DECREE NO. 6,213, OF September 26, 2007.

Disposes on the execution of the QuadragumSeventh Additional Protocol to the Economic Supplementation Agreement no 35, among the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and the Republic of Chile, of August 13, 2007.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, and

Whereas the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by Brazil on August 12, 1980, and approved by the National Congress through the Legislative Decree no 66 of November 16, 1981, provides for the modality of Complementation Agreement Economic;

Considering that the Chancellors of the States Parties to Mercosur and Chile, with basis in the Treaty of Montevideo of 1980, signed on June 25, 1996, in San Luis, Argentina, the Economic Supplementation Agreement between Mercosur and Chile, promulgated by the Decree no 2,075, of November 19, 1996;

Considering that the Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and the Eastern Republic of Uruguay, in its condition of States Parties of Mercosur, on the one hand, and of the Republic of Chile, on the other, on the basis of the Treaty of Montevideo of 1980, signed, on August 13, 2007, in Montevideo, the Quadragth Seventh Additional Protocol to the Economic Supplementation Agreement no 35, between the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and the Republic from Chile;

DECRETA:

Art. 1st The Seventeenth Additional Protocol to the Economic Supplementation Agreement no 35, among the Governments of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and of the Republic of Chile, of August 13, 2007, apensed by copy to the present Decree, shall be executed and fulfilled as entirely as therein.

Art. 2nd This Decree goes into effect on the date of its publication.

ECONOMIC COMPLEMENTATION AGREEMENT No 35 CELEBRATED AMONG THE

GOVERNMENTS OF THE STATES PARTIES TO MERCOSUR AND THE GOVERNMENT

OF THE REPUBLIC OF CHILE

Quadragumteenth Additional Protocol

The Plenipotentiaries of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, in their condition of States Parties to the Common South Market (MERCOSUR), on the one hand, and of the Republic of Chile, on the other, accredited by their respective Governments second powers bestowed in good and due form, deposited opportunely at the General Secretariat of the Latin American Association of Integration (ALADI),

HAVING IN VIEW OF MCS-CH Resolution No 01/2007, emanating from the X Meeting Ordinary of the ACE Administrative Commission No 35 MERCOSUL-Chile, held on the days 3 and May 4, 2007, in the city of Montevideo, Uruguay,

CONVVE IN:

Article 1st-Eliminate of Appendix No 1, letter B, of Annex 13 to the Economic Supplementation Agreement No 35, the NALADI/SH 7324 position, by staying that position subject to the General Origin Regime provided for in Article 3 of Annex 13 to the Agreement.

Article 2nd-The present Protocol will enter into force bilaterally between the Signatary Parties that have communicated to the General Secretariat of the ALADI that incorporated it into its domestic law in the terms of its respective legislations. The General Secretariat of ALADI will inform the respective Signatary Parties for the bilateral effective date.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly authenticated copies to the signatory Governments.

IN FÉ DO WHAT, THE RESPECTIVE PLENIPOTENTIARIES SIGN the present Protocol, in the city of Montevideo, at the thirteen days of the month of August two thousand and seven, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
