DECREE OF March 18, 2009.

Outorga to Transmission Lines of the Itatim Ltda. concession for exploration of the public power transmission service electric, relative to Transmission Line Innocence-Single Island 2, in 230 kV, Double Circuit, and Transmission Line Innocence-Single Island 2, in 230 kV, Circuit 3, Transmission Line Plate-Innocence, in 230 kV, Double Circuit, Line of Transmission Chapadão-Innocence, at 230 kV, Circuit 3, Substation Innocence, at 230 kV, and Substation Chapadão, at 230 kV, and Substation Solfolio Island 2, at 440/230 kV, and Single Island Transmission Line-Single Island 2, in 440 kV, Double Circuit, in the states of Mato Grosso do Sul and São Paulo.

THE PRESIDENT OF THE REPUBLIC, in the use of assignment that confers you the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the Laws n^o 8,987, of February 13, 1995, n^o 9,074, of July 7, 1995, n^o 9,491, of September 9, 1997, and n^o 9,648, of May 27 of 1998, and what appears in the Process n^o 48500.003905 /2008-92,

DECRETA:

Art. 1^o It gets bestoed on Itatim Ltda Transmission Lines. concession for exploration of the service public power transmission by construction, operation, maintenance and other associated facilities required to the functions of measurement, supervision, protection, command, control, telecommunication, administration and support of the ventures Transmission line innocence-Single Island 2, in 230 kV, Double Circuit, and Transmission Line Innocence-Single Island 2, at 230 kV, Circuit 3, in the states of Mato Grosso do Sul and São Paulo, Line of Transmission Chapadão-Innocence, at 230 kV, Double Circuit, Chapadão Transmission Line-Innocence, at 230 kV, Circuit 3, Substation Innocence, at 230 kV, and Substation Chapadão, at 230 kV, in the State of Mato Grosso do Sul, and Substation Solfolio Island 2, at 440/230 kV, and Transmission Line Single Island-Single Island 2, at 440 kV, Double Circuit, in the State of Mato Grosso do Sul.

Paragraph single. The electrical power transmission ventures referred to in this article comprise, still, the deployment and magnification of the associated Substations as well as of the Sole Power Transmission Facilities of Generation Central for Connection Shared-ICG, connected to the Basic Network, according to § § 4º to the 8º of the art. 6º of Decree No. 2,655, of July 2, 1998, and of the Exclusive Interest and Individual Character Facilities of the Generation-IEG Central.

Art. 2^o The granting of which treats this Decree will be invigorated by the thirty-year term, counted from the date of signing of the respective Grant Contract of Electrical Power Transmission Public Service.

§ 1^o The Contract should be signed within thirty days, counted from the convocation made by the National Electrical Power Agency-ANEEL, under penalty of ineffectiveness of the concession ora outorgada.

§ 2^the Mediant application of the Transmission Lines of the Itatim Ltda. to ANEEL, presented up to thirty six months before the end of the caput constant deadline of this article, the concession may be extended under the conditions that are stipulated.

Art. 3^o Existing goods and installations in function of the electric power transmission service are linked to the public services granted, vetted to alienation, assignment, transfer or dation in warranty, without prior and express authorization from ANEEL.

Paragraph single. Fining the term of the concession, the goods and facilities linked to the provision of the service granted will revert to the Union, in the manner provided for in law and in the Grant Agreement.

Art. 4^o This Decree goes into effect on the date of its publication.
