LAW

amending and supplementing the law on associations for irrigation (official SG. 34 of 2001; amend., 108/2001, no. 30 of 2006, no. 59 of 2007, 36/2008 and no. 61 by 2015.)

§ 1. In art. 2, al. 1, the words "in the interest of its members and" are deleted.

§ 2. In art. 3, item 1 the words "communicated to them by the procedure of art. and 47 § 3 of the transitional and final provisions ' shall be deleted.

§ 3. In art. 5 is hereby amended as follows: 1. In para. 1 the words "assist and ' shall be deleted.

2. in the Al. 2 the word "food" is replaced by "food".

§ 4. In art. 6, al. 2 the words "50 per cent plus one" shall be replaced by "30 per cent".

§ 5. In art. 8, al. 1 the word ' five ' is replaced by ' three '.

§ 6. In art. 13 make the following amendments and additions:

1. In paragraph 8. 2 the words "50 plus 1 of votes, and under item 3 – with the majority" are replaced by "more than half of the votes of the persons".

2. a para. 3:

"(3) the decisions referred to in paragraph 1. 1, item 3 shall be adopted with the votes of all the persons under art. 6, al. 2. "

§ 7. In art. 14, para. 2, the words "with mandatory provisions of the Act" shall be replaced by the words "in the law".

§ 8. In art. 15, para. 3 the words "which shall be published in the" Official Gazette "at the request of the Court of Justice ' shall be deleted.

§ 9. Article 18 is hereby repealed.

§ 10. In art. 19, para. 1 make the following amendments and additions:

1. the text before point 1 shall be replaced by the following: "the supervisory authority shall at the written request of the Association:".

2. paragraph 1 shall be added at the beginning "text information.

3. paragraph 2 shall be added at the beginning "graphics and text information.

§ 11. In art. 21 the word "producer" shall be replaced by "owners".

§ 12. In art. 22, after the words "art. 7, paragraph 2 "shall be inserted" or of art. 21. "

§ 13. In art. 37, para. 4, first sentence, the words "mandatory provisions" shall be deleted and the second sentence, the words "subject to appeal ' shall be replaced by ' shall be notified and may be appealed pursuant to the administrative code.

§ 14. In art. 44, item 5 the words "trespassing" are deleted.

§ 15. In the name of chapter v the word "Preferences" is deleted.

§ 16. In art. 47 following amendments and supplements shall be made:

1. In paragraph 8. 1 the first sentence shall be replaced by the following: "Minister of agriculture and food can provide the associations for a period of 5 years right of use on the sites of the hidromeliorativnata infrastructure and service equipment on the territory of the Association included in the assets of the companies in which the State is the sole owner of the capital, or their successors.", and in the second sentence, the word "food" is replaced by "food".

2. paragraph 2 is repealed.

3. in the Al. 3, after the word "objects" are added "and the service" technique.

4. Paragraph 4 is replaced by the following:

"(4) the Minister of agriculture and food, can provide the Association new right of use for a period of 15 years, if, within the period referred to in paragraph 1. 1 the Association has not taken away the right to use or not is imposed administrative punishment for violation of the law and its implementing acts. "

§ 17. Article 49 shall be repealed.

§ 18. Article 52 shall be repealed.

§ 19. In art. 53, first sentence, the word "food" is replaced by "food", and the second sentence shall be deleted.

§ 20. The title of Chapter vi shall be replaced by the following: "the supply of water for irrigation.

§ 21. Article 58 shall be amended as follows:

"Art. 58. water providers carry out the delivery of irrigation water "for a fee at a price determined by the methodology adopted by the Council of Ministers."

§ 22. Article 59 shall be repealed.

§ 23. In § 1 of the supplementary provision shall create item 9 and 10:

"9." Suppliers "of irrigation water are the owners or users of irrigation system or technologically distinct part thereof.

10. "the supply of water for irrigation is a service in which the agricultural land is supplied irrigation water from irrigation water providers via components of irrigation systems or technologically distinct part thereof."

§ 24. In other texts of the law the words "Minister of agriculture and food and the Minister of agriculture and food" are replaced with "Minister of agriculture and food and the Minister of agriculture and food".

Final provisions

§ 25. Within three months of the entry into force of this law the Council of Ministers sets in accordance with it the Ordinance under art. 47, para. 1 and the methodology adopted under art. 58.

§ 26. The law shall enter into force on the day of its publication in the Official Gazette.

The law was passed by the National Assembly-43 on 1 July 2016 and is stamped with the official seal of the National Assembly.
