DECREE OF December 23, 2011

Declared of social interest, for purposes of agrarian reform, the rural real estate named "Saint Benedict", situated in the Municipality of Barra de Santa Rosa, State of Paraíba, and gives other arrangements.

THE CHAIRWOMAN OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2 ° of the Supplementary Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504, of November 30, 1964, and 2 of Law No. 8,629 of February 25, 1993,

D E C R E T A:

Art. 1 ° It shall be declared of social interest, for purposes of agrarian reform, rural real estate named "Saint Benedict", with registered area of thousand, five hundred and nineteen hectares, and measured area of a thousand and ninety hectares, six airs and fifty-six centiars, situated in the Municipality of Barra de Santa Rosa, object of the Matriculation n ° 385, fls. 01, Book 2-C, of the Estate Registration Service of the Comarch of Santa Rosa, State of Paraíba (Case INCRA/SR-18/n° 54320.000744 /2008-04).

Art. 2 ° This Decree, regardless of discrimination or fundraising, does not hear particular indemnifying effects, in respect of areas of public domain consisting of law or registration and the areas of private domain harvested by nullity, prescription, comb or ineffectiveness operated solely for the benefit of any legal person of public law, excepted good-faith benefactions existing in them previously to the science of the beginning of the administrative procedure, excluding still from its effects the soothing, the machinery and the agricultural implements and any benfeitory introduced by anyone who comes to benefit from their targeting.

Art. 3 ° The National Institute of Colonization and Agrarian Reform-INCRA, attested to the private dominial legitimacy of the mentioned planimetry area, is allowed to promote the disappropriation of the rural real estate of which it treats this Decree, in the form provided for in the Act Supplementary n ° 76 of July 6, 1993 and to keep the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4 ° This Decree comes into effect on the date of its publication.
