DECREE OF September 27, 2001.

Creates the Reserva Extractivist Navy of the Lagoon of the Jequiá, in the Municipality of Jequiá da Praia, State of Alagoas, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers him the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the art. 18 of the Law n^o 9,985, of July 18, 2000, and in the Decree n^o 98,897, of January 30, 1990,

DECRETA:

Art. 1^o It is created the Reserve Extractivist Reserve of the Jequiá Lagoa, in the Municipality of Jequiá da Praia, in the State of Alagoas, with the objectives of ensuring the sustainable use and conservation of renewable natural resources, protecting the means of life and the culture of the local extractivist population.

Art. 2^o The Marine Extractivist Reserve of the Jequiá Lagoon covers an area of approximately 10,203.90 ha, being a part in mangrove grounds and part of Brazilian territorial waters, with its delimitation based on the MI-1599 Folha, MI-1600 and MI-1668, published by the Department of Cartography of the Brazilian Institute of Geography and Statistics, with the following descriptive memorial: departing from Point 1, of approximate geographical coordinates 09º56 ' 28.00 "S and 35º57" 42.57" Wgr, located over the coast line at the mouth of the Taboado Riacho, follows by the shoreline in the southwest direction, by a approximate distance of 14,712.60 meters, accompanying the line of maximum preamar, up to Point 2, of approximate geographical coordinates 10º02?59.90 " S and 36º01?53.38 " Wgr, located on the left bank of the mouth of the Jequiá River, in the locality of Barra do Jequiá; hence, it follows, by the left bank of the River Jequiá, in the upstream sense, accompanying the boundary of the mangrove land zone, by a distance approximate 6,975.56 meters, up to Point 3, of coordinates 10º00?18.94 " S and 36º01?20.23" Wgr, where the Lagoa do Jequiá meets the River Jequiá, on its left margin; hence, follows bypassing the Lagoon, over the margin line, by an approximate distance from 10,354.66 meters, up to Point 4, of approximate geographical coordinates 09º56?19.43 " S and 36º01?13.47" Wgr, located at the mouth of the North River, when this dewatering in the Lagoon of the Jequiá; hence, follows by following the boundary of the Lagoon, by a distance approximate 6,242.98 meters, up to Point 5, located together at the mouth of a non-denomination, approximate geographical coordinates 09º54?58.33 " S and 36º02?19.06" Wgr; hence, follows margeing the boundary of the land zone of the Jequiá Lagoa, by a approximate distance of 1,351.30 metres, up to Point 6, of approximate geographical coordinates 09º54?57.85 " S and 36º03?46.09" Wgr, located at the mouth of stream d?water without denomination; hence, it follows always marching the Lagoon of the Jequiá, accompanying the boundary of the land area, by approximate distance of 9,633.37 metres, up to Point 7, of approximate geographical coordinates 09º56?34.61 "S and 36º03?02.35" Wgr, located at the mouth of a brook without denomination; hence, follows by accompanying the boundary of the zone ground, by a distance of approximately 5,343.68 meters, up to Point 8, of approximate geographical coordinates 09º56?01.43 " S and 36º04?32.06" Wgr, located in the de-icing of the Taquari River with the Lagoon of the Jequiá; follows by marching the Lagoon of the Jequiá, accompanying the boundary of the land zone, by an approximate distance of 9,402.37 meters, up to Point 9, of approximate coordinates of 09º55?59.25 " S and 36º06?27.42" Wgr, located on the right bank of the mouth of the Jequiá River, when this dewatering in the Lagoon of the Jequiá; hence, it follows by an approximate distance of 15,233.31 metres, accompanying the boundary of the land zone, up to Point 10, of approximate coordinates 10º00?15.11 " S and 36º01?27.22" Wgr, located in the de-icing of the Jequiá Lagoon over the right bank of the River Jequiá; hence, it follows by accompanying the boundary of the mangrove land zone, on the right bank of the River Jequiá, in the downstream sense, by an approximate distance of 7,331.35 meters, up to Point 11, of approximate geographical coordinates 10º03?16.93 "S and 36º02?05.65" Wgr, located at the mouth of the Jequiá River, when this de-icing in the Atlantic Ocean, at the site called the Bar of the Jequiá; hence, follows a 129º26?19, 68" azimuth line and approximate distance of 5,482.25 meters, up to the Point 12, located in Brazilian territorial waters at a distance of 3 nautical miles from the shoreline; hence, it follows in the northeast direction, by a approximate distance of 15,590.42 meters, maintaining an equidistance of 3 nautical miles from the line of coast, up to Point 13, of approximate geographical coordinates 09º58?09.91 "S and 35º55?09.78?" Wgr; hence, it follows by a 303º56?36, 89 "azimut line" and approximate distance of 5,609.34 meters, up to Point 1, point starting from this descriptive.

Art. 3^o Caberá to the Brazilian Institute of the Environment and Renewable Natural Resources-IBAMA overseeing the area of which it treats this Decree, promote the necessary measures to the formalization of the actual concession contract of free use with the traditional extractivist population, for the purpose of their celebration by the Ministry of Planning, Budget and Management, pursuant to Decree No. 3,125 of July 29, 1999, and follow up with compliance with the conditions stipulated therein.

Art. 4^o This Decree takes effect on the date of its publication.
