DECREE OF November 30, 2006.

Dislays on the creation of the Gurupá Extrativist Reserve, in the Municipalities of Gurupá and Melgsteel, in the State of Pará, and gives other arrangements.

THE VICE PRESIDENT OF THE REPUBLIC, in the exercise of the post of President of the Republic, using the assignment that gives him the art. 84, inciso IV, of the Constitution, and having and seen the provisions of the art. 18 of the Law no 9,985, of July 18, 2000, and what is stated in the Process in the 02001.001740 /2004-11,

DECRETA:

Art. 1st It is created the Gurupá Extrativist Reserve, in the Municipalities of Gurupá and Melgsteel, in the State of Pará, with approximate area of 145,297.54 ha, with cartographic basis drawn up from the charter SA-22-V-D, with scale 1:250.000, published by the Brazilian Institute of Geography and Statistics-IBGE, SAD 69, and with the following memorial descriptive: departing from point 1, of approximate geographical coordinates 51 ° 0 '1.87 "Wgr and 1 ° 7' 1.01" S, located at the confluence of an igarapé with no denomination with left margin of the Tajapuru borehole, follows by the said igarapé by a distance approximate 1.171.20 metres, up to point 2, of approximate geographical coordinates 51 ° 0 '14.78 "Wgr and 01 ° 7' 20.91" S, located in the spring of this igarapé without denomination; of this one, follows by a straight azimut 252 ° 07 ' 43 " and approximate distance of 254.17 metres up to point 3, of approximate geographical coordinates 51 ° 0 '23.32 "Wgr and 1 ° 7' 23.53" S; of this, it follows by a straight of azimut 176 ° 40 '16 "and approximate distance of 6,336.69 metres up to point 4, of approximate geographical coordinates 51 ° 0' 11.41" Wgr and 1 ° 10 '49.56 "S, located in the nascent of an igarapé with no tax denomination of the left bank of the Tajapuru furrow; of this, it follows by the left bank of the Tajapuru borehole by a approximate distance of 25,236.44 meters to the point 1, start of this descriptive memorial, totaling a perimeter approx. 243,338.78 meters.

Art. 2nd The Extrativist Reserve Gurupá-Melgsteel aims to protect the means of life and culture of the extractivist population residing in the area of its comprehensiveness and ensure the sustainable use of the natural resources of the unit.

Art.3rd Caberá to the Brazilian Institute of the Environment and Renewable Natural Resources-IBAMA administer the Gurupá-Melgsteel Extractivist Reserve, adopting the necessary measures for its deployment and control, in the terms of the art. 18 of the Law no 9,985 of July 18, 2000, providing the contract of free use cession with the traditional extractivist population, for effect of its celebration by the Union Heritage Secretariat of the Ministry of Planning, Budget and Management, and follow up with the fulfilment of the conditions stipulated therein, in the form of the law.

Art. 4th Ficam declared of social interest, for the purposes of misappropriation, in the form of the Law no 4,132, of September 10, 1962, the rural real estate of legitimate domain private and their benefits that come to be identified in the boundaries of the Gurupá-Melgsteel Extractivist Reserve.

§ 1st The IBAMA is allowed to promote and execute the dispropriations of which it treats the caput of this article, and may, for the purpose of immission in the possession, claim the urgency to which if refers to art. 15 of the Decree-Law no 3,365, of June 21, 1941.

§ 2nd The Federal Attorney General, Organ of the Advocate General of the Union, through its legal unit of execution together with the IBAMA, shall be authorized to promote the relevant administrative and judicial measures, aiming at the declaration of nullity of any property titles and respective real estate records considered irregular, incidents in the Gurupá-Melgsteel Extrativist Reserve.

§ 3rd The areas that come to be identified as domain of the State of Pará will only be able to be misappropriated after due legislative authorization.

Art. 5th This Decree goes into effect on the date of its publication.
