DECREE OF December 26, 2011

Outorga to Transmission Company Timóteo-Mosque Ltda. concession for exploration of the public service of electric power transmission, relative to the Mosque Line Mosque-Timóteo 2, Circuit Simple, at 230 kV, and to Substation Timóteo 2, 230 kV, both located in the State of Minas Gerais.

THE CHAIRPERSON OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, incisions IV, of the Constitution, with a view to the provisions of Laws No. 8,987, of February 13, 1995, n ° 9,074 of July 7, 1995, and No. 9,648 of May 27, 1998 and what appears in Processes No. 48500.000981 /2011-41 and n ° 48500.005996 / 2011-04,

D E C R E T A:

Art. 1 ° It is bestoed to the Timóteo-Mosque Transmission Company Ltda. concession for operation of the public service of electric power transmission, upon construction, operation, maintenance and other associated facilities necessary to the functions of measurement, supervision, protection, command, control, telecommunication, administration and support of the ventures Line of Transmission Mosque-Timóteo 2, Simple Circuit, in 230 kV, and Substation Timóteo 2, 230 kV, both located in the State of Mines General.

Art. 2 ° The concession that it treats this Decree shall apply for the period of thirty years, counted from the date of signature of the respective public service concession contract of electrical power transmission.

§ 1 ° The contract is to be signed within thirty days, counted from the convocation made by the National Electrical Energy Agency-ANEEL, under penalty of ineffectiveness of the concession ora outorgada.

§ 2 ° Mediant application of the Timóteo-Mesquita Transmission Company Ltda. à ANEEL, presented up to thirty six months before the end of the caput' s constant deadline, the grant that it treats this Decree may be extended under the conditions that are stipulated.

Art. 3 ° The existing goods and facilities as a function of the electric power transmission service are bound to the public services granted, vetting the disposal, assignment, transfer or dation in warranty, without prior and express authorization of the ANEEL.

Single Paragraph. Fining the term of the concession, the goods and facilities linked to the provision of the public power transmission service granted will revert to the Union, in the form provided for in law and in the concession contract.

Art. 4 ° This Decree comes into effect on the date of its publication.
