LAW

amending and supplementing the law on fisheries and aquaculture (official SG. Since 2001, 41; amend., SG. 88, 94 and 105 by 2005, issue 30, 65, 82, 96 and 108 of 2006, issue 36, 43 and 71 of 2008, issue 12, 32, 42, 80 and 82 of 2009, issue 61 and 73 by 2010. , PC. 8 and 19 of 2011, issue. 38, 59, 77 and 102 by 2012 PCs. 15 and 109 in 2013, PCs. 53 and 107 by 2014 and PCs. 12 by 2015.)

§ 1. In art. 17 al. 1 shall be amended as follows:

(1) commercial fishing in the waters of the Black Sea and the Danube River is carried out after the issuance of a permit for commercial fishing and acquiring the right to absorb the resource of fish and other aquatic organisms:

1. natural persons, legal persons and the sole traders, for vessels with a length up to 10 m;

2. legal entities and sole Commer CE-for vessels with a length of 10 meters and above. "

§ 2. In art. 18 (b), para. 1 the words "para. 6 ' shall be replaced by "para. 7. "

§ 3. In art. 19 create al. 10 and 11:

"(10) masters of fishing vessels with a length of up to 10 metres shall be exempt from the obligation to conduct a fishing journal based on the effective sampling plan in accordance with the law of the European Union.

(11) the masters of fishing vessels with a length of up to 10 meters recorded in the Declaration, an integral part of the plan under paragraph 1. 10 data on catches/landings for the previous month by species and quantities. The Declaration shall be transmitted in NAFA to 5-day of the month following the month to which it relates. "

§ 4. In art. 57, al. the words "sole trader or legal entity" are replaced by "A person" and the words "punishable by" are replaced by "a fine in the amount of 200 to 500 EUR, respectively.

§ 5. In art. 58 (b), the words "sole trader or legal entity" are replaced by "A person" and the words "punishable by" are replaced by "a fine in the amount of 200 to 500 EUR, respectively.

§ 6. In art. 59 the words "sole trader or legal entity" are replaced by "A person" and the words "punishable by" are replaced by "a fine in the amount of 200 to 500 EUR, respectively.

§ 7. In art. 61, para. the words "sole trader or legal entity" are replaced by "A person" and the words "punishable by" are replaced by "a fine in the amount of 200 to 500 EUR, respectively.

§ 8. Art is created. 61A:

"Art. 61. A person who contravenes the requirements of art. 19, para. 11, having a fine of 200 to 500 EUR, respectively, the penalty payment in the amount of 400 to 1000 BGN "

§ 9. In the transitional and concluding provisions of the law amending and supplementing the law on fisheries and aquaculture (official SG. 59 by 2012; amend., SG. 102 by 2012, from 2013, 109 and 107 from 2014) in § 119, para. 1, after the word "fishing" is added "with a ship with a length of 10 or more yards.

Transitional provision

§ 10. (1) pending the entry into force of the plan for statistical sampling under art. 19, para. 10 masters of fishing vessels with a length of up to 10 meters in NAFA completed declarations of origin under art. 20 to 5-day of the month following the month to which they relate.

(2) a person who fails to submit a declaration of origin in contravention of para. 1 shall be imposed a fine in the amount of 200 to 500 EUR, respectively, the penalty payment in the amount of 600 to 1200 LV.

(3) the acts establishing the infringements shall be drawn up and the penal provisions shall be issued in accordance with art. 91.

The law was passed by the National Assembly-43 on 17 December 2015 and is stamped with the official seal of the National Assembly.
