DECREE NO. 4,422, OF October 14, 2002

Dislays on the execution of the Eighteenth Additional Protocol to the Agreement on Economic Supplementation No. 36, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, as States Parties to Mercosur, and the Government of the Republic of Bolivia, of August 7, 2002.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers the art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by the Federative Republic of Brazil on August 12, 1980 and approved by the National Congress, through the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas the Governments of the Federative Republic of the Brazil, of the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and the Government of the Republic of Bolivia, signed on December 17, 1996, in Fortaleza, the Economic Supplementation Agreement No. 36, to the amparo of the 1980 Treaty of Montevideo, which has, among others, the goal of conforming an area of free trade between the signatory countries;

Whereas the Economic Supplementation Agreement No. 36 was incorporated into the Brazilian legal planning by Decree No. 2,240, of May 28, 1997;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, of the Argentine Republic, of the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to the Southern Common Market (MERCOSUR), on the one hand, and the Republic of Bolivia, of the other, signed on August 7, 2002, in Montevideo, the Eighteenth Additional Protocol to the Economic Supplementation Agreement No. 36 (Resolution No. 01/02 of the Administrative Commission of the ACE-36-Transitional Regime of Origin), between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Republic East of Uruguay, as States Parties to Mercosur, and the Government of the Republic of Bolivia;

DECRETA:

Art. 1º The Eighteenth Additional Protocol to the Economic Supplementation Agreement No. 36 (Resolution No. 01/02 of the Administrative Commission of the ACE-36-Transient Regime of Origin), between the Governments of the Federative Republic of Brazil, of the Argentine Republic, of the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to the Common Market of the South (MERCOSUR), and of the Republic of Bolivia, aped by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º This Decree comes into force in the date of its publication.

ECONOMIC SUPPLEMENTATION AGREEMENT NO. 36 CELEBRATED AMONG THE GOVERNMENTS OF THE STATES PARTIES OF MERCOSUR AND THE GOVERNMENT OF THE REPUBLIC OF BOLIVIA

Eighteenth Additional Protocol

The Plenipotentiaries of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, in their condition of States Parties to the Common South Market (MERCOSUR), on the one hand, and of the Republic of Bolivia, on the other, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely at the General Secretariat of the Association Latin American Integration (ALADI),

HAVING IN VIEW OF MCS-BO Resolution No. 01/02 of the ACE 36 Administrative Committee,

DECK IN:

Article 1º-Extend since 1º July 2002 to December 31, 2002 the deadline for the special treatment provided in the Appendix 2, letters a) and (b), of Annex 9 of the Regime of Origin for the products included in the aforementioned Appendix.

Article 2º-Ficam excepted from the provisions of the previous article, for the cases that correspond, the tariff positions included in Annex III of the Fourteenth Additional Protocol, for those governing the definitive specific regime of the agreement.

Article 3º.-Ficam excluded from the provisions of Article 1º of this Additional Protocol the NALADI/SH items 6205.20.00 and 6205.30.00, for the case of the trade exchange between the Argentine Republic and the Republic of Bolivia.

Article 4º-This Protocol will enter into force on the date on which the General Secretariat of the ALADI communicates to the Parties the receipt of the last notification regarding compliance with the internal legal provisions for its entry into force.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly authenticated copies to the signatory Governments.

IN FÉ DO WHAT, THE RESPECTIVE PLENIPOTENTIARIES SIGN the present Protocol in the city of Montevideo, at the seven days of the month of August two thousand and two, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
