DECREE NO. 6,546, OF August 25, 2008.

Approves the Regimental Structure and the Demonstrative Table of the Cargos in Commission and of Gratified Functions of the Ministry of the Tourism, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that gives you the art. 84, incisos IV and VI, point? a? of the Constitution, and with a view to the provisions of the art. 50 of the Law no 10,683, of May 28, 2003,

DECRETA:

Art. 1o Ficam approved, in the form of the Annexes I and II to this Decree, the Regimental Structure and the Demonstrative Picture of Cargos in Commission and Gratified Functions of the Ministry of Tourism.

Art. 2o As a result of the provisions of the art. 1o, stay remanded, in the form of Annex III to this Decree, the following posts in committee of the Group-Direction and Superiors Superiors-DAS:

I-from the Ministry of Tourism to the Office of Management, of the Ministry of Planning, Budget and Management: three DAS 102.4; and

II-from the Office of Management, the Ministry of Planning, Budget and Management, to the Ministry of Tourism, the following posts in committee of the Group-Direction and Higher Advising: one of DAS 101.5; five DAS 101.4; five DAS 101.2; and one of DAS 102.3.

Art. 3o The apostilaments arising from the approval of the Structure Regimental of which treats art. 1o should occur within twenty days, counted from the date of publication of this Decree.

Single paragraph. After the apostilaments provided for in the caput, the Minister of State for Tourism will make published in the Official Journal of the Union within thirty days of the date of publication of this Decree, nominal relation of the holders of the posts in committee of the Group-Direction and Superiors Superiors-DAS referred to in Annex II, indicating, including, the number of vacant positions, their denomination and their level.

Art. 4o The internal regiment of the Ministry of Tourism will be approved by the Minister of State for Tourism and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 5o This Decree comes into effect on the date of its publication.

Art. 6o It is revoked the Decree no 5,203, of September 3 of 2004.

ANNEX I

REGIMENTAL STRUCTURE OF THE MINISTRY OF TOURISM

CHAPTER I

OF THE NATURE AND COMPETENCE

Art. 1o The Ministry of Tourism, the body of the direct Federal Administration, has as an area of competence the following subjects:

I-national tourism development policy;

II-promotion and dissemination of national tourism, in the Country and abroad;

III-stimulus to public and private initiatives of incentive to tourist activities;

IV-planning, coordination, supervision, and evaluation of tourism incentive plans and programs;

V-management of the General Fund of Tourism; and

VI-development of the Brazilian System of Certification and Classification of activities, endeavors and equipment of tourist service providers.

CHAPTER II

OF THE ORGANIZATIONAL STRUCTURE

Art. 2o The Ministry of Tourism has the following Organizational Structure:

I-organs of direct and immediate assistance to the Minister of State:

a) Cabinet;

b) Secretariat-Executive:

1. Board of Strategic Management; and

2. Board of Internal Management;

c) Legal Consultancy;

II-specific organ-specific organs:

a) National Policy Office of Tourism Policies:

1. Department of Tourism Planning and Evaluation;

2. Department of Studies and Research;

3. Department of Structuring, Articulation and Tourist Planning;

4. Department of International Relations of Tourism; and

5. Department of Promotion and National Marketing;

b) National Registry of Programs of Development of Tourism:

1. Department of Regional Tourism Development Programs;

2. Department of Tourist Infrastructure;

3. Department of Financing and Promotion of Investments in Tourism; and

4. Department of Qualification and Certification and Production Associated with Tourism;

III-organ collegiate: National Tourist Board-CNT; and

IV-linked entity: autarky EMBRATUR-Brazilian Institute of Tourism.

