DECREE NO. 4,655, OF March 27, 2003.

Approves the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and Gratified Functions of the Ministry of Assistance and Social Promotion, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that gives him the art. 84, incisos IV and VI, paragraph "a" of the Constitution, and with a view to the provisions of the arts. 47 and 50 of the Provisional Measure n ° 103, 1º January 2003,

DECRETA:

Art. 1 ° Stay approved the Regimental Structure and the Demonstrative Framework of Cargos in Commission and Functions Gratified from the Ministry of Assistance and Social Promotion, in the form of the Annexes I and II to this Decree.

Art. 2 ° In due to the provisions of the art. 1º, stay remanded, in the form of Annex III to this Decree, the following posts in committee of the Group-Direction and Superiors-DAS:

I-from the Ministry of Social Welfare to the Registry of Management, of the Ministry of Planning, Budget and Management: two DAS 101.6; five DAS 101.5; eleven DAS 101.4; eleven DAS 101.3; one DAS 101.2; twenty DAS 101.1; two 102.4; eleven DAS 102.2; and seven DAS 102.1; and

II-from the Registry of Management, of the Ministry of Planning, Budget and Management, for the Ministry of Assistance and Social Promotion: three DAS 101.6; thirteen DAS 101.5; forty-seven DAS 101.4; thirty-three DAS 101.3; nine DAS 101.2; ten DAS 101.1; five 102.5; nine 102.4; twenty-six DAS 102.3; twenty-six DAS 102.2; and one DAS 102.1.

Art. 3 ° The apostilings arising from the approval of the Regimental Structure of which it treats art. 1st should occur within thirty days, counted from the date of publication of this Decree.

Single paragraph. After the apostilaments provided for in the caput, the Minister of State for Assistance and Social Promotion will make publishing, in the Official Journal of the Union, within thirty days, counted from the date of publication of this Decree, nominal relation of the holders of the posts in committee of the Group-Direction and Superiors Superiors-DAS, referred to in Annex II, indicating, including, the number of vacant posts, their denomination and their respective level.

Art. 4 ° The internal regiment of the Ministry of Social Assistance and Promotion shall be approved by the Minister of State and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 5 ° This Decree comes into effect on the date of its publication.

ANNEX I

REGIMENTAL STRUCTURE

MINISTRY OF ASSISTANCE AND PROMOTION SOCIAL

CHAPTER I

OF THE NATURE AND COMPETENCES

Art. 1º The Ministry of Welfare and Social Promotion, the organ of the Public Administration Direct Federal, has as areas of competences the following subjects:

I-national welfare policy;

II-standardization, guidance, supervision and evaluation of the implementation of the assistance policy Social;

III-orientation, monitoring, evaluation and supervision of plans, programs and projects concerning the area of social assistance;

IV-articulation, coordination and evaluation of government social programs Federal;

V-management of the National Social Assistance Fund; and

VI-approval of the general budgets of the Social Service of Industry-SESI, of the Social Service of Trade-SESC and the Social Service of Transport- SEST.

CHAPTER II

OF THE ORGANIZATIONAL STRUCTURE

Art. 2º The Ministry of Assistance and Social Promotion has the following structure organizational:

I-bodies of direct and immediate assistance to the Minister of State:

a) Cabinet;

b) Department of Management of the National Social Assistance Fund;

c) Executive Secretariat: Undersecretariat of Planning, Budget and Administration; and

d) Legal Consulting;

II-specific bodies:

a) Secretary of Assistance Policies Social:

1. Department of Social Care Policy Development; and

2. Department of Monitoring Social Assistance Policies;

b) Office of the Evaluation of Social Programs:

1. Department of Monitoring and Monitoring Social Programs;

2. Department of Social Programs Evaluation; and

3. Department of Information Development and Social Data;

c) Office of the Articulation of Social Programs:

1. Department of Public Sector Articulation;

2. Department of Articulation with the Private Initiative; and

3. Department of Articulation with International Organisms;

III-decentralized units: Regional Offices; and

IV-collegiate bodies:

a) National Council on Social Assistance; and

b) Council of Articulation of Social Programs.

