DECREE OF May 29, 2007.

Declara of public utility, for purposes of dismispropriation, total or partial, or of institution of servitude administrative, in favor of Brazilian Petroleum SA S.A. -PETROBRÁS, the real estate constituted of land and benfeasures, of private property, necessary for the construction of the Gas Treatment Unit of Caraguatatuba-UTGCA, of natural gas pipelines and condensate in the State of São Paulo, and gives other providencies.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers the art. 84, incisus IV, of the Constitution, and with a view to the provisions of the Decree-Law no 3,365, of June 21, 1941, in the Decree-Law no 1,075 of January 22, 1970 on the art. 8th, inciso VIII, of the Law no 9,478, of August 6, 1997, in Law no 9,847, of October 26, 1999, and what is stated in the ANP Process in the 48610.008574 /2006-78,

DECRETA:

Art. 1st Ficam declared of public utility, for purposes of dispropriation, total or partial, or of administrative servitude institution, in favor of Brazilian Petroleum S.A. -PETROBRÁS, or of company by it controlled, directly or indirectly, which comes to be in charge of the construction and operation of the under-discriminated transport and treatment facilities, the real estate constituted of land and benfeits, of private property, excluded the public domain goods, understood in the areas and lanes of land located in the State of São Paulo, in the Municipalities of Caraguatatuba, São Sebastião, Paraibuna, Jambeiro, São José dos Campos, Caçapava and Taubtill, and whose administrative constraints are indispensable to the construction of the Gas Treatment Unit of Caraguatatuba-UTGCA, from the pipeline from the Praia das Palmeiras (at the point of arrival of the PMXL-1 Platform Gaspipeline) to the UTGCA, of the Condensed Pipeline from the UTGCA to the São Sebastião-TEBAR Terminal, from the Caraguatatuba-Tauba-GASTAU, optical cable, and from the respective complementary and accoutreable facilities.

§ First the area of land referred to in the caput of this article, intended for the construction of the Caraguatatuba-UTGCA Gas Treatment Unit, thus describes and characterizes: land area of one million, twelve thousand, sixty and five square meters, situated in the Municipality of Caraguatatuba, State of São Paulo, limiting itself to the perimeter defined by the coordinate points described below, with start at the coordinate point E=449.388, 79 and N=7.383.536, 35, follows with general course SO, by a distance of 95.12 m, until it reaches the coordinate point E=449.362, 32 and N=7.383.444, 98; of this point, it follows by margeoning the Camburu River or Tonga, by a distance of 1,648.47 m, until it reaches the coordinates point E=448.172, 75 and N=7.383.524, 31; of this point, it follows with general NE course, by a distance of 1,031.13 m, until it comes to the point of coordinates E=448.459, 64 and N=7.384.514, 73; of this point, it follows with general direction SE, by a distance of 1,164.68 m, until it reaches the point of coordinates E=449.578, 33 and N=7.384.190, 68; of this point, it follows with general course SO, by a distance of 681.23 m, until it reaches the point of coordinates E=449.388, 79 and N=7.383.536, 35, where the description of the Gas Treatment Unit of Caraguatatuba-UTGCA has started. This description is in accordance with the coordinate system in the Universal Transverse unit of Mercator-UTM, Datum horizontal 69, origin in Ecuador and Central Meridian 45º WGr, containing their respective constants in the value of 10,000 km "N" and 500 km "E", as per Planta DE-4300.43-6521-942-PEN-011.

Art. 2nd The PETROBRÁS, or company by it controlled, directly or indirectly, which comes to be in charge of the construction and operation of the transport and processing facilities of which it treats this Decree, shall be authorised to promote, with own resources, friendly or judicially, the disappropriation, total or partial, or the institution of administrative servitude of which it treats art. (I) may, including, invoke the character of urgency for purposes of provisional immission in the possession of the goods, pursuant to art. 15 of the Decree-Law no 3,365, of June 21, 1941, and of the Decree-Law no 1,075, of January 22, 1970.

Art. 3rd This Decree comes into effect on the date of its publication.
