amending the law on the direct participation of citizens in the State power and local self-government (official SG. 44 of 2009; amend., SG. 100 by 2010 and issue 9 of 2011.)

§ 1. In art. 1 create al. 2:

"(2) this Act regulates and measures for the implementation of Regulation (EC) no 211/2011 of the European Parliament and of the Council of 16 February 2011 on the citizens ' initiative (OJ L 65/1 of 11 March 2011), hereinafter referred to as" Commission Regulation (EU) no 211/2011. "

§ 2. In art. 3 make the following amendments and additions:

1. In paragraph 8. 1:

a) a new paragraph 3:

"3. the European citizens ' initiative within the meaning of art. 2, point 1 of Regulation (EC) no 211/2011; "

(b)) the current paragraph 3 becomes paragraph 4.

2. in the Al. 3, after the word "national" is a comma and add "European".

EUROPEAN CITIZENS ' INITIATIVE

Certification of statements of support online on the European citizens ' initiative

Art. 53. (1) a European citizens ' initiative is carried out via subscription subject to the requirements of Regulation (EC) no 211/2011.

(2) the statements of support from supporters of a proposed European citizens ' initiative is collected on paper or electronically.

(3) in cases where the collected statements of support online, obtained through the system for collecting online data, the Minister of transport, information technology and communications is the authority competent to verify that the system for collecting online complies with the requirements of Regulation (EC) no 211/2011 through the Minister designated by accredited persons under art. 57, al. 1 of the law on e-governance.

(4) before starting the collection of statements of support, the organizers made a request to the Minister of transport, information technology and communications to verify whether the system for collecting online data that will be used meets the requirements of Regulation (EC) no 211/2011.

(5) the methodology, rules for the assessment of conformity determination of accredited persons under para. 3 and the requirements to their activities are governed by the Ordinance of the Council of Ministers.

(6) the Ministry of transport, information technology and communications leads the list of accredited persons, access to which is free.

(7) the technical specifications and security features of systems for the collection of online statements of support are laid down in the implementing Regulation (EC) no 1179/2011 of 17 November 2011 laying down technical specifications for systems to collect statements of support online, by Regulation (EC) no 211/2011 of the European Parliament and of the Council on the citizens ' initiative (OJ , L 301/3 of 18 November 2011).

(8) when the system for the collection meets the requirements of paragraphs 1 and 2. 9, accredited by the Minister of transport, information technology and communications persons under para. 3 issue the certificate within one month, the model – annex IV to Regulation (EC) no 211/2011.

(9) the recognised certificates of conformity of the system for the collection of statements of support online with the requirements of art. 6 of Regulation (EC) no 211/2011 issued by a competent authority of another Member State of the European Union.

Verification and certification of statements of support for the European citizens ' initiative

Art. 53B. (1) in cases where the European citizens ' initiative is organized, competent authority of inspection and certification number of the actual collected statements of support for the Republic of Bulgaria, is the Directorate General for civil registration and administrative service, Ministry of regional development and public works. The verification shall be carried out within three months of receipt of the statements, as for its results to the organizers a certificate confirming the number of actual statements of support.

(2) financial resources for carrying out the verification referred to in paragraph 1. 1 are provided from the State budget.

Protection of personal data

Art. 53. the collection and processing of personal data under this chapter shall be carried out under the conditions and by the procedure of the law on the protection of personal data. "

§ 4. In the additional provision, the following amendments and supplements shall be made:

1. The title shall be replaced by the following: "additional provisions".

2. § 1a shall be inserted:

"§ 1 (a). The funds for carrying out official checks on subscriptions for a local referendum on local initiative and for the convening of a general meeting of the population provided by the municipal budget of the municipality and shall be made available in the budget of the Ministry of regional development and public works. "

Additional provision

§ 5. Everywhere in the law the word "box" is replaced by "urn".

The law was adopted by 41-Otto National Assembly on May 22, 2012 and is stamped with the official seal of the National Assembly.