CHAPTER III

OF THE COMPETENCE OF THE ORGANS

Section I

Of the Direct and Immediate Assistance Bodies to the Minister of State

Art. 3rd To the Cabinet of the Minister competes:

I-attend the Minister of State in his political and social representation, occupy himself with the relations public and the preparation and dispatch of your personal expedient;

II-follow the progress of the Ministry's projects of interest, in tramway in the National Congress;

III-provide for the fulfillment of the consultations and the requirements formulated by the National Congress;

IV-provide for the official publication and the dissemination of the subjects related to the acting area of the Ministry;

V-planning, coordinating and overseeing the development of the Ministry's media activities; and

VI-advise the Minister of State in the approval of the general budgets of SESI, the SESC and the SEST.

Art. 4th To the Department of Management of the National Social Assistance Fund competes to plan, coordinate, execute and control the utilization of the resources that make up the National Social Assistance Fund, under guidance and control of the National Board of Social Assistance.

Art. 5th To the Executive Secretariat competes:

I-assist the Minister of State in the definition of guidelines and programs and in the implementation of actions of the area of competence of the Ministry;

II-assist the Minister of State in the supervision and coordination of the activities of the Ministry's integral Secretaries;

III-supervising and coordinating, within the Ministry's scope, activities related to the federal planning, budget, accounting, financial administration, organization systems and administrative modernization, administration of information and informatics resources, of human resources and general services;

IV-supervising disciplinary and correctional activities developed within the Ministry and its decentralized units; and

V-advising the leaders of the Ministry's bodies in formulating collaborative strategies with the bodies international financial.

Single paragraph. The Executive Secretariat exercises, still, the role of the sectoral body of the Civil Personnel Systems of the Federal Administration-SIPEC, of Organization and Administrative Modernization-SOMAD, of Information Resources Administration and Informatics-SISP, of General Services-SISG, and of Planning and Federal Budget, of Federal Accounting, of Federal Financial Administration through the Sub-Secretariat of Planning, Budget and Administration, to her subordinate.

Art. 6th To the Subsecretariat of Planning, Budget and Administration competes:

I-plan and coordinate, within the Ministry, the execution of the activities related to the federal systems of human resources, general services, organization and administrative modernization, administration of information and informatics resources, planning and budget, accounting and financial administration;

II-promote the articulation with the central bodies of the federal systems referred to in the previous inciso and inform and guide the organs of the Ministry as to the compliance with established administrative standards;

III-promote the elaboration and consolidation of the plans and programs of the activities of their area of competence and submit them to the decision higher;

IV-coordinate the elaboration and consolidation of the plans and programs of the Ministry's finalistic activities, their budgets and changes, and submit them to the top decision;

V-follow up and promote the evaluation of projects and activities;

VI-develop, within the framework of the Ministry, the enforcement activities budgeting, financial and accounting; and

VII-carry out account-taking of the expense-payers and too much responsible for public goods and values and of all the one that gives cause to loss, stray or wrongdoing that results in damage to the erarium.

Art. 7º À Legal Consultancy, the sectoral organ of Advocate General of the Union, competes:

I-advise the Minister of State in matters of a legal nature;

II-exercise the supervision of the legal activities of the Ministry;

III-fix the interpretation of the Constitution, of laws, of treaties and too much normative acts to be uniformly followed in their areas of acting and coordination, when there is no normative orientation of the Union Advocate General;

IV-draw up studies and prepare information by request of the Minister of State;

V-watch the Minister of State in the internal control of the administrative legality of the acts to be by him practiced or already effective, and of those arising from organs or entities under his legal coordination; and

VI-examine preview and conclusively, within the Ministry:

a) the edital texts of bidding with the respective congenneric contracts or instruments, to be published and celebrated; and

b) the acts by which one is going to recognize the unchargeability, or decide the dispensation, of bidding.