CHAPTER III

OF THE COMPETENCIES OF THE ORGANS

Section I

From the Direct and Immediate Assistance Bodies to the Minister of State

Art. 3the To the Cabinet competes:

I-attend the Minister of State in his political and social representation, occupy himself with the public relations and the prepares and dispatch of expedients;

II-follow up the progress of the projects of interest or initiative of the Ministry, in tramway at the National Congress, and advise the Minister of State in the care of consultations and applications formulated by parliamentarians;

III-exercise the social communication activities concerning the achievements of the Ministry and the linked entity;

IV-coordinate, in the framework of the Ministry, the activities related to the ouvidoria;

V-coordinate and develop activities, in the international framework, that aid institutional actuation of the Ministry, in articulation with the Ministry of Foreign Affairs and other bodies of the Public Administration;

VI-exerting actions related to the Program of Combat to the Abuse and Sexual Exploitation of Children and Adolescents; and

VII-exercise other skills that are committed to you by the Minister of State.

Art. 4o À Secretariat-Executive competes:

I-assist the Minister of State in the definition of guidelines and in the implementation of policies and actions of the area of competence of the Ministry;

II-promote the intra-and intergovernmental articulation, aiming at the identification of articulation mechanisms specific to public tourism policies;

III-attend the Minister of State in the supervision and coordination of the activities of the member Secretaries of the structure of the Ministry and of the municipality to it linked;

IV-supervise and coordinate the execution of the activities of organization and administrative modernization, as well as those related to the federal planning and budget systems, financial administration, accounting, administration of information and informatics resources, civil personnel and general services, within the Ministry; e

V-exercise other skills that are committed to you by the Minister of State.

Single paragraph. The Executive Secretariat exercises, still, through the Directors of Strategic Management and Internal Management, to her subordinates, the role of the sectoral organ of the Civil Personnel Systems of the Federal Administration-SIPEC Administration of Information and Informatics Resources-SISP, of General Services-SISG, Planning and Federal Budget, Federal Financial Administration and Federal Accounting and the National Archives-SINAR.

Art. 5the To the Directorate of Strategic Management competes overseeing, coordinate and promote the activities related to planning, budgetary and financial and accounting programming, of organization, of improvement of management and de-bureaucratization, within the framework of the Ministry and the linked entity and, specifically:

I-coordinate, guide, and supervise the planning process strategic;

II-formulate, propose, coordinate and support the implementation of programs, projects and systemic actions of transformation of management, aimed at institutional strengthening of the Ministry and the linked entity;

III-coordinate, integrate and evaluate the acting of the organs of the Ministry and the linked entity, with views to the fulfillment of the established policies, goals and projects;

IV-establish and implement systematics of elaboration, follow-up, evaluation and review of the multi-annual plan, budget proposal and budget and financial programming, proposing measures for correction of distortions and improvement;

V-orienting and performing the activities concerning analytical accounting and the process of design and alignment of organizational and managerial structures and de-bureaucratization;

VI-coordinate the collection of information and draw up the annual reports of management, propitiating greater transparency with the society at large;

VII-undertake outlets of bills of the expense payers and too responsible for public goods and values and of all the one that gives cause to loss, stray or other wrongdoing that results in damage to the erarium; and

VIII-propose the introduction of special account-taking and too much measures of its competence when the provision of accounts is not approved, after exauriating the bootable arrangements.

Art. 6the To the Directorate of Internal Management competes overseeing, coordinating and promote the activities related to the management of people, of convents, of logistics, of information technology, of financial administration and of documentation and file within the Ministry and, specifically:

I-elaborate and consolidate the plans and programs pertaining to the activities of your area of competence;

II-develop the budgeting and financial execution activities;

III-carry out actions of development and administration of people;

IV-perform the activities concerning the celebration and the provision of accounts of convennials, agreements and other instruments congeners that involve transfer of resources from the General Budget of the Union;

V- to develop the activities of administration of general services and documentary management; and

VI- to establish and formulate strategies and standards related to the administration of information and informatics resources for the systematization and provision of managerial information, aiming to support decision-making and supervision ministerial.

