.

§ 13. (1) the registration of tour operators and travel agents and designated categories of tourist sites, carried out under art. 52, para. 2 the Chairman of the State Agency for tourism, is preserved.

(2) where at the date of entry into force of this Act has started registration procedure, respectively, for issuing of certificate for registration of tour operator or travel agency activity by the President of the State Tourism Agency, completes the procedure by the Minister of economy, energy and tourism.

(3) where at the date of entry into force of this law has an open procedure for categorisation of tourist objects of art. 52, para. 2 of the President of the State Tourism Agency, completes the procedure by the Minister of economy, energy and tourism.

§ 14. In the Act of gambling (official SG. 51 of 1999; amend., no. 103 of 1999, 53/2000, issue 1, 102 and 110 since 2001, 75/2002, no. 31 of 2003, no. 70 by 2004, issue 79, 94, 95, 103 and 105 of 2005, no. 30 and 54 since 2006. , PC. 109 and 110 from 2007 and PC. 42 and 74 of 2009.) the following modifications are made:

1. In art. 41, para. 2 the words "Ministry of Economic Affairs" shall be replaced by the "Ministry of economy, energy and tourism.

2. In art. 51, para. 3 the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism.

3. In art. 59, para. 7, the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism.

§ 15. In the law on the Organization of the Black Sea coast (promulgated, SG. 48 of 2007; amend., SG. 36 and 67 of 2008 and no. 19 of 2009) in art. 21, para. 1, item 1, the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism.

§ 16. In the Health Act (promulgated, SG. 70 by 2004; amend., SG. 46, 76, 85, 88, 94 and 103 by 2005, issue 18, 30, 34, 59, 71, 75, 80, 81, 95 and 102 in 2006, issue 31, 41, 46, 53, 59, 82 and 95 (2007), no. 13, 102 and 110 since 2008 and 36 PCs. 41, and 74 of 2009.) the following modifications are made:

1. In art. 49, para. 2 the words "the Minister of economy and energy" are replaced with "Minister of economy, energy and tourism.


2. In art. 77 in the text before point 1, the words "the Chairman of the State Agency for tourism" are replaced with "Minister of economy, energy and tourism.

§ 17. In the law of internal audit in the public sector (official SG. 27 of 2006; amend., SG. 64 and 102 in 2006, issue 43, 69, 71 and 110 from 2008 and 42 and 44 of 2009) in the annex to article 2. 12, al. 1.5 p. 13 "State Agency for tourism" is repealed.

§ 18. In the law on administrative regulation of the production and trade of optical discs, matrices and other media containing objects of copyright and related rights (official SG. 74 2005; amend., SG. 105 by 2005, issue 30, 34 and 80 of 2006 and no. 53 and 84 in 2007) all over the words "the Minister of economy and energy" "the Minister of economy and energy" and "the Ministry of economy and energy" are replaced with "Minister of economy, energy and tourism", "Minister of economy, energy and tourism and Ministry of economy, energy and tourism.

§ 19. In the law on accreditation carried out by the Bulgarian accreditation service (promulgated, SG. 100 of 2005; amend., 105/2005 30/2006 and no. 42 since 2009) is hereby amended as follows:

2. In art. 10:

1. In art. 6, al. 1, second sentence, the words "the Minister of economy and energy" are replaced with "Minister of economy, energy and tourism.

The Food Act (promulgated, SG. 90 of 1999; amend., SG. 102 by 2003, no. 70 by 2004, no. 87, 99 and 105 by 2005, issue 30, 31, 34, 51, 55, 80 and 96 06, issue 31, 51 and 53 of 2007 No. 36 and 69 by 2008 and no. 23, 41 and 74 of 2009) make the following changes : 1. § 52. In the law on genetically modified organisms (official SG. 27 of 2005; amend., SG. 88 and 99 of 2005, no. 30 of 2006, no. 31 of 2007, issue 36, 43 and 54 of 2008 and no. 74 of 2009) is hereby amended as follows:

1. In art. 7, para. 5, paragraph 1, point (d), the words "Ministry of Economic Affairs" shall be replaced by the "Ministry of economy, energy and tourism.

2. In art. 111 the words "Ministry of Economic Affairs" shall be replaced by the "Ministry of economy, energy and tourism.

§ 53. In the export insurance (official SG. 61 of 1998; amend., SG. 112 of 2001 No. 92 since 2004, 103/2005, no. 41 of 2007 and no. 36 of 2008) is hereby amended as follows:

§ 58. In the law on waste management (promulgated, SG. 86 from 2003; amend., SG. 70 by 2004, no. 77, 87, 88, 95 and 105 by 2005, issue 30, 34, 63 and 80, 2006 no. 53 of 2007 and no. 36, 70 and 105 of 2008) all over the words "Minister of economy", "economy Minister" and "Ministry of economy" are replaced with "Minister of economy , energy and tourism "," Minister of economy, energy and tourism and Ministry of economy, energy and tourism.

§ 59. The law shall enter into force on the day of its publication in the Official Gazette.
