DECREE NO-7,938, DE February 19, 2013

Amend the Decree No. 6,275 of November 28, 2007 approving the Regimental Framework and the Demonstrative Framework of the Cargos in Commission and the Gratified Functions of the National Institute of Metrology, Quality and Technology-Inmeter.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers him on art. 84, caput, inciso VI, paragraph "a", of the Constitution,

D E C R E T A:

Art. 1º Annex I to Decree No 6,275 of November 28, 2007, passes vigorously with the following changes:

" Art. 1º The National Institute of Metrology, Quality and Technology-Inmetre, federal municipality established by Law No. 5,966 of December 11, 1973, with headquarters and venue in the Federal District, linked to the Ministry of Development, Industry and Commerce Exterior, is the central executive body of the National System of Metrology, Normalization and Industrial Quality-Sinmeter, and has by competence:

I-draw up and expedite technical regulations in the areas determined by the National Council of Metrology, Normalization and Industrial Quality-Conmeter ;

II-elaborate and expedite technical regulations on legal metrological control and measuring instruments ;

III-exercise the power of administrative police in the area of legal metrology, which may be delegated to public law bodies or entities ;

IV-exercise administrative police power, and expedite technical regulations in the areas of conformity assessment of products, inputs and services, provided that they do not constitute the object of the competence of other organs or entities of the federal public administration, as to:

a) security ;

b) protection of life and human, animal and plant health ;

c) protection of the environment ; and

d) prevention of deceptive trade practices ;

V-run, coordinate and supervise the legal metrology and assessment activities of compulsory compliance by it regulated or exercised by delegation ;

VI-act as an official accreditation body of conformity assessment bodies ;

VII-register objects subject to the assessment of compulsory compliance ;

VIII-plan and perform research, teaching and scientific and technological development activities in metrology, conformity assessment, and related areas ;

IX-provide technological transfer services and technical cooperation aimed at innovation and scientific and technological research in metrology, conformity assessment and related areas ;

X-provide services aimed at technical strengthening and innovation in national companies ;

XI-produce and alienate reference materials, metrological patterns and related products ;

XII-carry out contributions to congenial foreign entities, whose interests are amidded in agreements struck between each other or between their respective countries, as a single action ;

XIII-designate public or private entities to perform technical activities in the areas of legal metrology and conformity assessment, within the framework of their regulatory competence ;

XIV-acting as an official body of monitoring compliance with the principles of good laboratory practice ;

XV-grant scientific and technological research grants for the development of product technology or process technology, of continuous character, directly or through partnership with public institutions or private ;

XVI-establish partnerships with educational entities for training and professional specialization in the areas of their acting, including for technical residency programs ;

XVII-annual in the process of importing products by it regulated that are subject to non-automatic licensing regime or other measures of administrative control prior to dispatch for consumption ; and

XVIII-represent the Country in regional, national and international forums on conformity assessment. " (NR)

V-co-ordinate, in conjunction with the Directorate of Administration and Finance and with the Directorate of Planning and Institutional Articulation, the actions of budget and financial repasses to RBMLQ-I;

X-coordinate the integrated action of the sector and regional chambers with the manager board and plenary meetings of RBMLQ-I; and

XI-scrutinizing compliance with technical and legal standards as to units of measurement, measurement methods, materialized measures, measuring instruments and pre-measured products. "(NR)

IX-plan and execute the accreditation activities of calibration and testing laboratories, proficiency testing providers, conformity assessment bodies and others necessary for the development of the technological services infrastructure in the Country. " (NR)

" Art. 11. To the Directorate of Planning and Institutional Articulation competes:

IV-coordinate actions on human resource development, and plan, coordinate, direct, supervise, monitor and evaluate the implementation of the actions concerning the Federal Administration's Civil Personnel System, within the framework of of the Inmeter ;

VI-coordinate, plan, direct and execute technological information activities and deploy diffusion actions of metrology culture, standardization, conformity assessment, and on technical barriers to the business sectors, technology, academic and scientific, contributing to the technological modernization of

