DECREE NO. 4,015, OF November 13, 2001

Disposes on the implementation of the Third Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Republic Federative of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), from August 8, 200l.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas, based on the Treaty of Montevideo of 1980, the Economic Supplementation Agreement No. 39 was signed by the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), in Montevideo, in 11 of august 1999, and incorporated into the Brazilian legal planning by means of the Decree No. 3,138, of August 16, 1999;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, of the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), based on the Treaty of Montevideo of 1980, signed on November 15, 2000, in Montevideo, the First Additional Protocol to the Economic Supplementation Agreement No. 39, incorporated into the Brazilian legal planning by means of Decree No. 3,744, of February 5, 2001;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and of the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), based on the Treaty of Montevideo of 1980, signed on April 11, 2001, in Montevideo, the Second Additional Protocol to the Economic Supplementation Agreement No. 39, incorporated into the Brazilian legal planning by means of Decree No. 3,854, of June 29, 2001;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), based on the Treaty of Montevideo of 1980, signed on August 8, 200l, in Montevideo, the Third Additional Protocol, which aims to extend the term of the Economic Supplementation Agreement No. 39 by December 31, 2001, pursuant to Article 22 of the Original Protocol of the Economic Complentation Agreement No. 39;

D E C R E T A:

Art. 1º The Third Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Colombia, of the Republic of Ecuador, of the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community) of August 8, 2001, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º This Decree takes effect on the date of its publication.

Ecuador, Peru And Venezuela, Member States Of The Andean Community, And The Republic

Federative Of Brazil

Third Additional Protocol

The Plenipotentiaries of the Republics of Colombia, Ecuador, Peru and Venezuela, member states of the Andean Community, and of the Republic Federative of Brazil, duly authorized by their respective Governments, second powers presented in good and due form, deposited opportunely at the General Secretariat of the Latin American Integration Association (ALADI),

Considering the need to preserve and broaden existing trade currents between both Parties;

reaffirming the willingness to continue the negotiations of an economic supplementation agreement between the MERCOSUR member states and those of the Andean Community to create a free trade zone,

Concome in:

Single Article.-Extend, from August 16 to December 31 of 2001, the duration of the Economic Supplementation Agreement No. 39 and the paced preferences among its signatories.

If before December 31, 2001 an economic supplementation agreement between MERCOSUR and the Andina community, the Economic Supplementation Agreement No. 39, the preferences paced on the same and its Protocols, will lapse from its entry into force.

The General Secretariat of ALADI will be depositary of the present Protocol, of which it will send duly authenticated copies to the Signatary Parties.

In faith of what, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the eight days of the month of August two thousand and one, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
