DECREE OF 1º OF JUNE OF 2005

Declaration of social interest, for the purposes of agrarian reform, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of Supplementary Law No. 76 of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964 and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Without Denomination", with recorded area of two hundred and fifty hectares, and measured area one hundred and twenty-six hectares, ninety and four airs and ninety-eight centials, situated in the Municipality of Monte Santo, object of the Registry in the R-1-3.601, fls. 54, Book 2-A-11, of the Estate Registration Card of the Comarca of Monte Santo, State of Bahia (Process INCRA/SR-05/nº 54160.002611 /2003-30) ;

II-"Rancho farms Alegre, São José and Without Denomination", with registered area of trezent and thirty-two hectares, and measured area of three hundred and five hectares, twenty-seven airs and ninety and two centiars, situated in the Municipality of Monte Santo, object of the Records in the R-1-2.930, fls. 135, Book 2-A-6 ; R-2-403, fls. 307, Book 2-A ; and R-1-2.761, fls. 151, Book 2-A-6, of the Estate Registration Card of the Comarca of Monte Santo, State of Bahia (Process INCRA/SR-05/nº 54160.003498 /2004-91) ;

XII-"Gleba I-Good Cica and Gleba III-Picada of the Line", with area of a thousand, ninety-nine hectares, six airs and sixty centiars, situated in the Municipality of Touros, object of the Registrars in the R-1-1.990, fls. 64v, Book 2-M ; and R-1-1.992, fls. 65v, Book 2, of the Notarial and Registral Service of the Touros Comarch, State of Rio Grande do Norte (Process INCRA/SR-19/nº 54330.000242 /98-13) ;

XIV-"Farm Mata Blue", with area of four thousand, two hundred and eighty and seven hectares and ninety centiars, situated in the Municipalities of Little and Itaporan, object of the Matricles in the 86, fls. 87, Book 2-A ; 88, fls. 89, Book 2-A ; and 99, fls. 100, Book 2-A, of the Real Estate Registration Office of the Colmenia Comarca, State of the Tocantins (Process INCRA/SR-26/nº 54400.001024 /2004-34) ; and

XV-"Farm Matão", with area of a thousand, two hundred and seventy three hectares, fifty and three airs and fifty-eight centiars, situated in the Municipalities of Porto National and Ipueiras, object of the Registration in R-1-10.120, Book 2, of the Estate Registration Office of the National Port Comarca, State of the Tocantins (Case INCRA/SR-26/nº 54400.000792 /2004-71).

Art. 2º Delete from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in art. 1º and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute for Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Act No. 76 of July 6, 1993, and to maintain the areas of Legal reservation and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree shall enter into force on the date of its publication.