Section II

Of the organs Specific Individuals

Art. 8º To the Office of Social Assistance Policies competes:

I-attend the Minister of State in the formulation and coordination of the National Social Assistance Policy;

II-coordinate, implement, follow up and control the programs and projects concerning the National Assistance Policy Social, in conjunction with the States, the Federal District the Municipalities and private entities;

III-promoting the normatization of the National Social Assistance Policy;

IV-coordinate the implementation of the strategic actions of the National Social Assistance Policy;

V-follow up implementation and the development of state, municipal and social welfare network management;

VI-supporting technically the states, the Federal District and the Municipalities in the implementation of forum, council and social assistance fund, at a local level;

VII-coordinate the deployment of the decentralized and participatory system structure of Social Assistance, concerning the elaboration of Plans of Social Assistance; and

VIII-promoting and defining the empowerment of advisors, managers, managers and technicians involved with the policies implemented and coordinated by the Ministry; and

IX-promoting studies and researches necessary to the process of planning, implementing and normatizing social policies.

Art. 9th Ao Department of Social Assistance Policy Development competes:

I-promoting studies and research necessary to the process of planning, implementing and normatization of the Policy National Social Assistance;

II-coordinate the deployment of decentralized and participatory system of social assistance, with regard to the elaboration of municipal action plans and state;

III-support technically and follow up the development of state and municipal management of social assistance, including with regard to the implementation of forum, board and of social assistance fund at a local level; and

IV-set guidelines and norms of implementation of the National Social Assistance Policy.

Art. 10. The Department of Monitoring Social Assistance Policies competes:

I-promote the monitoring and evaluation of the National Social Assistance Policy;

II-promote the development of social policy evaluation system with views to subsidize the decision-making process in regard to the public policies implemented or coordinated by this Ministry;

III-carry out the mapping and enrollment of existing social policies;

IV-promote diagnostics studies social and support the development of new social policies of the government;

V-coordinate the specific diagnostic elaboration of the social area;

VI-promoting the systematic qualification of advisors, managers, managers and technicians involved with the policies implemented and coordinated by the Ministry;

VII-define guidelines and parameters to be used in the empowerment of social actors; and

VIII-promoting the technical enablement of managers state and municipal of social assistance.

Art. 11. The Social Programs Evaluation Office competes:

I-promoting studies and research for the implementation of programs and projects concerning social assistance;

II-promote the evaluation of programs and projects of the National Social Assistance Policy;

III-promote the systematic qualification of advisors, managers, managers and technicians involved with the policies implemented and coordinated by the Ministry;

IV-stimulate the implementation of local plans, programs, and projects innovators of impact for the development of social policies; and

V-coordinate the development of the social care network.

Art. 12. The Department of Social Programs Monitoring and Monitoring competes:

I-support technically and follow up on the development of the social care network;

II-follow up and monitor the implementation of the programs and social assistance projects;

III-monitor and follow up indicators for afferition of the results of the programs and capacity-building projects implemented.

Art. 13. The Department of Social Programs Evaluation competes:

I-promoting the institutional and socio-economic impact assessment of social programs;

II-elaboration and promote the approval of the director plan for evaluation of social programs;

III-promote the drafting of evaluation plans specific to the social programs; and

IV-systematization and disseminate studies and information from social program evaluations.

Art. 14. To the Department of Information Development and Social Data competes:

I-develop and update the federal government's single income transfer enrollment;

II-develop decentralized enrollment update mechanisms;

III-make the Single Cadastro available for all social programs of the federal, state, and municipal governments;

IV-develop new focusing technologies for social programs;

V-accomplish the mapping and enrollment of all social data sources, disseminating the information to Brazilian society and the international community;

VI-implement, maintain and make the single enrollment available to the social programs of the federal, state, and municipal governments; and

VII-carry out the lifting of social data for the third sector and governments locations.