Art. 7o À Legal Consultancy, the sectoral organ of the Advocate-General of the Union, compete:

I-advise the Minister of State on matters of a legal nature;

II-exercise the supervision of the activities of the legal body of the linked entity;

III-fixing the interpretation of the Constitution, of laws, of treaties and of the remaining normative acts to be uniformly followed in their areas of acting and coordination, when there is no normative orientation of the Union Advocate General;

IV-elaborating studies and preparing information, by request of the Minister of State;

V-assist the Minister of State in the internal control of the legality of the administrative acts by him practiced and those coming from organs or entity under his coordination legal;

VI-examine, prior and conclusively, within the Ministry's scope:

a) the texts of bidding editions, as well as those of the respective congenneric contracts and instruments, to be published and celebrated;

b) the acts by which it is going to recognize the inexigsibility or decide the bidding dispensation;

c) the texts, the conditions and documentation necessary to the celebration of congeniums, terms of partnership and congenneric instruments; and

d) proposals, studies, projects, anteprojects and minutes of normative acts of interest of the Ministry.

Section II

From the Singular Specific Organs

Art. 8the To the National Registry of Tourism Policies competes:

I-formulate, elaborate and monitor the National Tourism Policy, in accordance with the proposed guidelines and the grants provided by the National Tourism Board;

II-analyze and evaluate the implementation of the National Tourism Policy;

III-designing instruments and proposing standards for the implementation of the National Tourism Policy;

IV-coordinate the elaboration and accompany the implementation of the National Tourism Plan;

V-draw up and evaluate the plans, programmes, actions and projects of the Ministry, such as also subsidizing the elaboration of these instruments by the remaining units;

VI-designing guidelines for the formulation of studies, research, analyses and withdrawals of data in national and international scope aimed at formulation, implementation and assessment of the National Tourism Policy;

VII-perform the duties of Executive Secretariat of the National Tourism Council;

VIII-orienting, accompanying and overseeing the execution of the programs, actions and projects of classification, structuring and diversification of the tourist offer;

IX-guiding the surveying and structuring of tourism indicators, with the purpose of keeping up with the dynamics of the national and international tourist market and subsidize the evaluation of the implementation of the National Tourism Policy;

X-articular and participate in national and international bodies and instances, aiming at the development of national tourism;

XI-promoting cooperation and articulation with the organs of the Federal, State Administration, the Federal and Municipal District, with the productive sector and the third sector, in their programs, actions, and projects that interact with those of this Registry or that can contribute to the strengthening and development of national tourism;

XII-promoting cooperation and articulation with the forums, councils, consortia and tourism and related entities in an international, national, state, regional and municipal level; e

XIII-promoting and encouraging the realization of events of interest of tourism, as well to disseminate and support the marketing of Brazilian tourist products in the domestic market.

Art. 9o To the Department of Planning and Assessment of Tourism compete:

I-plan, coordinate, follow up and evaluate the National Tourism Policy;

II-coordinate the drafting and evaluation of the National Tourism Plan;

III-elaboration of the instruments and standards aimed at the implementation of the National Tourism Policy;

IV-provide technical and administrative support to the National Tourist Board; and

V-accompany the decentralized management of the National Tourism Plan in the actions of the boards and forums state, regional and municipal.

Art. 10. The Department of Studies and Research competes:

I-carry out studies, research, analysis and withdrawals of data and indicators necessary for the formulation, implementation and evaluation of the National Tourism Policy;

II-accompany the dynamics of the national and international tourism market with views to subsidize the formulation and evaluation of National Tourism Policy;

III-propose, coordinate, supervise, and support the realization of studies, research, analysis, uprisings and systematization of statistical data on the tourism sector, with the aim of guiding public policies;

IV-create database of managerial information on the tourist supply and demand to support public decision making; and

V-interacting with institutions in national and international scope, who can collaborate with the enhancement in the area of research and tourist information.

Art. 11. To the Department of Structuring, Articulation and Tourist Planning competes:

I- coordinate, monitor supervise and articulate policies, plans, programs, actions and projects for the structuring and diversification of the tourist offer;

II-exercise sector planning activities, which comprise to legislate, classify, enroll and scrutinize services and tourism ventures;

III-supporting the planning of programs and projects within the framework of the Administration of States, Federal District, de Municipalities and of micro-regions that contribute to the strengthening and sustainable development of tourism activity;

IV-subsidize the formulation and management of policies, plans, programs, actions and projects for the planning and development of tourism and its segments in the framework local, regional, state and national, promoting the insertion of social, environmental and cultural thematics;

V-subsidizing the formulation of policies, normative, regulatory and supervisory acts for tourism planning and tourism activity in general; and

VI-create and manage instruments and mechanisms of communication, establishing information networks and relationships to subsidize the deployment of the National Tourism Plan and strengthen tourism activity.

