DECREE OF June 19, 2012

Declara of public utility, for purposes of misappropriation, in favor of the concessionary Autopista Coastal Sul S.A., the real estate it mentions, located in the Municipality of Palhoça, State of Santa Catherine.

THE VICE PRESIDENT OF THE REPUBLIC, in the exercise of the post of PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, caput, inciso IV, of the Constitution, with a view to the willing in the arts. 3º, 5º, caput, points "h" and "i", and 6º of the Decree-Law No. 3,365, of June 21, 1941, in the arts. 29, caput, inciso VIII, and 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and what is stated in the ANTT Process No. 50500.138961 / 2011-94,

D E C R E T A:

Art. 1 ° Ficam declared of public utility, for the purposes of dispropriation, in whole or in part, in favour of the Autopista Coastal South S.A., the real estate covered and delimited by the topographical coordinates described below, excluded the goods from public domain, adjacent to the Highway Governor Mário Covas, 101/SC, necessary for the execution of the pedestrian walkway implantation works at km 211 + 340m:

I-Area 01, with the following characteristics: starts the perimeter at point P01, of Plants Plants in the UTM-SIRGAS 2000 System, respectively E: 731,466 ,170m and N: 6,942,059 ,788m; of this, follows with AZPlano= 132 ° 27 '46 "and distance of 4.34m, up to the point P02, E: 731,469 ,374m and N: 6,942,056 ,856m; of this, follows with AZPlano= 222 ° 27' 46" and distance of 31 ,05m, up to P03, E: 731,448 ,412m and N: 6,942,033 ,950m; of this, follows with AZPlano= 312 ° 27 '46 "and distance of 2.50m, up to the point P04, E: 731,446 ,567m and N: 6,942,035 ,638m; of this, follows with AZPlano= 222 ° 27' 46" and distance of 74 ,80m, up to the point P05, E: 731,396.069 m and N: 6,941,980.456 m; of this, follows with AZPlano= 312 ° 27 '46 "and distance of 2.55m, up to point P06, E: 731,394.186 m and N: 6,941,982.180 m; of this, follows with AZPlano= 42 ° 50' 49" and distance of 105 ,85m, up to the point P01, E: 731,466 ,170m and N: 6,942,059.788, with perimeter of two hundred and twenty one meters and ten centimeters, and total area of three hundred and ten square meters and twenty-five square decimeters; and

II-Area 02, with the following characteristics: starts the perimeter at point P01, of Plants Plants in the UTM-SIRGAS 2000 System, respectively E: 731,425 ,209m and N: 6,942,111 ,912m; of this, follows with AZPlano= 132 ° 27 '46 "and distance of 5.27m, up to the point P02, E: 731,429 ,094m and N: 6,942,108 ,357m; of this, follows with AZPlano= 222 ° 40' 34" and distance of 95 ,06m, up to P03, E: 731,364 ,654m and N: 6,942,038 ,466m; of this, follows with AZPlano= 312 ° 52 '02 "and distance of 4.91m, up to the point P04, E: 731,361 ,054m and N: 6.942.041,808m; of this, follows with AZPlano= 42 ° 27' 46" and distance of 95 ,03m, up to the point P01, E: 731,425 ,209m and N: 6,942,111 ,912m, with perimeter of two hundred metres and twenty-seven centimeters, and total area of four hundred and eighty-three square meters and sixty-six square decimeters.

Art. 2 ° It is the concessionaire Coastal Sul S.A. authorised to promote, with own resources, the disappropriation of the areas of land and benfeits of which it treats art. 1º, in the form of the prevailing legislation and regulations.

Single paragraph. The expropriate is allowed to invoke the character of urgency in the process of misappropriation of which it treats the caput, for purposes of immission in the possession, in the terms of the art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3 ° The public utility statement of which it treats this Decree does not exonerate the dealership of the prior obtaining of the licensing and the fulfilment of the obligations attached to the environmental entities and other public administration bodies, necessary to effectivation of the works and activities referred to in art. 1 °.

Art. 4 ° This Decree comes into effect on the date of its publication.
