DECREE OF November 12, 2010

Declara of public utility, for the purposes of misappropriation, in favor of the dealership Autopista Ferno Dias S.A., the immovable property that mentions, located in the Municipality of Joyous Landing, in the State of Minas Gerais, necessary to the execution of the deployment works of the Operational Control Center-CCO on the Highway Ferno Dias, 381/MG.

The VICE PRESIDENT OF THE REPUBLIC, in the exercise of the post of PRESIDENT OF THE REPUBLIC, using the assignment that gives it the art. 84, inciso IV, of the Constitution, in accordance with the provisions of the arts. 3º, 5º, points ("h" and "i", and 6º of the Decree-Law No. 3,365, of June 21, 1941, 29, inciso VIII, and 31, inciso VI, of Law No. 8,987 of February 13, 1995, and what appears in the ANTT Process in the 50500.071278 /2009-45,

D E C R E T A:

Art. 1º Become declared of public utility, for the purposes of dispropriation, in favor of the Autopista Ferno Dias S.A., the real estate covered and delimited by the topographical coordinates described below, adjacent to the Highway Ferno Days, BR- 381 /MG, necessary for the execution of the deployment works of the Operational Control Center-CCO, in Joyous Landing / MG:

I-area enrolled under the number 38,828 of the Joyous Landing CRI / MG: begins this description at point 05-A, determined by the intersection of the common divisa between real estate corresponding to the enrolment No. 38,828 and No. 67,047 of the Landing CRI Allegre/ MG and the domain track of the Highway Ferno Days, 381/MG; of this point, follows with azimuth of 114º11'36 '' in a distance of 50.01 metres, until I find the point 15, confronting with the immovable described in the matriculate in the 67,047 of the Joyful Landing CRI / MG; hence deflects the right with the AZ 119º04 '28' ' in a distance of 67.93 metres, until you find the point 16, confronting with the lotheter Ferno Dias; hence deflect right with the AZ 206º56 '40' 'in a distance of 51.16 metres, until I find the point 17, confronting with the same lotement; hence deflects right with the AZ 292º11'38' 'in a distance of 28.89 metres, until you find the point 18; hence deflect right with the AZ 292º51'54' ' in a distance of 95.79 metres, until you find the point 01, confronting from point 17 to point 01 with Posto Mavesa or successors; hence deflect right with the azimute from 28º to 50 '04' ' in a distance of 4.05 metres, until you find the point 02; hence deftly left with the AZ 28º 01'52 '' in a distance of 5.70 metres, up to point 03; hence deflect right with the AZ 28º28 '19' 'in a distance of 26.64 metres, until you find the point 04; hence deflect right with the AZ 36º29' 17 '' in a distance of 16.15 metres, until you find the point 05; hence deflect right with the AZ 46º15 '05' ' in a distance of 8.68 metres, until you find the point 05-A, point this where it had inception and finda the present perimetric description, confronting from point 01 to point 05-A with the track of domain of Highway Ferno Dias, BR-381 /MG, ending a surface area of 7,006.83 m² (seven thousand and six square meters and eighty-three square decimeters), being that the area described here corresponds to the entirety of the tuition in the 38,828 of the Merry / MG Landing Real Estate Registration Office, as per plant DE-05-381/MG-850-5-D03-501-rev0; and

II-area enrolled under the number 67,047 of the Joyous Landing CRI / MG: begins this description at point 05-A, determined by the intersection of the common divisa between real estate corresponding to the enrolment No. 38,828 and No. 67,047 of the Allegre/MG Landing CRI and the domain strip of the Highway Ferno Days, BR-381 /MG; of this point, follows with azimut 46º15 '05' ' in a distance of 4.79 metres, until it finds the point 06, confronting with the Highway Ferno Days, 381/MG; hence deflect right with the AZ 57º24 '39' 'in a distance of 10.67 metres, until you find the point 07; hence deflect the right with the AZ 64º25' 25 '' in a distance of 10.43 metres, until you find the point 08; hence deflete the right with the AZ 74º15 '29' in a distance of 10.63 metres, until you find the point 09; hence deflect right with the AZ 77º35 '08' 'in a distance of 25.89 metres, until you find the point 10; hence deflete the left with the AZ 76º05' 40 '' in a distance of 6.78 metres, until you find point 11; hence deflete the left with the AZ 70º25 '59' 'in a distance of 8.94 metres, until you find the point 12; hence deflect right with azimute 123º21'07' ' in a distance of 2.64 metres, until you find the point 13, confronting from point 05-A up to point 13 with the domain strip of the Highway Ferno Days, 381/MG; hence deflect right with the AZ 210º38 '58' 'in a distance of 27.63 metres, until you find the point 14; hence deflect right with the AZ 214º12' 04 '' in a distance of 26.48 metres, until you find the point 15, confronting from point 13 to point 15 with the lotion Ferno Dias; hence deflect the right with the AZ 294º11'36 '' in a distance of 50.01 metres, until you find the point 05-A, confronting with the immovable described in the tuition No. 38,828, of the Joyful Landing CRI / MG, point this where it had inicio and finda the present perimetric description, ending a surface area of 1,648.98 m² (one thousand, six hundred and forty eight square meters and ninety-eight decimeters squares), being that the area described here corresponds to the entirety of the tuition at the 67,047 of the Joyful Landing / MG Real-estate Registration Office, as per plant DE-05-381 / MG-850-5-D03-501-rev0.

Art. 2º Stay the Autopist Ferno Dias S.A. dealership authorized to promote the dispropriation of the said areas of land and benfeits, of which it treats art. 1º, with own resources, in the form of the prevailing legislation and regulations.

Single paragraph. The expropriating shall be permitted to invoke the character of urgency in the process of dispropriation, for the purposes of impropriation of possession, of the areas of land and benfeits covered by this Decree, pursuant to art. 15 of the Decree-Law No. 3,365, of June 21, 1941.

Art. 3º This Decree enters into vigour on the date of its publication.