Art. 12. To the Department of International Relations of Tourism competes:

I-support, plan, coordinate and follow up the conclusion of agreements and instruments of international technical cooperation;

II-support, plan, coordinate, develop activities and follow up the performance and participation of the Ministry of Tourism in forums and international bodies of interest of the national tourism and in line with the foreign policy of the Country;

III-support, plan, coordinating, monitoring and promoting studies and initiatives with views to subsidize the role of the Ministry and the Brazilian government in the negotiations of bilateral, regional and multilateral trade agreements dealing with tourism products and services;

IV-support, plan, coordinate and follow up with the articulation with the remaining bodies and institutions government with acting on the international stage; and

V-researching, identifying, analyzing and disseminate new practices of tourism development and management, carried out in the international framework, aiming to enhance the quality and competitiveness of Brazilian tourism.

Art. 13. To the Department of Promotion and National Marketing competes:

I-propose, support, plan, coordinate, follow up and carry out the actions and projects of marketing, promotion, advertisement, support for the marketing and dissemination of Brazilian tourism in the national market;

II-support, plan, coordinate, and follow up programs for the promotion and dissemination of events and products Brazilian touristic ones on the national market; and

III-support, plan, coordinate and follow up the promotion and dissemination of products associated with tourism in the national market.

Art. 14. To the National Registry of Tourism Development Programs competes:

I-subsidize the formulation of the plans, programs and actions aimed at the development and strengthening of national tourism, in compliance with the National Tourism Policy guidelines;

II-support and follow up the formulation of the regional tourism development programmes and promote technical support, institutional and financial necessary to the strengthening of the execution and participation of the states, the Federal District and the Municipalities, in these programs;

III-supporting and accompanying programs, actions and projects for the catchment and stimulus to the realization of national and international private investments, in compliance with the Guidelines of the National Tourism Policy;

IV-promote the cooperation and articulation of the instruments of the Public Administration for financing, support and development of tourism activity;

V-regulatory and support the certification of the activities, ventures and equipment of the service providers and fix the evaluation criteria of the bodies of certification of conformity;

VI-supporting professional and business qualification and the improvement of the quality of service provision for the tourist;

VII-support and encouraged production associated with tourism;

VIII-carry out the management of the General Tourism Fund- FUNGETUR;

IX-execute and support the deployment, magnification, recovery and modernization of the infrastructure necessary for tourism, included the historical heritage and tourist signage; and

X-promoting cooperation and articulation with the organs of the Federal, State Administration, Federal and Municipal District, with the productive sector and organized civil society, in its programs, actions and projects that interact with those of this Registry or that can contribute to the strengthening and development of national tourism, in its areas of competence.

Art. 15. To the Department of Regional Tourism Development Programs competes:

I- coordinate the formulation, support, follow up and evaluate regional tourism development programmes, which aim to benefit local populations and the increment of income generated by national and international tourism;

II-subsidize the formulation, coordinate, support, and follow up with the promotion of technical, institutional and financial support necessary for the strengthening of the implementation and participation of states, the Federal District and the Municipalities, in these programs;

III-coordinate the formulation, support and follow up the appropriate institutional and financial structure for the implementation of the regional tourism development programmes; and

IV-coordinate the formulation, support and follow up with the aport of responsibility resources of the Ministry, in compliance with the guidelines and the funding matrix of each program.

