Declaration of public utility, for the purposes of misappropriation, total or partial, or of institution of administrative servitude of passage, in favor of Brazilian Petroleum S.A. -PETROBRAS, the real estate you mention, situated in the Municipalities of Itaboraí and Maricá, State of Rio de Janeiro, necessary for the construction of the Inland Waterway of Industrial Efluents of the Petrochemical Complex of Rio de Janeiro-Comperj, and gives others provider.

Art. 1º Stay declared of public utility, for the purposes of dispossession, total or partial, or of institution of administrative servitude of passage, in favor of Brazilian Petroleum S.A. -PETROBRAS, or of society by this controlled, directly or indirectly, which comes to be in charge of the construction, installation and operation of the refining and production units of petrochemicals, real estate constituted of land and benfection, of private property, excluded the public domain goods, understood in the areas and lanes of land located in the Municipalities of Itaboraí and Maricá, State of Rio de Janeiro, whose administrative restrictions are indispensable to the construction of the Submission Submarine of Industrial Efluents of the Petrochemical Complex of Rio de Janeiro-Comperj, included the complementary facilities.

Art. 3º PETROBRÁS, or Company by it controlled, directly or indirectly, is authorized to promote, with own resources, amicable or judicially, the misappropriation, total or partial, or the institution of administrative servings of passage, in case of that will be compensated, when cabin, the values already compensated in the perpetual servings of passage instituted in favor of PETROBRAS over the area of land of which it treats this Decree, and may, including, invoke the urgency character for the purposes of provisional immission in possession of the goods, pursuant to art 15 of Decree-law No. 3,365 of June 21, 1941 and of Decree-law No. 1,075 of January 22, 1970.

Art. 4º The declaration of public utility that treats this Decree does not exonerate the concessionary of prior obtaining of the licensing and fulfilment of the obligations to the environmental entities and other bodies of the public administration, necessary to the effectivation of the works and activities referred to in the arts. 1º and 2º.

Art. 5º It Shall Be for PETROBRÁS to shoulder the expenses arising from the implementation of the provisions of this Decree, as well as the administrative arrangements laid down in Decree-Law No. 9,760 of September 5, 1946, before the Union's Office of Heritage of the Union Ministry of Planning, Budget and Management and the registration of competent real estate.
