DECREE NO. 7,194, OF 1º JUNE 2010.

Promulga the Basic Agreement of Technical Cooperation between the Government of the Federative Republic of Brazil and the Government of the Republic of Zambia, firming in Brasilia, on March 14, 2006

THE PRESIDENT OF THE REPUBLIC, at the use of the assignment that gives you the art. 84, inciso IV, of the Constitution, and

Whereas the Government of the Federative Republic of the Brazil and the Government of the Republic of Zambia celebrated, in Brasilia, on March 14, 2006, a Basic Agreement of Technical Cooperation;

Whereas the National Congress passed this Agreement through the Legislative Decree no 495, of July 17, 2009;

Considering that the Agreement entered into international force on January 28, 2010, pursuant to paragraph 1º of its Article 5;

DECRETA:

Art. 1º The Basic Agreement of Technical Cooperation between the Government of the Federative Republic of Brazil and the Government of the Republic of Zambia, firmed up in Brasilia, on March 14, 2006, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º Are subject to the approval of the National Congress any acts that may result in revision of the said Agreement, as well as any supplementary adjustments which, pursuant to art. 49, inciso I, of the Constitution, carries charges or gravy commitments to the national heritage.

Art. 3º This Decree comes into effect on the date of its publication.

BASIC AGREEMENT OF TECHNICAL COOPERATION BETWEEN

THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL

AND THE GOVERNMENT OF THE REPUBLIC OF ZAMBIA

The Government of the Federative Republic of Brazil

and

The Government of the Republic of Zambia

(henceforth named?Contracting Parties?),

In view of the interest to strengthen existing friendship ties between their peoples;

Considering the mutual interest in perfecting and stimulating the socio-economic development of their respective countries;

Convinced of the need to give emphasis to development sustainable;

Recognizing the advantages reciprocals resulting from technical cooperation in areas of common interest;

Wishes to develop the cooperation that stimulates technical progress,

Wake up the following:

ARTICLE I

Do Object

The present Agreement Basic of Technical Cooperation, henceforth called' Agreement ', has the object of promoting technical cooperation in the areas deemed to be given priority by the Contracting Parties.

ARTICLE II

From the relevant Authorities

1 .The Foreign Ministry of the Federative Republic of the Brazil and the Ministry of Foreign Affairs of the Republic of Zambia will be the institutions responsible for the coordination of all programs and cooperation projects under this Agreement.

2.The terms and conditions of the programs and projects identified in the framework of this Agreement will be completed through Supplemental Adjustments.

ARTICLE III

Of The Working Groups

1.As Contracting Parties should, where convier, establish working groups for the joint development of programs and cooperation projects in the framework of this Agreement.

2.Dentre the tasks of the groups of work include:

a) evaluate and define priority common areas in which the implementation of technical cooperation would be feasible;

b) establish mechanisms and procedures to be adopted by the Contracting Parties;

c) examine and approve Work Plans;

d) analyze, approve, and follow up with the implementation of the technical cooperation programs and projects; and

e) evaluate the results of the implementation of the programs and projects implemented in the framework of this Agreement.

3.The composition, agenda, time, place and date of the meetings of the working groups shall be agreed upon between the Contracting Parties by diplomatic means.

4.A Contracting Party that hosts the meeting will provide the venue and the administrative services necessary for its realization.

5.A Visiting Contracting Party will be responsible for the costs of your delegation regarding the trip, lodging and other possible expenses.

ARTICLE IV

From Confidentiality

Each of the Contracting Parties shall ensure that the documents, information and other knowledge obtained in due course implementation of this Agreement shall not be disclosed or passed on to third parties without the prior written consent of the other Contracting Party.

ARTICLE V

Da Input in Vigor, Duration and Denpronunciation

1.Cada Part Contractor notifies the other, by diplomatic way, of the fulfilment of the internal legal formalities necessary for the entry into force of this Agreement, which shall be effective from the date of receipt of the last of such notifications.

2.O this Agreement will be effective 5 (five) years, and shall automatically be extended by equal and successive periods, unless one of the Contracting Parties manifests, by diplomatic means, his intention to report it, with at least 6 (six) months in advance of its renewal automatic.

3.Em case of denunciation of the present Agreement, it will be up to the Contracting Parties to decide on the continuity or not of the activities that are under execution.

ARTICLE VI

Emendas

After the fulfillment of the internal legal formalities required for its entry into force, any modification to this Agreement is to be effected by means of exchange of Notes and will effective from the date of receipt of the last of these notifications.

ARTICLE VII

From the Resolution of Conflicts

The controversies arising in the implementation of the present Agreement will be drive amicably, through direct consultations between the Contracting Parties.

Made in Brasilia, on March 14 of 2006, in two (2) exemplars, in the Portuguese and English languages, being both texts being equally authentic.