Art. 16. To the Department of Tourist Infrastructure competes:

I-formulate, coordinate, support, follow up and evaluate the Ministry's plans, programs and actions aimed at the implementation of tourism infrastructure projects, as per the National Tourism Policy;

II-coordinate, scrutinize, monitor, and evaluate the application of Ministry's responsibility resources in projects of tourism infrastructure;

III-support the formulation of proposals for recovery of historical heritage component of structured tourism product or in structuring; and

IV- analyze investment in basic and environmental sanitation integral of structured tourism project or in structuring, in compliance with the National Tourism Policy.

Art. 17. To the Department of Financing and Promotion of Investments in Tourism competes:

I- coordinate the formulation, support, follow up and evaluate the stimulus actions and foster the mobilization of the private, national and international initiative, for their active participation in the implementation of the National Tourism Policy;

II-coordinate, support and track the development of plans, projects, and events that object to the capturing and stimulation of national and international investments, in actions integrated with the guidelines and regions benefited by tourism development programs;

III-coordinate, support and follow up on the development, maintenance and promotion of projects and opportunities of investments;

IV-coordinate, support and monitor development, together with the institutions financial lines and other financial instruments, aimed at financing the tourist and the companies of the productive chain of tourism; and

V-carry out the management of the General Fund of Tourism-FUNGETUR.

Art. 18. To the Department of Qualification and Certification and Production Associated with Tourism competes:

I-format, implement and support programs, actions, and projects aimed at the development of artisanal production and too many products associated with tourism;

II-coordinate the actions aimed at the promotion and commercialization of artisanal production and too much products associated with tourism;

III-propose actions of planning, coordination, implementation and evaluation of quality policies for tourism;

IV-format, implement and support programs, actions and projects aimed at the development of professional qualification, technical assistance to micro and small businesses and tourism education;

V-articular and establish partnerships between program executors and government area agents, from entities of business class, of workers, of technical and technological institutions, of teaching and research and of too many social sectors involved in the thematic issues aimed at improving the quality of the tourist products;

VI-format, implement, and support programs, actions, and projects aimed at normalization and certification in the tourism;

VII-coordinate programs, actions and projects aimed at professional qualification and business and the improvement of the quality of services provided to the tourist;

VIII-auxiliary public institutions in the formulation of quality policies for tourism;

IX- stimulate private institutions to adopt quality practices for tourism;

X- develop, implement, and support structuring projects, in target regions of new tourism investments generators of economic and social impacts;

XI-articular, support and follow up the promotion of technical, institutional and financial support needed by the regions with tourist and low-income potential per capita, in compliance with the National Tourism Plan; and

XII-coordinate the formulation, support, perform and follow up programs, actions and projects aimed at generating new local development alternatives based on the touristic segments and their productive chain.

Section III

From the Collegiate Organ

Art. 19. To the National Board of Tourism it is to exercise the competences set out in specific regulation.

CHAPTER IV

OF THE ATTRIBUTIONS OF THE LEADERS

Section I

From the Executive Secretary

Art. 20. The Executive Secretary is incumbent on:

I-coordinate, consolidate and submit to the Minister of State the planning of the overall action of the Ministry, in line with the Federal Government guidelines;

II-supervise and evaluate the execution of the actions, projects and activities of the Ministry;

III-supervising and coordinating the articulation of the organs of the Ministry with the central bodies of the systems affections to the area of competence of the Secretariat-Executive;

IV-supervising and coordinating the activities of the integral Secretaries of the Ministry's structure and of the municipality to it bound; and

V-exercise other assignments that are committed to it by the Minister of State.

Section II

Dos Secretaries and too many Leaders

Art. 21. To the Secretaries, it is incumbent on planning, directing, coordinating, directing, monitoring and evaluating the execution of the activities of the units that integrate their respective areas and exert other assignments that are committed to them.

Art. 22. To the Chief Minister's Office, to the Legal Adviser, the Directors and the other leaders it is incumbent on planning, coordinating and directing the implementation of the activities of the respective units and to exercise other assignments that are committed to them.

CHAPTER V

OF THE GENERAL PROVISIONS

Art. 23. The internal regiment shall define the detailing of the integral bodies of the Regimental Structure of the Ministry of Tourism, the competences of the respective units and the assignments of their leaders.
