DECREE OF November 8, 2002

Declares of social interest, for purposes of agrarian reform, the rural real estate it mentions, and gives others providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that give it the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplementary Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

D E C R E T A:

Art. 1º Become declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters? a?,? b?,? c? e? d?, and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

X??Farm Santa Marta and Retiro?, with area of a thousand, one hundred and fifty hectares, fifty nine airs and eighteen centiars, situated in the Municipality of Baião, object of the Registrations n R-1-303, Ficha 03, Book 2-B and R-1-302, Ficha 02, Book 2-B, of the Real estate Registration Office of the Comarch of Baiao, State of Pará (Process INCRA/SR-27/nº 54600.001484 /2001-63).

Art. 2º Excludes from the effects of this Decree the soothing, machinery and agricultural implements, as well as the existing benfeons in the real estate referred to in art. 1º and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is hereby authorized to promote the rural real estate dispropriations of which it treats this Decree, in the manner provided for in the Supplementary Act No. 76 of July 6, 1993, and to maintain the areas of Legal reserve and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree comes into effect on the date of its publication.
