DECREE NO. 6,831, OF April 29, 2009.

Dispose on the execution of the Quadragumeth Eighth Protocol Additional to the Economic Supplementation Agreement nth 35, signed between the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to MERCOSUR, and the Government of the Republic of Chile, of July 7, 2008.

The PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, inciso IV, of the Constitution, and

Whereas the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by Brazil on August 12, 1980 and promulgated by Decree n 87,054, of March 23, 1982, provides for the modality of Economic Supplementation Agreement;

Considering that the Chancellors of the States Parties of MERCOSUR and Chile, based on the Treaty of Montevideo of 1980, signed on June 25, 1996, in San Luís, Argentina, the Economic Supplementation Agreement nth 35, promulgated by Decree n 2,075, of November 19, 1996;

Considering that the Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and the Eastern Republic of Uruguay, in its condition of States Parties of the MERCOSUR, on the one hand, and of the Republic of Chile, on the other, on the basis of the Treaty of Montevideo of 1980, signed, on July 7, 2008, in Montevideo, the Quadragth 8th Additional Protocol to the Economic Supplementation Agreement nth 35,

DECRETA:

Art. 1th The Quadragumth Eighth Protocol Additional to the Economic Supplementation Agreement n 35, between the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to MERCOSUR, and the Government of the Republic of Chile, of July 7, 2008, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2th This Decree comes into effect on the date of its publication.

ECONOMIC SUPPLEMENTATION AGREEMENT NO. 35

CELEBRATED AMONG THE GOVERNMENTS OF THE STATES PARTS OF MERCOSUR AND

THE GOVERNMENT OF THE REPUBLIC OF CHILE

Quadragumeth Eighth Additional Protocol

The Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and the Eastern Republic of Uruguay, in their condition of States Parties to the Common Market of the South (MERCOSUR) on the one hand, and of the Republic of Chile on the other, accredited by the respective Governments second powers that were bestoed in good and proper shape, deposited opportunely in the General Secretariat of the Latin American Integration Association (ALADI),

HAVING IN VISTA the Resolution MCS-CH N ° 01/2008, emanating from the XVIII Extraordinary Meeting of the Administrative Commission of ACE N ° 35 MERCOSUL-Chile, celebrated on the July 7, 2008, in the city of Montevideo,

DECK IN:

Article 1-Guess the margins of preference set out in Article 2 (f) and (g) of the ACE No. 35, bestoed by the Eastern Republic of Uruguay to the Republic of Chile and by the Republic of Chile to the Eastern Republic of Uruguay for the products originating in the respective territories, as follows:

a) for the products included in Annex 6, preference will be applied from 67% as of 1/1/2008 and preference of 100% as of 1/1/2009; and

b) the products that have special treatment, in Annex 7, higher than that set out in Annex 6, will maintain the benefit corresponding for the period from 1/1/2008 to 12/31/2008 and, as of 1/1/2009, will have a preference of 100%.

Article 2.-This Protocol shall enter into force 30 days after the date on which Chile and o Uruguay have communicated to the ALADI General Secretariat compliance with the internal legal provisions for its entry into force.

The General Secretariat of ALADI will be a depositary of this Protocol, of which it will send duly certified copies to the Governments of the signatory countries and to the Registry of MERCOSUR.

IN FÉ THAN THE RESPECTIVE PLENIPOTENTIARIES sign the present Protocol in the city of Montevideo, at the seven days of the month of July of the year two thousand and eight, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
