DECREE OF June 11, 2010.

Creates the National Park of the Serra das Lontras, in the Municipalities of Arataca and Una, in the State of Bahia, and gives other arrangements

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution, with a view to the provisions of the art. 11 of the Law no 9,985, of July 18, 2000, in the Decree no 4,340 of August 22, 2002, and what appears in the Process at 02001.006944 /2005-29,

DECRETA:

Art. 1º Stay created the Park National of the Serra das Lontras, located in the Municipalities of Arataca and Una, in the State of Bahia, with the objectives of preserving its high biological richness, enabling the development of education and environmental interpretation activities, recreation in contact with nature and ecological tourism, as well as the development of scientific research.

of point 62, of c.p.a. 463608 E and 8333367 N, follows downstream by the right margin up to point 63, located on the west bank of BR-101; of point 63, of c.p.a. 464133 E and 8333584 N, follows in a straight line up to the point 58, start of the description of this perimeter, thus understanding the exclusion polygon of the damping zone and by perimeter an approximate perimeter of 138,103 meters.

Art. 4º Ficam allowed in the damping zone of the Serra das Lontras National Park the activities minerals authorized by the National Department of Mineral Production-DNPM and licensed by the competent environmental body up to the date of publication of this Decree.

Paragraph single. They may be allowed, within the limits of the unit's damping zone, mining ventures that obtain the authorizations of which treats the caput of this article after the publication of this Decree, respected the provisions of the manhandling plan of the unit, when there is.

Art. 5º The National Park of the Serra das Lontras will be run by the Chico Mendes Institute of Conservation of Biodiversity-Chico Mendes Institute, which is expected to adopt the necessary measures to its effective protection and deployment.

Art. 6º Ficam declared of public utility, for the purposes of misappropriation by the Chico Mendes Institute, the rural real estate of legitimate private domain and its benefits that come to be identified in the boundaries described in art. 2nd of this Decree, in the terms of the arts. 5th, paragraph? k?, and 6th of the Decree-Law no 3,365, of June 21, 1941.

§ 1º The Institute Chico Mendes is allowed to promote and execute the dispropriations of which it treats this article, and may, for the purpose of immission of possession, claim the urgency to which art relates. 15 of the Decree-Law no 3,365, from 1941.

§ 2º The Federal Attorney General, the organ of the Advocacy-General of the Union, through its legal unit of implementation with the Chico Mendes Institute, shall be authorized to promote the relevant administrative and judicial measures, aiming at the declaration of nullity of possible securities of property and respective real estate records considered irregular, incidents in the conservation unit of which it treats this Decree.

Art. 7º This Decree goes into effect on the date of its publication.
