LAW

amending and supplementing the law on Bulgarian Academy of Sciences (official SG. 85 of 1991; amend., SG. 90 of 1993, no. 123 of 1997, 41/2007 and no. 101 of 2010.)

§ 1. In art. 2 make the following amendments and additions:

1. Paragraph 1 shall be amended as follows:

"(1) the Bulgarian Academy of Sciences took part in the development of science in accordance with universal values, national interests and objectives set out in the national research strategy, adopted by the National Assembly. With its activities the Bulgarian Academy of Sciences contribute to multiplying the spiritual and material riches of the Bulgarian people. "

2. in the Al. 2, item 1 "after the word" fundamental "is added and applied research".

§ 2. In art. 3 make the following amendments and additions:

1. Paragraph 2 shall be replaced by the following:

"(2) the Chairman of the Bulgarian Academy of Sciences presented in the National Assembly by 30 April of the following year an annual report on the activities of the BULGARIAN ACADEMY of SCIENCES, academic institutions and other private bodies, which contains a statement of:

1. research, including for the implementation of the objectives and tasks set out in the national strategy for scientific research;

2. financial activity;

3. international activity. "

2. Al are created. 3 and 4:

"(3) the decision of the Assembly concerning the adoption of the annual report on the activities of the Bulgarian Academy of Sciences shall be promulgated in the State Gazette.

(4) within 10 days from the publication of the decision referred to in paragraph 1. 3 annual report of the activities of the Bulgarian Academy of Sciences, including for each academic Institute and any other self link, is published on the website of the BAN. "

§ 3. Create art. 5A, 5B and 5 c: "art. 5a. (1) the Board of Trustees shall be the BAN with a four-year term.

(2) the Board of Trustees of the ACADEMY of SCIENCES include:

1. two representatives of ministries, laid down by decision of the Council of Ministers;

2. a representative of the National Association of municipalities in Republic of Bulgaria;

3. two representatives of the national representative employers ' organisations;

4. a representative of the Council of Rectors of higher education institutions;

5. two representatives of non-profit legal entities in science or the arts;

6. the person, occupy the Office of President of the BAN in the previous term, and in an objective impossibility – representative of the Assembly of academicians and Member-correspondents;

7. two scientists-members of the General Assembly of the ACADEMY of SCIENCES defined by him;

8. two foreign scientists, appointed by the general meeting of the ACADEMY of SCIENCES on a proposal from the European Science Foundation and the European Federation of national academies of Sciences.

(3) the representatives referred to in paragraph 1. 2 of the representative organizations of the employers shall be elected and removed by the producer organisations recognised under the conditions laid down in the labour code.

(4) in the composition of the Board of Trustees of the BAN without the right to vote include:

1. the Chairman of the standing parliamentary Committee responsible for science;

2. a representative of the Bulgarian Academy of Sciences.

(5) the Chairman of the Bulgarian Academy of Sciences is the Chairman of the Board of Trustees without the right to vote. The members of the Board of Trustees of the ACADEMY of SCIENCES elected Vice-President of Council from among the members in the Al. 2, item 3 – 8.

(6) the members of the Board of Trustees of the ACADEMY of SCIENCES, with the exception of the President of the ACADEMY of SCIENCES and members under para. 2, item 5, 6, 7 and 8 may not be persons who have an employment or other relationship with the BAN, with academic institutes or other self-contained units as well as persons who have a particular interest that may influence the impartial and objective performance of their activity as members of the Board of Trustees.

(7) for the purposes of this Act is the private interest every interest that leads to profit from material or immaterial nature for the Member of the Board of Trustees, including any commitment related to its activity.

Art. 5b. (1) the Board of Trustees of the BAN:

1. support the development of the Bulgarian Academy of Sciences and the effective management of funds and property;

2. agreed on the General Assembly draft a strategic plan for the development and the research priorities of the Bulgarian Academy of Sciences and made suggestions on them;

3. give opinions and well-motivated can make proposals to the General Assembly for amendment of the Statute, as well as for the creation, transformation and closure of academic institutes and other structural units;

4. propose measures to achieve the objectives set out in the European research and innovation strategies;

5. coordinate the annual report of the BULGARIAN ACADEMY of SCIENCES;

6. assist in providing the necessary budgetary subsidy for the operation of the BULGARIAN ACADEMY of SCIENCES, as well as other sources of financing;


7. receive every six months financial statement of all units in the BAS, provides recommendations for improvement of the financial activity and alert the competent authorities in the event of infringements;

8. control the spending of budgetary grant and coordinated financial policy of the BULGARIAN ACADEMY of SCIENCES;

9. control in the manner and under the stewardship and disposition on the State property of the BULGARIAN ACADEMY of SCIENCES, academic institutions and other private property units;

10. proposes that the financial and other necessary mechanisms for joint scientific, educational and practical activities with higher education institutions and commercial enterprises;

11. analyze every two years by the Management Board received results of the work of the academic institutes and other independent units, and every three years – the results of performance appraisals of scientists;

12. assist in creating innovative centres of production, implementation, trade and other activities relating to the application of scientific results.

(2) the Board of Trustees shall adopt the decisions referred to in paragraph 1. 1, 2, 3, 5 and 8 with a majority of two thirds of the list are stock with voting rights, and in other cases – with the majority more than half of the list are stock with voting rights.

(3) upon refusal to reconcile the acts under paragraph 1. 1, 2, 5, and 8 more reasoned proposals to the General Assembly for amendment of the Statute, as well as for the creation, transformation and closure of academic institutes and other structural units, or when a negative opinion of the Board of Trustees in cases under para. 1, paragraph 3, the General Assembly of the ACADEMY of SCIENCES shall decide by a qualified majority of two thirds of the list are stock.

Art. 5. (1) the Board of Trustees of the ACADEMY of SCIENCES shall meet not less than once every three months.

(2) the Board of Trustees shall meet when convened by the President of the Council either on his own initiative or at the request of any of its members.

(3) the Board of Trustees shall adopt its own rules of procedure.

(4) the members of the Board of Trustees shall not be remunerated for their activities. "

§ 4. In art. 10 para. 4 is repealed.

Transitional and final provisions

§ 5. (1) within one month from the entry into force of this law the Council of Ministers and other bodies and organizations under art. 5 (a), para. 2 and 4 shall appoint their representatives to the Board of Trustees of the ACADEMY of SCIENCES and shall notify the Chairman of the Bulgarian Academy of Sciences.

(2) within one month of the receipt of notifications of appointed representatives, the Board of Trustees of the ACADEMY of SCIENCES shall be constituted in accordance with the requirements of this law, as the President of the ACADEMY of SCIENCES convened and held its first session.

§ 6. Within three months of the entry into force of this law, Bulgarian Academy of Sciences sets its statute in accordance with its provisions.

§ 7. The law shall enter into force on the day of its publication in the Official Gazette.

The law was adopted by 41-Otto National Assembly on 30 March 2011 and is stamped with the official seal of the National Assembly.