Art. 15. The Office of the Articulation of Social Programs competes:

I-coordinate the process of articulation of social policies;

II- promote the intra-, intergovernmental and intersectoral articulation necessary to the compatibilization of policies, plans, programs and projects concerning social assistance policies;

III- formulate and implement institutional strengthening strategies and mechanisms of the Ministry;

IV-promote the articulation of the federal welfare policies of the federal government with the diverse spheres of government, private sector and nongovernmental organizations with views to compatibilize policies and optimize resource allocation;

V-promoting articulation with organisms international; and

VI-propose and promote mechanisms of participation and social control of social care actions.

Art. 16. The Public Sector Articulation Department competes:

I-coordinate the process of articulation of social policies and integrate governmental social actions at the federal, state, and municipal and track its implementation;

II-promoting the institutional articulation for the improvement of the mechanisms of decentralization of welfare policies;

III-support technically the participation of the Ministry in collegiated bodies and forums concerning the subjects of its area of competence; and

IV- identify opportunities for integration of actions and programs developed by the Ministry, by the remaining federal bodies, by the states, the Federal District and Municipalities.

Art. 17. The Department of Articulation with the Private Initiative competes:

I-articulating relations with civil society organizations, including councils, forums, confederations and associations, so as to favour the compatibilization of policies, plans, programmes and projects concerning social policies;

II-articulate the social policies implemented to the actions developed by the civil society, with views to optimize the allocation of resources and generate greater benefits to citizens;

III-identify opportunities for integration of actions and programs developed by the Ministry and by non-governmental institutions; and

IV-fostering participation and social control in social care actions.

Art. 18. The Department of Articulation with International Organisms competes:

I-articulating relations with international funding bodies and fomenting, seeking alternative sources of resources for the development of social policies;

II-articulate technical cooperation agreements with international bodies, so as to promote the exchange of experiences, empowerment technique and the enhancement of the mechanisms of formulation, social participation and evaluation of social policies;

III-promote and coordinate the insertion of the Ministry into the international forums of discussion of social issues;

IV-identify opportunities for integration of actions and programs developed by the Ministry and by international bodies; and

V-support technically the Ministry in the activities regarding the celebration of international technical and financial cooperation agreements.

Section III

Units Decentralized

Art. 19. The Regional Offices compete to coordinate, guide and control, in their area of jurisdiction, the execution of the activities related to assistance and social promotion.

Section IV

Of the organs Collegiated

Art. 20. To the National Council for Social Assistance, set up by Law No. 8,742 of December 7, 1993, it is up to exercise the competences set out in specific regulation.

Art. 21. To the Council for the Articulation of Social Programs, set up by the Provisional Measure no 103, from 1º January 2003, it is up to exercise the competencies set out in specific regulation.

CHAPTER IV

DAS ASSIGNMENTS OF THE LEADERS

Section I

From the Executive Secretariat

Art. 22. The Executive Secretary is to:

I-coordinate, consolidate and submit to the Minister of State the Ministry's overall plan of action;

II-supervise and evaluate the execution of the Ministry's projects and activities;

III-supervise and coordinate the articulation of the contral organs of the systems affections to the area of competence of the Secretariat-Executives; and

IV-exercise other assignments that are committed to it by the Minister of State.

Section II

Of The Secretaries and Too Leaders

Art. 23. To the Secretaries, the Chief Minister's Office, the Legal Adviser, the Undersecretary, the Directors and the other leaders it is incumbent on planning, directing, coordinating and directing the implementation of the activities of the respective units and to exercise others assignments that are committed to them in their areas of competence.

CHAPTER V

OF THE GENERAL PROVISIONS

Art. 24. The internal regiment will define the detailing of the integral bodies of the Regimental Structure of the Ministry of Promotion and Social Assistance, the competencies of the respective units and the assignments of their leaders.
