DECREE NO. 5,547, OF September 22, 2005

Promulgate the Agreement between the Government of the Federative Republic of the Brazil and the Government of the Czech Republic on Partial Exemption from Vistos, celebrated in Prague, on April 29, 2004.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution, and

Whereas the Government of the Federative Republic of the Brazil and the Government of the Czech Republic celebrated, in Prague, on April 29, 2004, an Agreement on Partial Exemption of Visits;

Whereas the National Congress has approved this Agreement through Legislative Decree n o 889, from 1 to September 2005;

Considering that the Agreement will enter into force on October 3, 2005, pursuant to paragraph 1 o of its Article 8;

D E C R E T A:

Art. 1º The Agreement between the Government of the Federative Republic of Brazil and the Government of the Czech Republic on Partial Visctions Exemption, celebrated in Prague, on April 29, 2004, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º Are subject to the approval of the National Congress any acts that may result in revision of the said Agreement, as well as any further adjustments which, pursuant to the art. 49, inciso I, of the Constitution, carries gravy charges or commitments to the national heritage.

Art. 3º This Decree comes into effect on the date of its publication.

AGREEMENT BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE GOVERNMENT OF THE CZECH REPUBLIC ON PARTIAL VISA-FREE TRAVEL

(henceforth called "Contracting Parties"),

Taking into account your interest in strengthening existing friendship relations and wishing to facilitate travel of nationals of the State Party of a Contracting Party to the territory of the State of the other Contracting Party,

Wake up the following:

ARTICLE 1

1. Nationals of the Federative Republic of Brazil who are holders of valid national passports and enter the territory of the Czech Republic for the purpose of a stay which will not exceed the period of 3 (three) months and that there will not be used for the engagement in any lucrative activity will be able to enter the territory of the Czech Republic and there stay on temporary bases, without Visas, for a period not exceeding 3 (three) months in 6 (six) calendar months from the date of the first entry.

2. Nationals of the Czech Republic who are holders of valid national passports and enter the territory of the Federative Republic of Brazil for the purpose of a stay which will not exceed the period of 90 (ninety) days and that there will not be used for the engagement in any lucrative activity will be able to enter the territory of the Federative Republic of Brazil and there stay on temporary bases, without Visas, for a period not exceeding 90 (ninety) days. This period can be extended, provided that the complete period of stay does not exceed 180 (one hundred and eighty) days in a calendar year.

ARTICLE 2

The nationals of the State of one of the Contracting Parties will be able to enter the territory of the State of the other Contracting Party and exit from it by the specified border points for international traffic.

ARTICLE 3

State nationals of one of the Contracting Parties shall abide by, during their stay in the territory of the State of the other Contracting Party, the legal regulations of the State of this other Contracting Party, inclusive of the regulations applicable to the entry, stay and exit of its territory.

ARTICLE 4

The Parties Contractors will readmit the nationals of their respective states without any special formalities or additional expenses.

ARTICLE 5

Both Contracting Parties reserve the right to deny entry or shorten the stay in the territory of their respective States to persona non grata or to persons who do not comply with the conditions stipulated for entry or stay by the national Legislation of their respective states.

ARTICLE 6

Any of the Contracting Parties may temporarily suspend the implementation of this Agreement, in the whole or in part, for reasons of safety, public order, health protection, or any other relevant reasons, with the exception of Article 4. The suspension of the implementation of the Agreement is to be notified to the other Contracting Party, by diplomatic channels, and shall take effect on the day of dispatch of such notification.

ARTICLE 7

1. The Contracting Parties shall interchange, by diplomatic channels, specimens of their valid national passports, with data on their dispatch and use, in no more than 30 (thirty) days after the date of signature of this Agreement.

2. In the eventuality of any modification to valid passports or the introduction of new passports, the Contracting Parties shall interchange their new specimens, by diplomatic channels, with data on their dispatch and use, in no less than 30 (thirty) days prior to its introduction.

ARTICLE 8

1. This Agreement shall conclude for an unlimited period and shall enter into force on the date of dispatch of the last diplomatic Note by which a Contracting Party informs the other Contracting Party of the Agreement's approval in accordance with the national Legislation of their respective states.

2. This Agreement may be amended on the basis of a written agreement between the Contracting Parties. The amendments will enter into force in the manner mentioned in paragraph 1 of this Article.

3. Any of the Contracting Parties may denounce this Agreement, by diplomatic channels. The complaint will take effect 90 (ninety) days after the date of its dispatch to the other tractive Part.

Made in Prague, on April 29, 2004, in two originals, in the Portuguese, Czech and English languages, being all texts being equally authentic. In the eventuality of any divergence of interpretation, the English version prevails.