VIII-formulating institutional strategic guidelines ; and

IX-stimulates the use of quality management techniques in Brazilian companies. "(NR)

I-plan, coordinate, direct, supervise, monitor, and evaluate the implementation of the actions concerning the General Services, Financial Administration and Federal Accounting Systems within the framework of the Inter ; and

" Art. 13. To the Directorate for Evaluation of Conformity competes:

III-coordinating the activity of conformity assessment, voluntary or compulsory, of products, services, processes and persons, and to carry out feasibility studies, development, deployment, monitoring and evaluation of the different conformity assessment programmes, within the framework of the Sinmeter ;

VII-to implement national policy and to draw up technical regulations, in the area of quality ;

X-stimulates the use of quality management techniques in Brazilian companies ; and

XI-strengthen the participation of the Country in international activities and exchange with foreign and international entities and bodies within the framework of conformity assessment. "(NR)

VI-retain the standards of the units of measurement, and deploy and maintain the traceability chain of the metrological patterns of the various laboratories in the Country, referred to international standards ;

I-orient, plan, drive, coordinate, control, and perform legal metrology activities ;

II-proposal projects of metrological technical regulations ;

IV-specify the requirements of the measuring instrument models by examining them, defining them and approving-them ;

VI-establish the specifications of equipment, standards and facilities to be used by the organs of RBMLQ-I;

VII-participate in international and regional forums related to legal metrology, and represent Brazil in the International Organization of Legal Metrology and other international instances of legal metrology ;

VIII-participate in technical cooperations with governmental bodies, metrology institutes, research centres and universities within the framework of legal metrology ;

IX-disseminate knowledge of legal metrology to the society ;

X-establish action guidelines within the framework of legal metrology, in compliance with consolidated policies of the Conmeter ; and

XI-technically evaluate the processes of autuation of resource-grade infractions, advinds of legal metrological control. "(NR)

" Art. 16-A. To the Directorate of Applied Metrology in Life Sciences competes:

I-plan, direct, coordinate and supervise the execution of activities within the framework of metrology applied to the life sciences ;

II-establish acting guidelines within the scope of metrology applied to the areas of life science ;

III-create and preserve reference materials related to life sciences ;

IV-develop scientific and technological research relating to metrology applied to life sciences ;

V-disseminate knowledge to the society in its area of acting, through courses, publication of institutional material, methodologies and presentation of work at technical and scientific events ;

VI-create mechanisms of interaction between the Inmeter and other educational and scientific and technological research institutions, to strengthen the institutional scientific complex, in the biological area ;

VII-manage the deployment of national infrastructure support to the biological area, including maintaining standard collections of culture of prokaryotic and eukaryotic cells, of plasmids and experimentation animals ;

VIII-create interaction mechanisms of the Inter with agencies of fostering activity in science, technology and innovation, in the biological area ;

IX-assisting the Brazilian industry in characterizing and determining the properties of biological materials and materials of use in the area of health ; and

X-aiding the public safety sector in the development of reference materials, methodologies and essay services useful in criminalistic activities. " (NR)

XII-create Representation offices, with the approval of the Ministry of Development, Industry and Foreign Trade, in Federation States, when it is made necessary for full compliance with the institutional mission ; and

XIII-provide technical and administrative support to the Conmeter and its advising committees, acting as the Executive Secretary of the Conmeter. " (NR)

Art. 2º The Table "a" of Annex II to Decree No. 6,275, 2007, passes in the form of the Annex to this Decree.

Art. 3º The apostillations arising from changes promoted by this Decree should occur within twenty days, counted from the date of their entry into force.

Art. 4º The occupier of office which cees to exist by virtue of this Decree shall be deemed to be automatically exonerated or dispensed.

Art. 5º This Decree enters into force twenty-eight days after the date of its publication.

Art. 6º It is revoked the inciso V of the art's caput . 16 of Annex I to Decree No 6,275 of November 28, 2007.
