DECREE NO. 5,082, OF May 17, 2004.

Disposes on the execution of the Fourteenth Additional Protocol to the Economic Supplementation Agreement no 39, among the Governments of the Republic of Colombia, of the Bolivarian Republic of Venezuela, of the Republic of Ecuador and the Republic of Peru (member states of the Andean Community) and of the Federative Republic of Brazil, of March 10, 2004.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives him the art. 84, inciso IV, of the Constitution, and

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by the Government of the Federative Republic of Brazil on August 12, 1980 and approved by the National Congress, through the Legislative Decree no 66, of November 16, 1981, provides for the modality of Economic Supplementation Arrangement;

Whereas the Plenipotentiaries of the Republic of Colombia, the Bolivarian Republic of Venezuela, the Republic of Ecuador and the Republic of Peru (member states of the Andean Community) and of the Federative Republic of Brazil, based on the Treaty of Montevideo of 1980, have signed on August 12, 1999, in Montevideo, the Economic Supplementation Agreement no 39, between the Governments of the Republic of Colombia, the Bolivarian Republic of Venezuela, the Republic of Ecuador and the Republic of Peru (member states of the Andina community) and of the Federative Republic of Brazil, incorporated into the national legal planning by means of the Decree no 3,138, of August 16, 1999;

Considering that the Plenipotentiaries of the Republic of Colombia, the Bolivarian Republic of Venezuela, the Republic of Ecuador and the Republic of Peru (member states of the Community Andina) and of the Federative Republic of Brazil, based on the Treaty of Montevideo of 1980, signed on March 10, 2004, in Montevideo, the Fourteenth Additional Protocol to the Economic Supplementation Agreement no 39, among the Governments of the Republic of Colombia, of the Bolivarian Republic of Venezuela, the Republic of Ecuador and the Republic of Peru (member states of the Andean Community) and of the Federative Republic of Brazil;

DECRETA:

Art. 1st The Fourteenth Additional Protocol to the Economic Supplementation Agreement no 39, among the Governments of the Republic of Colombia, of the Bolivarian Republic of the Venezuela, the Republic of Ecuador and the Republic of Peru (member states of the Andean Community) and the Federative Republic of Brazil, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2nd This Decree goes into effect on the date of its publication.

ECONOMIC COMPLEMENTATION AGREEMENT No 39, SIGNED BETWEEN

REPUBLICS OF COLOMBIA, ECUADOR, PERU AND VENEZUELA, COUNTRIES-MEMBERS OF THE ANDINA COMMUNITY, AND THE REPUBLIC FEDERATIVE DO BRASIL

eleventh Additional Protocol

The Plenipotentiaries of the Republics of Colombia, Ecuador, Peru and Venezuela, Paises-Members of the Andina community, and of the Federative Republic of Brazil, duly authorized by their respective Governments, in accordance with the powers presented in good and due form, timely deposited in the General Secretariat of the Latin American Association of Integration (ALADI),

HAVING IN VIEW the Resolution No 003/04 of the III Commission Meeting ACE 39 administrator,

DECK IN:

Article -Increase to 100 percent the margin of preference that Brazil bestows to Peru for the product NALADI/SH (96) 7403.11.00 (Codes of copper and its elements).

Article 2nd-Increase at 100 percent the margin of preference that Peru outorates to Brazil for the product NALADI/SH (96) 3815.90.00 (Others) (only for Catalysts for oil craking).

Article 3rd-The preferences to which the preceding articles refer will enter into force bilaterally and de concurrent form on the date on which the Governments of Peru and Brazil have incorporated them into their domestic law.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly authenticated copies to the Signatary Parties

IN FÉ DO WHAT, THE RESPECTIVE PLENIPOTENTIARIES SIGN the present Protocol in the city of Montevideo, at the ten days from the month of March of year two thousand and four, in an original in the Portuguese and Spanish languages, being both texts being equally valid. By the Government of the Republic of Colombia: Claudia Turbay Quintero; By the Government of the Republic of Ecuador: Leonardo Carrión Eguiguren; By the Government of the Republic of Peru: William Belevan Mc Bride; By the Government of the Bolivarian Republic of Venezuela: Nancy Unda; By the Government of the Federative Republic of Brazil: Bernardo Pericás Neto.
