Decree No. 4239, of 21 MAY 2002 adopts provisions concerning the performance of the Sixteenth additional protocol to the agreement on Economic Complementation No. 36, between the Governments of the Federative Republic of Brazil, Argentina, the Republic of Paraguay and the Eastern Republic of Uruguay, (MERCOSUR), and the Government of the Republic of Bolivia, of 31 December 2001.
The PRESIDENT of the SUPREME COURT, in the exercise of the Office of the President of the REPUBLIC, using the allocation that gives the art. 84, section IV, of the Constitution, whereas the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI) signed by Brazil on August 12 1980 and approved by the National Congress through Legislative Decree No 66, of 16 November 1981, provides the Economic Complementation Agreement mode;
Whereas the Governments of the Federative Republic of Brazil, Argentina, the Republic of Paraguay and the Eastern Republic of Uruguay, States parties of MERCOSUR, and the Government of the Republic of Bolivia, signed on 17 December 1996, in Fortaleza, the agreement on Economic Complementation No. 36, under the terms of the Treaty of Montevideo of 1980, which has, among other the goal of conforming a free trade area between the signatory countries;
Whereas the agreement on Economic Complementation No. 36 was incorporated into the Brazilian legal system by Decree No. 2240, of 28 May 1997;
Whereas the Plenipotentiaries of the Federative Republic of Brazil, Argentina, the Republic of Paraguay and the Eastern Republic of Uruguay (MERCOSUR), of the one part, and the Republic of Bolivia, on the other, signed on 31 December 2001, in Montevideo, the sixteenth additional protocol to the agreement on Economic Complementation No. 36, which aims to extend until 31 March 2002 the transitional regime established source in the agreement;
D E C R E T a: Art. 1st Is promulgated, for all intents and purposes, the sixteenth additional protocol to the agreement on Economic Complementation No. 36, December 31, 2001 between the Governments of the Federative Republic of Brazil, Argentina, the Republic of Paraguay and the Eastern Republic of Uruguay, States parties of MERCOSUR, and the Government of the Republic of Bolivia, attached by copy to this Decree.
Art. 2 this Decree shall enter into force on the date of its publication.

MARCO AURÉLIO MELLO Osmar Chofi agreement on Economic Complementation No. 36 between the Governments of the States parties of MERCOSUR and the Government of the Republic of Bolivia Sixteenth additional protocol the Plenipotentiaries of the Republic Argentina, of the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, in its condition of States parties of the common market of the South (MERCOSUR) on the one hand, and the Republic of Bolivia, on the other, accredited by their respective Governments in accordance with powers that have been granted in good and due form, deposited in due course in the General Secretariat of the Latin American Integration Association (LAIA), with a view to Resolution MCS-BO No. 02/01 ACE administrator 36 the Commission should in: article 1-Extend from January 1 until March 31 2002 the special treatment provided for in Appendix 2 (a)), annex 9 of the Origin.
Article 2-Are excepted from the provisions of article before, to the relevant cases, the tariff positions listed in Appendix 3 of the MCS-Resolution 4/00 Revised BO, for which there is the special scheme.
Article 3-Apply from January 1 until March 31 2002 the special treatment provided for in Appendix 2, point (b)), annex 9 of the origin deleted items NALADI/SH 6205.20.00 and 6205.30.00, for which if extending the Transitional Regime of origin until the same date.
The ALADI General Secretariat is depository of this Protocol, which shall send certified copies to the signatory Governments.
In witness whereof, the respective Plenipotentiaries signed this Protocol in Montevideo, Uruguay, at the age of thirty-one days of December 2001, in an original Portuguese and Spanish languages, both texts being equally valid.
